STATE OF GEORGIA ) ) COUNTY OF RICHMOND) DEED UNDER POWER THIS INDENTURE, made and entered into this ih day of May, 2008 between Claude A. Rogers and Frances C. Rogers, by Augusta, Georgia as Attorney in Fact (hereinafter "party ofthe first part"), and Augusta, Georgia (hereinafter "party of the second part"); and WHEREAS, Claude A. Rogers and Frances C. Rogers executed and delivered a Note and Deed to Secure Debt dated March 11, 1997 and recorded in the Office of the clerk of Superior Court of Richmond County, Georgia, in Book 73, page 508, conveying property to be hereinafter described, to Percy Blount and Charles William Hock as security for an indebtedness evidenced by a certain promissory note originally in the principal sum of $7,000.00; and WHEREAS, Percy Blount and Charles William Hock executed and delivered a Transfer of said Note and Deed to Secure Debt dated February 25, 2008 and recorded in the Office of the Clerk of Superior Court of Richmond County, Georgia, in Book 1167, Page 741, to party of the second part; and WHEREAS, Default having occurred in the payment of said indebtedness, party of the second part, the owner and holder of said Security Deed and said Note, under the terms and provisions thereof, elected to declare immediately due and payable the entire indebtedness secured by said Security Deed and the said party of the first part having failed to pay the same, party of the second part proceeded to sell said property pursuant to the power of sale contained in said Security Deed, and advertised said property for sale, specifying that the same would be sold at auction at the usual place of conducting sales at the Courthouse Door in Richmond County, Georgia, to the highest and best bidder, for cash, between the legal hours of sale, on the first Tuesday in May, 2008, to-wit: May 6, 2008, which advertisement was published once a week for four weeks immediately preceding said sale in the Augusta Chronicle, the newspaper published in said county in which sheriff's advertisements are published, and pursuant to the powers contained in said Security Deed, and in compliance with the terms of said advertisement, party of the first part exposed said property for sale at auction at the time and place designated in said advertisement, and thereupon the property was sold to party of the second part as the highest bidder for cash, at and for the sum of $20,011.95; and WHEREAS, proper, timely and legal notice of the foreclosure sale was given to the debtors in compliance with Official Code of Georgia Annotated Section 44-14-162 through 44-14-162.4. Book 01176:0400 Augusta - Richmond County 200802440505/12/2008 11 :06:01.00 .,t WI T N E SSE T H: That the said party of the first part, for and in consideration of the sum of twenty thousand, eleven and 95/100 Dollars ($20,011.95) in cash to them in hand well and truly paid by the party of the second part, at and before the sealing and delivery of these presents, the receipt of which is hereby acknowledged, has granted, bargained, sold, released, conveyed and confirmed and by these presents does grant, bargain, sell, release, convey and confirm unto the party of the second part, its successors and assigns, the following described property, to wit: All that lot or parcel of land, with improvements thereon, situate, lying and being in the State of Georgia, County of Richmond, being known and designated as property fronting a distance of 40 feet on the North side of Fenwick Street between Chafee Avenue and Wrights Avenue and extending back in a northerly direction between parallel lines a distance of 132 feet. Being known and designated as Lot 109 on a plat recorded in the office of the Clerk of Superior Court of Richmond County, Georgia, in Realty Book 3-Z, Page 602; reference is made to said plat for a more complete and accurate description as to the metes, bounds and location of said property. Said property being known under the present system of house numbering in Richmond County, Georgia, as 1557 Fenwick Street. Map 035-4 Parcel 335 TOGETHER WITH ALL AND SINGULAR the rights, easements, ways, members and appurtenances to said property being, belonging or in anywise appertaining and the remainders, reversions, rents, issues and profits thereof, and every part thereof. TO HAVE AND HOLD said property and all and singular the members and appurtenances thereto belonging as aforesaid, and every part thereof, unto the party ofthe second part, its successors and assigns, forever in fee simple.
