Tms INDENTURE, made this 25th day of February, 2005, by and between HUGH J.
SIMON and 10 ANNE SIMON, both of Richmond County, State of Georgia, as parties of the
first part. and AUGUSTA, GEORGIA, a political subdivision of the State of Georgia, as party of
the second part;
WITNESSETH:
That the parties of the first part, for and in consideration of the sum of One Hundred
Thirty Five Thousand and No/lOO ($135,000.00) Dollars, in hand paid, at or before the sealing
and delivery of these prestmce, the receipt and sufficiency of which is hereby acknowledged, has
granted, bargained, sold and conveyed, and by--these presence does hereby grant, bargaj,n, sell
and convey unto the said party of the second part, its sucdessors and assigns, the property more .
fully described in Bxhibit "A" attached hereto.
TO HAVE AND TO HOLD the said property, together with all ai1d singular of the
rights, ways, easements and appurtenances thereo~ to the 8atne being, belonging, or in anywise
appeltSl1,,;ng, to the only property use, benefit and behoof of the said party of the second party,
its successors and assigns, in fee simple, forever.

All that lot or parcel of land, with improvements thereon, situate, lying and being in
Richmond County, Georgia, being known and designated as Lot 35 of Crestview
Subdivision recorded in the Office of the Clerk of the Superior Court of Richmond
County, Georgia, in Realty Book 13-S, page 28, and shown upon an individual plat
prepared by D. L. Printup, Jr., dated January 17, 1966, attached to a certain Warranty
Deed from Floyd Thigpen to John T. Chandler and Barbara H. Chandler recorded in said
Clerk's Office in Realty Book 32-K, page 561-562; reference hereby being made to said
plats for a more complete and accurate description as to the metes, bounds and location of
said property. The improvements on said property are known under the present street
numbering system in use in Richmond County, Georgia as 2854 Pineview Road.
This conveyance is made subject to Protective Covenants applicable to said subdivision
appearing of record in said Clerk's Office in Realty Book 13-S, page 28-29.

3. Sellers and Purchaser hereby acknowledge that each has read and approved the
foregoing Closing Statement and agree that it accurately reflects the substance of the
financial aspects of the transaction and the parties hereby approve and direct the Closing
'Attorney to disburse the proceeds and expense of the sale and purohase in accordance
with this Closing Statement. No responsibility is assumed by the Closing Attorney for
the accuracy of the figures obtained from others. Sellers and their agent, in receiving the
funds disbursed herein, release the Purchaser and the Closing Attorney fi:om any Claims
against the funds disbursed herein and the assets which are the subject of this closing.
Purchaser and Sellers acknowledge that certain ancillary costs in the transfer shall be paid
outside of closing. .
