RESOLUTION APPROVING AND ACCEPTING A DEED OF DEDICATION FROM AUGUSTA TO THE AUGUSTA UTILITIES DEPARTMENT (Franke Industrial Boulevard) WHEREAS, the Augusta-Richmond County Commission has been petitioned to approve and accept a Deed of Dedication from Augusta to the Augusta Utilities Department, a copy of which is attached hereto as Exhibit A; and WHEREAS, the Augusta-Richmond County Commission has elected to approve and accept said Deed; and WHEREAS, it is appropriate for approval and acceptance of the Deed by the Augusta- Richmond County Commission be shown by execution of said Deed; NOW, THEREFORE, it is hereby resolved as follows: 1. The Augusta-Richmond County Commission does hereby approve and accept the Deed. 2. It is further determined that the Mayor of Augusta, Georgia shall execute the Deed, a copy of which is attached hereto as Exhibit A. This Resolution shall be recorded in the Minutes of the Augusta-Richmond County Commission, accompanied by the exhibits referred to herein. Retention Pond (County Owned & Maintained) " on a plat created of Bobby Jones Business Park, Phase II-B, by James G. Swift & Associates, dated August 14, 2001, and recorded in the realty records section of the Office of the Clerk of the Superior Court of Richmond County, Georgia, in Realty Reel 750, Page 973. WHEREAS, the Augusta Utilities Department desires to record a permanent Utility Corridor across this property for the purposes of installing utility pipelines; and WHEREAS, Augusta, Georgia desires to dedicate this utility corridor for the use of the Augusta Utilities Department; NOW, THEREFORE, this indenture, made and entered into this I sf'- day of ~lfd4" , 2008, by Augusta, Georgia, a political subdivision of the State of Georgia, for the use and benefit oft~e Augusta Utilities Department, a department of Augusta, Georgia; WIT N E SSE T H: Augusta, Georgia, in consideration of the public benefit to be derived by Augusta, Georgia and its citizens and for valuable consideration, the receipt and sufficiency of which is hereby acknowledged, has granted, bargained, sold and conveyed, and by these presence does hereby grant, bargain, sell and convey unto the Augusta Utilities Department all that tract or parcel ofland located in Augusta, Georgia, consisting of 4,315 square feet, as shown on a plat prepared for Augusta Utilities by Cranston Engineering Group, P.C., dated March 27, 2007, attached hereto and made a part hereof, to Book 01163:0762 Augusta - Richmond County 200800559402/06/2008 16:41 :22.01 ., which reference is made for a more accurate and complete description of the metes, bounds and courses, and being for the purpose of laying, relaying, installing, adding, expanding, extending, operating, repairing and maintaining pipelines transporting and carrying water and sewer services. AUGUSTA, GEORGIA does also grant, bargain, sell and convey unto the Augusta Utilities Department, its successors and assigns, the right, but not the duty, to clear, and keep clear, all trees, undergrowth and other obstructions from said permanent easement, along with the free right of ingress and egress to and from said permanent easement for this purpose and all other purposes stated herein.
