EASEMENT DEED
PARCEL IDENTIFICATION NUMBER: 026-2-120-00-0 ADDRESS: 202 Lakewood Drive
THIS INDENTURE made and entered into'this L day of A' (), ' 2004, between Herbert E.
Kernaghan, Jr. and Jean H. Kernaghan, hereinafter referred to as OWNERS, and Augusta, Georgia, a political
subdivision under the laws of Georgia, hereinafter referred to as AUGUSTA;
WITNESSETH, that Owners, for and in consideration of the sum of ONE DOLLAR ($1.00) in hand and
truly paid by Augusta at and before the sealing and delivery of these presents, and other valuable consideration, the
receipt whereof is hereby acknowledged, have granted, bargained, sold, conveyed and confIrmed, and by these
presents does grant, bargain, sell, convey and confirm unto Aygusta, its successors and assigns, an easement in
perpetuity under, across and through the hereinafter described parcel ofland.
Said easement consists of 3,971 Square Feet, more or less, as shown on a plat prepared by Cranston,
Robertson & Whitehurst, P.e., dated July 29, 2003, revised October 10, 2003, attached hereto and made a part
hereof, to which reference is made for a more accurate and complete description of the metes, bounds and courses,
and being for the purpose of laying, relaying, installing, extending, operating, repairing and maintaining pipelines
transporting and carrying utility services.
Owners do also grant unto Augusta a temporary easement consisting of 1,983 Square Feet, more or less, as
shown on said plat. Said easement is granted together with the right to dig such trenches in said parcel of land' as
may be necessary, for the Project, to pile thereon the material excavated, and to haul pipe, supplies and equipment
connected with the construction and maintenance thereof, over, along and across the said parcel of land. Said
temporary easement shall expire at the completion and final acceptance of the Project by Augusta.
Augusta does hereby agree to restore said easements in accordance with a plan developed by Roger Davis,
Landscape Architect, dated June 21, 2004, revised July 21, 2004, and kept in the office of the Augusta Utilities
Department, 360 Bay Street, Augusta, Georgia.
Augusta does hereby agree to remove, or have removed, at its convenience and expense, a large tree
directly adjacent to the barbeque pit, should said tree die as a result of the construction of the sewer line within one
year from the completion of the project. Said tree is shown as a 33" oak on the plan developed by Roger Davis.
Augusta does hereby agree to construct, or have constructed, at its expense and discretion, a boat anchor of
buried concrete with the capability to restrain a cable with which to hold a dock.
Owners, their heirs, assigns and legal representatives, after the completion of this Project, shall have the
right to use said parcel of land in any manner not inconsistent or interfering with the rights herein granted,
excluding, however, the right to erect, construct, maintain, or otherwise place on the permanent easement, a
building, structure, or any other pennanent type of structure.

Augusta does agree to allow Owners to plant ornamental trees and shrubs \\jthin the permanent easement"
as long as they do not exceed eight feet in height and are planted outside of a distance of five feet on either side of
the centerline of the pipeline.
Owners agree that all plantings are to be hand dug, to minimize damage tp the pipeline.
Owners further agree that all such plantings will be at the discretion and expense of the Owners and, should
they b,e damaged due to the future maintenance, repair, or operation of the pipeline, Augusta will not bear the
responsibility, or liability, for their replacement.
Owners do also grant, bargain, sell and convey unto Augusta, its successors and assigns, the free right of
ingress and egress to and from said permanent easement for the purpose for the purpose of operating, repairing and
maintaining pipelines transporting and carrying utility.
TO HAVE AND TO HOLD the aforesaid rights, ways, easements, privileges and appurtenances unto
Augusta, its successors and assigns, in perpetuity.
And Owners, their heirs, assigns and legal representatives shall and will forever warrant and defend unto
Augusta, its successors and' assigns, the rights, ways, easements privileges and appurtenances conveyed herein,
, against the claim of any person or persons whomsoever.
IN WITNESS WHEREOF, Owners and Augusta have set their hand and seal, the day and year first above
