EXISTING UNDER THE LAWS OF THE STATE OF GEORGIA, as parties of
th,~ First Part; and AUGUSTA, GEORGIA, a political subdivision of the State of
Gt:~orgia, as party of the Second Part:
WITNESSETH: THAT - the parties of the First Part for and in
consideration of the sum of TEN AND NO/I00 ($10.00) DOLLARS, the receipt
and sufficiency of which are hereby acknowledged, and other valuable
consideration to hereinafter described, has granted, bargained, sold, conveyed,
released and confirmed and by these presents does hereby grant, bargain, sell,
release, convey and confirm, to the party of the Second Part, its successors and
assigns, the following described. property, to-wit:
All those strips or parcels of land, situate, lying and being in Richmond
County, Georgia, in Section Two of Spirit Pointe Subdivision, being portions or
all of Vantage Way, Commonwealth W~y and Patriot Drive. Said property is
more particularly shown and described on a plat of Section Two of Spirit Pointe
Subdivision prepared by Southern Partners, Inc., under date of June 28, 1994;
said plat is recorded in the Office of the Clerk of Superior Court of Richmond
COlllnty, Georgia, in Reel 493. at pages 37; and reference is hereby made to said
plat for a more complete and accurate description as to metes, bounds and
location of said property.
ALSO, THE RIGaTS TO USE IN COMMON WITH THE GRANTORS
ALL DRAINAGE AND UTILITY EASEMENTS AS SHOWN ON THE
AFORESAID RECORDED PLAT. The party of the Second Part, as a part of

by and between GOLMAR. INC., hereinafter referred taas "Develaper," and AUGUSTA,
GEORGIA, a palitic:al .sllbdivision;of the Stat~,af Geargia, _~9~ing by ~nd thraugh its
Cammissian, hereinafter referred to as "Augusta."
WHEREAS, the Developer r~quested,.. that .', the - Augusta, Georgia,
Commissian accept certain roads, storm drains and appurtenances far Spirit Pointe
Subdivisian. Sectian Twa, as shown by deed contemparaneausly tendered and recarded in

WHEREAS, ,the City has adopted a palicy requiring the Develaper ta
maintain all.installatians laid or installed in the subdiyisian far a periad o,ftwelve manths,
which Augusta accepts by deed;
NOW, THEREFORE, III consideratian .of the premIses, the expense
previausly incurred by Develaper and the mutual agreements hereinafter set out, IT IS
AGREED that:

in the deed cantemparaneausly tendered herewith to the Augusta, Geargia, Cammission,

(2) The Developer agrees to maintain all the installatians laid .or installed
. in said subdivisian as described in said deed for a period .of twelve manths fram the date
herein.
(3) The Developer agrees that if during said twelve manth periad there is
a failure .of the installatians laid .or installed in said subdivisian described in the deed due
ta failure .of material .or paar workmanship, the Develaper shall be respansible far
adequate maintenance and repair.

the Develaper and set forth in writing the items in need .of repair. The Develaper shall

. (5) In the event .of 'an emergency, as determined by Augusta, the
Develaper is unable ta respand in a timely mmmer, the City shall be autharized ta erect
-b~~tades; traffic direction devices and such other temporary measures as are necessary to
- remedy the ~mergency nature .of the problem at the Develaper's expense andtaallaw the

Develaper time ta make the needed repairs.

(6) In the event the Developer fails to comply with the terms of this
agreement, then Augusta shall proceed to have the necessary corrective work done, and the
Developer agrees to be responsible to Augusta for payment in full of costs of repairing the
improvements due to failure of material or poor workmanship as liquidated damages.
IN WITNESS WHEREOF, Developer has hereunto set his hand and seal,
and Augusta has caused the execution of this agreement by and through its duly authorized
officers and agents, with its seal affixed, the day and year first above written.
