DEED OF DEDICATION
WHEREAS, BOBBY JONES BUSINESS PARK JOINT VENTURE, a
Georgia general partnership composed of SHERMAN & HEMSTREET, INC.,
SANDHILL DEVELOPMENTS, INC., W. F. FRANKE, JR., H. ALLEN STRICKLAND
and ROBERT R. WARR (the "Developer"), having its principal office
in Richmond County, Georgia, owns a tract of land in Richmond
County, Georgia, known as the Bobby Jones Business Park in which it
has laid out streets, street rights-of -way and a storm water
drainage system (the "Improvements"); and
WHEREAS, it is the desire of the Developer to convey the
Improvements to the Richmond County Board of Commissioners, a
political subdivision of the State of Georgia (the "County"), for
maintenance and control; and
WHEREAS, the County has consented and agreed to accept
and maintain said road and Improvements;
NOW, THEREFORE, this indenture made this day of
, 199 , between BOBBY JONES BUSINESS PARK JOINT VENTURE, as
the Grantor, and RICHMOND COUNTY, GEORGIA, as the Grantee;
WIT N E SSE T H:
That the Developer, for and in consideration of the sum
of One and nO/lOa ($1.00) Dollar to it in hand well and truly paid
by the County, at and before the execution, sealing and delivery of
these presents, the receipt of which is hereby acknowledged and for
the further consideration of the benefits to its property by the
maintenance of said Improvements by the County, has and by these
presents does grant, bargain, sell, confirm and convey unto the
County, its successors and assigns, the following described
property which is located in Richmond County, Georgia, to-wit:
A street with a right-of-way of 60 feet named
Franke Industrial Drive and the southwestern
portion (hereinafter specifically described)
of a street with a right-of-way of 60 feet
named Franke Court as well as the surface
water and storm water easements shown on a
plat of Bobby Jones Business Park prepared by
James G. Swift, R.L.S. on , 1995, a
copy of which is recorded in the Office of the
Clerk of the Superior Court of Richmond
County, Georgia, in Realty Reel ,s-I/ , at
Pages .2 J S" ' which plat is incorporated
herein and made a part of this description.
The portion of Franke Court hereby conveyed is
that portion which lies south and west of a
line which is the southeasterly extension of
the boundary between Lots 10 and 11 in Block A
as shown on said plat to the northwesternmost
corner of the Sharon Baptist Church Cemetery.
TO HAVE AND TO HOLD said streets, rights-of-way and
easements together with all and singular the rights, members and
appurtenances thereof to the same being, belonging or in anywise
appertaining to the only proper use, benefit and behoof of the
County, its successors and assigns, forever in fee simple.
And the Developer, its successors and assigns, will
warrant and defend the right and title to the above described
property to the County, its successors and assigns, against all
claims of all persons claiming under the Grantor.

MAINTENANCE AGREEMENT
THIS AGREEMENT, entered into this day of .
199 , by and between BOBBY JONES BUSINESS PARK JOINT VENTURE, a
Georgia General Partnership composed of SHERMAN & HEMSTREET, INC.,
SANDHILL DEVELOPMENTS, INC., W. F. FRANKE, JR., H. ALLEN STRICKLAND
and ROBERT R. WARR, hereinafter referred to as "Developer", and
RICHMOND COUNTY, GEORGIA, a political subdivision of the State of
Georgia, acting by and through its BOARD OF COMMISSIONERS,
hereinafter referred to as "the County."
WHEREAS, Developer requested that the Richmond County
Board of Commissioners accept certain roads, storm drains and
appurtenances (the "Improvements") for Bobby Jones Business Park
(the "Subdivision") contemporaneously tendered and recorded in the
Office of the Clerk of the Superior Court of Richmond County,
Georgia, in Realty Reel , at Pages ; and

WHEREAS, Richmond County has adopted a policy requiring
the Developer to maintain all installations laid or installed in
the Subdivision for a period of twelve months, which the County
accepts by deed;
NOW, THEREFORE, in consideration of the premises, the
expense previously incurred by Developer and the mutual agreements
hereinafter set out, IT IS AGREED:
1. The County accepts the roads, storm drains and
appurtenances , respectively described in the deed contemporaneously
tendered herewith to the Richmond County Board of Commissioners,
recorded in the Office of the Clerk of the Superior Court of
Richmond County, Georgia, in Realty Reel
at Pages
2. The Developer agrees to maintain all the
installations laid or installed in said Subdivision as described in
said deed for a period of twelve months from the date hereof.
3. The Developer agrees that if during said twelve
month period there is a failure of the installations laid or
installed in said Subdivision described in the deed due to failure
of material or poor workmanship, the Developer shall be responsible
for adequate maintenance and repair.
4. In the event of such failure of the Improvements,
the County shall notify the Developer and set forth in writing the
items in need of repair. The Developer shall present within
fifteen (15) business days its proposed plan of repair and shall
have the repairs completed at a reasonable time, as determined by
the County.
5. In the event of an emergency, as determined by the
County, and the Developer is unable to respond in a timely manner,
the County shall be authorized to erect barricades, traffic
direction devices and such other temporary measures as are
necessary to remedy the emergency nature of the problem at the
Developer's expense and to allow the Developer time to make the
needed repairs.
6. In the event Developer fails to comply with the
terms of this Agreement, then the County shall proceed to have the
necessary corrective work done, and the Developer agrees to be

responsible to the County for payment in full of costs of repairing
the Improvements due to failure of material or poor workmanship as
liquidated damages.
IN WITNESS WHEREOF, Developer has caused these presents
to be executed under seal and the County has caused the execution
of this Agreement by and through its duly authorized officers and
agents, with its seal affixed, the day and year first above
written.

WHEREAS,
Franke Court
is an existing road in
Richmond County, Georgia, open to public usage; and
WHEREAS, Richmond County desires to make Franke
Court a part of its County Road System.
NOW, THEREFORE, BE IT RESOLVED by the Augusta-
Richmond County commission-Council of Richmond County,
Georgia, that Franke Court is hereby added to its official

approximate alignment and location of said Road.
