Sussman, DalE: E. Toporek, Seth Toporek and Louis L. Battey to
Richmond County, dated October 31, 1996, which has been recorded in
the office of the Clerk of the Superior Court of Richmond County,
Georgia, in Realty Reel 542, pages 1287-1294.

WARRANTY DEED

THIS ll'JDENTURE, made and entered into this ?) day of October in the
year Nineteen Hundred Ninety-Six, between BAILEY INVESTMENT COMPANY, a
Georgia Corpuration, HY SUSSMAN, DALE E. TOPOREK, SETH TOPOREK
AND LOUIS L BATTEY, hereinafter collectively referred to as "party of the first part",
and RICHMOND COUNTY, GEORGIA, a political subdivision of the State of
Georgia, hereinafter referred to as "party of the second part";
WITNESSETH that the said party of the first part, for and in consideration of the
sum of Ten and No/100 ($10.00) Dollars and other good and valuable consideration in
hand well and 1ruly paid by the party of the second part, at and before the sealing and
delivery of these presents, the receipt whereof is hereby acknowledged, has granted,
bargained, sold. released, conveyed and confirmed, and by these presents does grant,
bargain, sell, release, convey and confirm, unto the said party of the second part, its heirs
and assigns the :following described property, to-wit:
SEE EXHIBIT "A" ATTACHED HERETO AND
BY REFERENCE INCORPORATED HEREIN.
The property described on Exhibit "A" is conveyed unto the party
of the second part in the following undivided interests:
Bailey Investment Company-l/3
Hy Sussman-l/6
Dale E. Toporek-l/12
Seth Toporek-l/12
Louis L. Battey-1I3
As part of the consideration for the conveyance herein described, the party
of the second part has agreed and does hereby agree to cause certain
sanitary sewage facilities to be installed across other property of the party
of the fust part and across certain easements controlled by the party of the
first part or Bailey Investment Company, hereinafter described, all in
accordance with certain plans prepared by James G. Swift & Associates

regarding the Highpointe trunk sewer from Hill Creek to Frontage Road,
such plans being dated February, 1989, last revised August 21, 1996, such
installation to be completed on or before March 1, 1997.
Bailey Investment Company joins in the execution and delivery of these
presents for the additional purpose of conveying unto the party of the
second part all of its right, title and interest (without warranty of title) in
and to the following described easements:
1. From William S. Morris, III, et al. recorded in said Clerk's Office
at Realty Reel 303, page 2106.
2. From Robby Wayne Lanier, as Executor, et al. dated October 29,
1986, recorded in said Clerk's Office at Realty Reel 275, page 847.
3. From William L. Hogue, et al. dated November 7, 1987, recorded
in said Clerk's Office at Realty Reel 275, page 855, et seq.
TOGETHER WITH ALL AND SINGULAR the rights, easements, ways,
members and appurtenances to said land, being, belonging or in any wise appertaining,
and the remainders, reversions, rents, issues and profits thereof, and every part thereof;
TO HAVE AND TO HOLD said land and all and singular the members and
appurtenances thereunto belonging as aforesaid, and every part thereof, unto the party of
the second part, its heirs and assigns, forever, in fee simple;
AND THE SAID PARTY OF THE FIRST PART, its heirs and legal
representatives, the said land unto the party of the second part, its heirs, legal
representatives and assigns, against the party of the first part, its heirs and legal
representatives, and against the lawful claim or claims of any person or persons
whomsoever, shall and will WARRANT and forever defend by these presents, but not
against any exception hereinabove set forth.
THE PHRASES "PARTY OF THE FIRST PART" and "party of the second part",
as used in the singular herein, shall, when appropriate, be construed to read as if written
in the plural, and the pronouns and relative words used herein shall, when appropriate, be
construed to read as if written in the feminine or neuter, respectively, and the word
"successors" shall be substituted for the word "heirs" when appropriate.
IN WITNESS WHEREOF, the party of the first part has caused these presents to
be executed by and through its duly authorized corporate officers and its corporate seal
affixed or have hereunto set their hands seals, as the case may be, the day and year first
above written as the date of these presents.

EXHIBIT "A"

ALL that tract or parcel of land situate, lying and being in the State of Georgia and County of
Richmond and being shown and designated as "Parcel 'A' - 0.69 Ac." on a certain plat prepared
for Augusta-Richmond County Commission Council by James G. Swift & Associates, dated
August 2, 1996, a copy of said plat being recorded in the Office of the Clerk of Superior Court of
Richmond County, Georgia at Plat Book,5 if ~ ' page f~'X f -I ~<t;" , reference being made to
said plat for a more particular description of the property hereby conveyed.
Together with the following non-exclusive easements:
1. Perpetual easement for ingress and egress, over and across that certain area designated as
"20' Ingress - Egress Easement 'B'" as shown on the aforementioned plat.
2. Perpetual easement for purposes of installation and maintenance of sanitary sewage
facilities over, under, across and through that certain area designated as "15' Sanitary Sewer
Easement 'c'" as shown on the aforementioned plat, and a temporary easement for purposes of
construction installation of such facilities over, under, across and through that certain area
designated as "Temporary Construction Easement, 20,429 sq. ft., 0.46 Ac." in the
aforementioned plat, which temporary easement will expire upon the completion of such
construction and installation.
Reserving, however, unto the party of the first part a non-exclusive drainage and utility easement
over and across that certain area described on the aforementioned plat as "20' Drainage & Utility
Easement "D"", reference being made to said plat for a more particular description.
