BETWEEN THE
GEORGIA ENVIRONMENTAL FACILITIES AUTHORITY
AND THE
GEORGIA ENVIRONMENTAL PROTECTION DIVISION
AND THE
CITY OF AUGUSTA
This CONTRACT (Contract #(97)00-4-0650-1018) made and entered into as of the date
of execution by and between the Georgia Environmental Facilities Authority, a public
corporation and instrumentality of the State of Georgia, hereinafter referred to as
"GEFA," the Georgia Environmental Protection Division of the Department of Natural
Resources, hereinafter referred to as "EPD," and the City of Augusta, hereinafter
referred to as "Augusta."
WITNESSETH
WHEREAS. GEFA was established by the Georgia Environmental Facilities
Authority Act of 1986 (Georgia Law 1986, p, 569, Section 1; O.C.G.A. Section 50-23-1)
and EPD may jointly enter into contractual agreements; and
WHEREAS, Congress, by the "Safe Drinking Water Act (SDWA) Amendments of
1996," Public L. 104-182, amending title XIV of the Public Health Service Act has
empowered the United States Environmental Protection Agency (EPA) to make
capitalization grants to assist in establishing a drinking water state revolving fund
(DWSRF) for assistance to public water systems in financing the cost of infrastructure
needed to achieve or maintain compliance with SOW A requirements and to protect
public health, Section 130, subsection 1452(a)(1); and
WHEREAS, Section 1452 of the SOW A authorizes States to provide funding for
certain non-project activities, called Set-Asides from the DWSRF for capacity
development and source water assessment and protection for public water systems at
the local government level to assist EPD in compliance with the requirements of the
Safe Drinking Water Act Amendments of 1996; and
WHEREAS. EPD has appropriated funds for source water assessment to assist
local governments through contracts to coordinate and facilitate the implementation of
the State's Source Water Assessment and Protection Plan;
WHEREAS, GEFA has entered into an interagency agreement with EPD to
assist in the administration of DWSRF to oversee the development of plans and

projects to meet the environmental protection needs of the State and its political
subdivisions; and
WHEREAS, Augusta has the capability to facilitate the development of
watershed source water assessments, an effort to evaluate and inventory potential
pollution sources and establish overall pollution potential and risk associated with
individual water supply intakes; and
WHEREAS, EPA has approved the DWSRF Intended Use Plan for FY 1997,
which includes assisting local governments with watershed planning and protection
through Georgia's Public Water Source Water Assessment Program,
NOW, THEREFORE, GEFA, EPD, AND AUGUSTA AGREE AS FOLLOWS:
A. Augusta agrees:
1. To perform all required services in accordance with this Contract and as set
forth in the Scope of Work, Attachment A, and to utilize the funds provided under
this Contract for such purposes. Attachment A is incorporated herein and made
a part of this Contract.
2. To utilize the funds in accordance with all applicable laws of the State of
Georgia and further agrees that this Contract is at all times subject to State laws,
rules, and regulations and all rights, privileges, and responsibilities shall be
interpreted and construed accordingly.
3, To maintain in orderly form all financial records pertaining to the expenditure
of funds provided under this Contract for a period of three years after the date of
execution and to make such records available to EPD and/or GEFA upon
request.
4. To be governed by the provisions of the SDWA Amendments of 1996, State
Drinking Water Act and Rules, all applicable federal circulars, and federal cross-
cutting authorities and rules, as published by the Office of Management and
Budget.
5. To establish and maintain a separate account for this project and comply with
the reasonable requests of GEFA, and/or EPD for information pertaining to
Augusta's compliance with this Contract, the provisions of Title XIV, and
regulations and guidance promulgated thereunder and OMB Circulars A-11 0
(Uniform Administrative Requirements) and A-122 (Cost Principles). The
required annual audit shall be conducted in accordance with federal Circular A-
133 for each fiscal year in which this contract is in effect.

6. To provide to EPD, project status reports on a quarterly basis unless
otherwise directed in writing by GEFA or EPD.
7. To closely coordinate with EPD in the performance of the Scope of Work
included in Attachment A.
B. GEFA agrees:
1. To pay Augusta an amount of $100,000,00 for the proper completion of
required work specified in Attachment A over the duration of this Contract in
accordance with the schedule provided in Attachment B. Payments shall be
made as shown in Attachment B upon receipt of an official invoice from Augusta
and recommendation for payment by EPD. Attachment B is incorporated herein
and made part of this Contract.
C. EPD agrees:
1, To provide sufficient technical guidance to Augusta as may be necessary for
the proper execution and implementation of the duties and services outlined in
Attachment A. Work to be performed under this Contract shall be subject to the

2. To provide timely review of Augusta invoices and to arrange with GEFA for
payment to Augusta.
D. Augusta, GEFA, and EPD, mutually agree:
1. At any time or times prior to or within two (2) years after the completion of this
Contract, a representative of EPD and/or GEFA may make or have made such
audit of the books and records of Augusta bearing upon this Contract as deemed
proper in accordance with the provisions of this Contract.

2. This Contract will be effective from the date of execution until June 30, 2003.
3. EPD reserves the right to change or increase the scope of work in this
Contract. Any such changes shall be mutually agreed upon by all parties. This
Contract shall be amended to incorporate any such changes.
4. This Contract may be extended with the written consent of each party.
5. This Contract may be terminated by any party upon thirty (30) days notice to
the other paries. Upon such termination, Augusta shall be entitled to payment
for only the services properly completed in accordance with this Contract up to
and through the effective date of the termination,
6. Augusta certifies that it is not a nonprofit contractor, as defined in a.C.G.A,
50-20-2, and therefore is not subject to the provisions of a.C.G.A. 50-20-1, et
seq.
7. Payments due under this Contract may not be assigned by Augusta without
the prior written consent of EPD.
8. This Contract represents the sole and complete understanding of the terms of
the agreement between the parties hereto and may be amended, changed or
modified only by a written document signed by the parties hereto,
9. This Contract and all rights, privileges and responsibilities shall be interpreted
and construed according to the laws of the State of Georgia.
Certifications:
a. Lobbying Disclosure: Augusta hereby warrants as a condition of this Contract that
it is not an organization described in Section 501 (c)(4) of the Internal Revenue Code of
1986, which cannot engage in lobbying activities prohibited by the Lobbying Disclosure
Act of 1985. ~
b. Certification Regarding Lobbying: Augusta certifies to the best of its knowledge and
belief that:
(1) No Federal appropriated funds have been paid in full or will be paid, by or on
behalf of Augusta, to any person for influencing or attempting to influence an
officer or employee of a Member of Congress in connection with the awarding of
any Federal contract, the making of any Federal grant, the making of any
Federal loan, the entering into of any cooperative agreement, and the extension,
continuation, renewal, amendment, or modification of any Federal contract,

grant, loan, or cooperative agreement.
(2) If any funds other than Federal appropriated funds have been paid or will be
paid to any person for influencing or attempting to influence an officer or
employee of any agency, a Member of Congress, an officer or employee of
Congress, or an employee of a Member of Congress in connection with this
Contract, then Augusta shall fully disclose same to EPD and the GEFA, and shall
complete and submit Standard Form-LLL, "Disclosure Form to Report Lobbying,"
in accordance with it instructions.
c. Drug free Work Place: Augusta certifies that, in accordance with the provisions of
O.C,G.A. 50-24-1, et seq. a drug-free workplace will be provided Augusta's employees
during the performance of this contract; and it will secure from any subcontractor hired
to work in a drug-free workplace the following written certification: "As part of any
subcontracting agreement (Subcontractor's Name), certifies to Augusta that a drug-free
workplace will be provided for the subcontractor's employees during the performance of
this contract pursuant to paragraph 7 of subsection (b) of Code Section 50-24-3",
d. Completion and Delivery of Services: The satisfactory completion and delivery of
all required services and deliverables pursuant to and in accordance with the provisions
of this Contract shall serve as a prerequisite to any payment(s) otherwise due Augusta
pursuant to this Contract. Provided, further, all payments to Augusta are subject to
available funding. In the event the funding source for this Contract ceases to exist or
otherwise becomes unavailable for the purposes stated herein in the sole discretion of
EPD, then this Contract shall be terminated without further obligation of GEFA or EPD
as of that moment, and this Contract will immediately become null and void.
e. No report, maps or other documents produced in whole or in part under this
Contract shall be subject of an application for copyright by or on behalf of Augusta. All
rights, title and interest in and to all deliverables required under this Contract shall vest
in EPD, Augusta shall execute any and all documentation which may be required in
order to fully effectuate the intent of this paragraph.

SCOPE OF WORK
Augusta-Central Savannah River Basin Water Supply Watershed
Regional Source Water Assessments
I. BACKGROUND
A. Purpose of Project: The 1996 Amendments to the Federal Safe Drinking Water
Act (SDW A) brought about a new approach for ensuring clean and safe drinking water
seNed by public water supplies in the United States. Building upon the past strengths
of the Surface Water Treatment Rule, increases in water monitoring and other
compliance measures, the U.S. Environmental Protection Agency (USEPA) and the
Georgia Environmental Protection Division (GAEPD) are now advocating prevention as
an important tool in the protection of public water supplies from contamination and
source protection. In order to implement prevention and protection, an assessment of
potential pollution sources near the source must first be conducted.
Georgia's SWAP has a specific focus on water supply source protection sharing like
goals with other water quality protection and enhancement programs (e.g. GAEPD
River Basin Management Planning and Nonpoint Source programs). These programs
seek to prevent and control impairments to water quality as well as abate
contamination sources currently impacting uses. With these programs sharing similar
goals, care should be taken to integrate the activities of SWAP so that its
implementation can compliment other water quality protection and enhancement
programs.

B. Study Area: The study area for this project will include the intake catchment
watershed regions for the following public water systems which utilize surface water
sources. This study will require close coordination between officials in Richmond,
Columbia, McDuffie, Wilkes, Burke and Lincoln counties. Additionally, the appropriate
parties located in the portion of the watershed which extends into South Carolina
should be coordinated with closely.

C. Project Management: The GAEPD has requested that the City of Augusta
Utilities Department coordinate the implementation of the State's Source Water
Assessment and Protection Plan (SWAPP) for the afore mentioned systems.
Augusta's Utilities Department will serve as Project Manager and will coordinate and
facilitate completion of tasks in support of the project.
D. Task Force: In order to complete assessments, the work proposed for this study
will involve a Task Force and possibly services of a private contractor or contractors.
Augusta will ensure the establishment of this Task Force soliciting members from the
afore mentioned counties and participating water system owners, and will monitor the
ongoing activity of any private contractors. Additional stakeholders, such as
municipalities, US Army Corps of Engineers, special interest groups, etc" with interest
in the study area should also be invited to have representation on the Task Force.
This Task Force will provide direction and make decisions on critical issues,
II. PROJECT TASKS
A. Delineation and Inventory Significant Sources of Contaminants: The City of
Augusta will delineate the watersheds and inventory significant sources of
contaminants. To accomplish this task Augusta will:

1. Delineate or cause to be delineated the topographic boundary of the
watershed that drains to each surface drinking water intake of the participating
water systems listed in I.B above.
a. Large reservoir previsions: Obtain EPD's concurrence with the area
delineated for assessment particularly as it relates to those intakes
withdrawing directly from Clarks Hill Lake.
b. The assessment of groundwater will not be included in this effort.
2. Map in ArcView other significant geographic features of the watershed such
as county boundaries, cities, major roads, major railroads, and major streams.
All electronic GIS coverages will be ArcView 3.1 compatible,
a. Data coverages: Any regional graphics are to show, at a minimum, the
public water systems within the region, towns and cities, major highways, major
bodies of water, and other political boundaries, a coverage title at the top, a
coverage scale below the graphic.
b, Mapping conventions: A coverage legend in the bottom right-hand corner,
a county index map in the upper right-hand corner showing the county of
interest, and other features and information required by EPD and mutually
agreed upon by Augusta during the term of the contract.
c. Deliverables: Deliverables are to include the electronic project file(s) and
the ArcView 3.1 compatible GIS coverages and four paper copies, printed in
color of any coverages. The color conventions will be supplied to Augusta by
EPD during the contract term,
3. Compile and organize a preliminary list of potential contaminants for each
drinking water intake catchment area and inventory data sources. A multi-
pronged approach of considering both contaminants and contaminant
information sources should be used to complete this task. This approach, as a
minimum, will include the following steps:
a. Identify potential sources and categories of sources and likely
contaminants that they would contribute.
(1) Review lists from EPA and EPD SWAP guidance documents.
(2) Inventory existing programs and collect lists from programs such as
Water Quality 305(b) report, NPDES Storm Water Program, Local
Watershed Initiatives and Assessments, EPD River Basin Management

Plans, etc.
(3) Using visual reconnaissance and site interview, determine where
possible the type of chemical that may be released into the environment
by a potential pollution source.
b. Identify potential contaminants including but not limited to those regulated
under SDWA MCLs, crypto sporidium, turbidity, and others expected to be
regulated and identify their likely sources.
(1) Interview water managers and review monitoring data.
(2) Conduct literature review.
(3) Interview EPD Water Quality and Drinking Water staff,
(4) Review USGS, EPD, University, etc. water quality studies.
(5) Collect/review GA EPD crypto sporidium raw water sampling data.
c. Review draft format and organization of potential contaminant sources
with Task Force.
d. Produce Preliminary List of Potential Contaminants and List of Relevant
Existing Data Sources.
4. Screen potential contaminants. The Task Force will discuss the lists and
make determination of sources of contamination for further data collection. The
Task Force will discuss criteria and consider as appropriate such aspects as
time of travel, water source to be impacted, size of watershed, short or long
term impacts, future trends, and the extent (temporal/spatial) to which data is
needed to make susceptibility determinations.
5. Collect data for potential contaminants. Using the list developed by the Task
Force in II.AA, above,Augusta will carry out or cause to be carried out the
following tasks:
a. Collection and analysis of available data, This will include a clear
description of sources of contamination (or categories of sources) by location or
area. Data to be collected for SWAP will be beneficial to other water quality
protection and enhancement programs (e,g. River Basin Management Plans,
Nonpoint Source Management, etc.), As such, Augusta will collect data for the

region (outside the water supply watersheds delineated in Task I of this Scope
of Work) where readily available.
b. If not available, raw water sampling for all surface water intake sources
involved in this project will be sampled for cryptosporidium parvum.
c. Discuss implication where lack of data limits ability to make source
susceptibility determinations.
d. Provide recommendations for any additional data collection in future
programs. Recommendations should integrate data needs with existing
programs' data collection efforts.
e. Present results to the Task Force.
B. Susceptibility Analysis: The susceptibility of each public water system
intake will be determined. To accomplish this task Augusta will:
1. Utilize the susceptibility determination methodology described in the
GAEPD Source Water Assessment Implementation Plan. Augusta should work
with the Task Force to refine this methodology as appropriate for the study
region. This process may include performing susceptibility analysis "dry runs"
for evaluation by the Task Force. The state's method provides a qualitative
measure (high, medium, low) for determining the level of susceptibility the
surface water intake has to potential pollution sources upstream. In determining
susceptibility, there are two issues that are addressed; the potential for the
contaminant to reach surface water and eventually the surface water intake and
if the contaminant reached the surface water intake, the risk the contaminant
poses to the drinking water supply.
2. Determine release potential and risk assessment for non-point sources
using 1995 (or more current data) Economic Development Information System
(EDIS) or other land use coverages developed through the use of aerial
photography. Using GIS and the GAEPD priority ranking criteria, Augusta and
the Task Force will establish weight measures for each category of high,
medium and low,
NOTE: Nonpoint source modeling is outside the scope and resource of
this contract.
3. After determining the overall potential and risk, using the weighed
factors along with the advice and guidance from the Task Force, each source
will be plotted on a chart in relation to the other sources with the axes

representing the potential and risk. After all of these sources are charted, they
will be prioritized with the main emphasis on those sources which represent high
potential of release and pose a high risk to the intake.
C. Communication Plan: Augusta will ensure an effective communication plan
is developed and implemented. The Communication Plan contains activities
that, when enacted together as part of an integrated communication strategy,
will be effective at helping the Task Force communicate with the public in
regards to addressing and creating dialogue for long term source water
protection programs. Each source water assessment needs to be, as stated in
the statute, "for the protection and benefit of the public water systems."
The 1996 Safe Drinking Water Act (SDWA) called for increased public
awareness and involvement during the development and implementation of
source water assessment programs. There must be adequate opportunity for
representatives of environmental groups, public interest groups, public health
groups, vulnerable population groups, business groups, farmers, local
governments, land conservation groups, drinking water suppliers, wastewater
treatment operators, developers, and others to participate on this SWAP
process.
The SOW A federal statute 1353(a)(7) requires that states "make the results of
the source water assessments conducted under this subsection available to the
public." A well-planned information campaign will help increase baseline
awareness of source water protection issues both within the study region and
the watershed area crossing jurisdictional boundaries. A more educated public
will be likely to understand the need for source water protection and will be
more inclined to work with, rather than against, local, state, and federal
government agencies.
The purpose of this Communication Plan is to outline the potential activities,
materials, and strategies that will, when implemented, function as an integrated
communications program and provide the needed support for the Task Force to
make assessments available to the public during the development and
implementation of strategies. The goals of this Communication Plan are to:
- Involve the public in developing SWAPs and make assessments
available to the public.
- Improve local jurisdictions' understanding of source water protection
programs.
- Make these results available in an understandable manner and in an

expeditious way after they are complete.
- Make available all information collected during each assessment when
requested,
- Create maps as part of the results, and those maps need to include the
delineated area and the sources of contamination described in the
inventory,
- Present the susceptibility determination in a narrative form, but may be
presented on a map if the results of the analysis would be more
understandable in that format.
- Create susceptibility maps through a Geographic Information System
(GIS), topographic formats may also be used.
The target audiences for this plan include the Public (defined as all consumers
in a source water protection area as well as other members of the public,
including federal, state and local government agencies), Georgia EPD, U.S.
EPA, and the watershed area crossing jurisdictional boundaries,
To accomplish the Communication Plan,Augusta will ensure the particular
communication elements considered for implementation include the following:
Source Water Assessment and Protection Report [REQUIRED]
Upon completion of the source water assessment program, a stand-alone
SWAP report that is understandable to the public will be created for
each of the participating water system's drinking water intakes. The
report will be made widely available via web page, public libraries, and
other means. In addition, a widespread notification describing in detail
how one can obtain a hard copy of the report will be done. The public will
be permitted to request a copy of the report through postage return mail
cards, a call-in number, and Internet posting.
Public Forum Meetings [REQUIRED]
Public forum meetings will be used to provide the public with assessment
results and allow for public comment. This will include both special called
meetings to specifically discuss SWAP and attendance at ongoing public
forums such a Rotary Club, PT A meetings, etc,
Consumer Confidence Report (CCR) [REQUIRED]
Each participating water system will publish a summary of the SWAP
report findings in their annual CCR, Information about how to obtain

access to the report will also be included in the CCR.
Newsletter [Recommended]
A newsletter insert discussing source water protection and the
assessment program will be circulated. Included in the newsletter would
be information on how to obtain or review reports and an Internet address
where one could obtain additional information on source water protection.
Utility Bill Inserts [Recommended]
Augusta will work with the Task Force to develop a notice about the
results of the source water protection assessment. Distribution of the
notice would be the responsibility of the individual water supply agencies.
Such a procedure would inform customers that source water protection
reports exist and ways they could easily be obtained.
Speakers Bureau [Recommended]
A list of speakers, consisting of utility managers, prepared to discuss
source water protection assessment programs will be developed. The
bureau will have a "canned" presentation ready on topics relating to
assessments.
Media Releases [Recommended]
A well informed media is better able to report balance news stories.
Media releases will be prepared and distributed to the press regarding the
assessments.
Displays and Exhibits [Recommended]
Displays and exhibits provide another way to offer the public more
information about designing and implementing SWAPs. Generic display
material will be developed for use by the Task Force in regional public
buildings, libraries, and other areas where the public may easily view
them.
D. Equipment: Augusta will ensure a return to EPD, in working order, any
equipment purchased under the terms of this contract upon completion of the
work described in the contract.

Payments shall be based on invoices from Augusta to EPD; such invoices shall
indicate the percent of work completed on each milestone identified above and
shall be considered a request for reimbursement to Augusta of that percent
share of the payment amount for each milestone above.
