COUNCIL OF JUVENILE COURT JUDGES OF GEORGIA PURCHASE OF SERVICES FOR JlNENILE QFFENDERS CONTRACT FOR SERVICES (Subcontract) SSNtI 254-25-4308 ./ This contract is hereby made this 14th day of February 2000, between Caffee Wright (Name) 3521 Wyevale Drive. Hephzibah, GA 30815 (Address), hereafter the "Contractor", and Ri rhmonrl County, in the State of Georgia, hereafter referred to as the "County", by which the Contractor agrees to supply, and the County agrees to purchase Counseling services for eligible children. \VITNESSETH Whereas the County has contracted with the Council of Juvenile Court Judges, hereafter referred to as the "Council", pursuant to a grant entitled Purchase of Services for Juvenile o.Uenders authorizing the County to purchase certain services from public or private persons, organizations, institutions, fIrms or corporations; And whereas the Contractor is a person, organization, institution, fInn, or corporation engaged in or able to engage in providing such services; The parties hereto do mutually agree as follows: A. DEFINITIONS As used herein: 1. Eligible Child: (a) any child alleged to be delinquent who is not currently incarcerated; or (b) any child alleged to be a status offender or unruly child. 2. Judge: the judge charged with hearing juvenile cases in the County. , , . B. SERVICES The Contractor agrees to provide the following service(s) [fIll in all appropriate categories] to eligible children upon proper referral in the manner and at the rates set forth below: 1. PersonneVSupervision Services: $ per hour for adult supervision of court-designated work programs of symbolic andlor monetary restitution for eligible children. ... " 1 ,~.. 2. Cantractar agrees to. pravide hausing and therapy in a nan-secure facility. C. REFERRAL Whether a child is referred to. a Cantractar under this cantract and the extent and cambinatian af services to. be provided is within the discretian afthe judge. No. child shall be referred to. ar received by a Cantractar unless that child is an eligible child under this cantract and the judge has ardered the referral. D. DUAL COMPENSATION No. persan halding public affice ar warking full-time and receiving campensation directly fr'am any department, agency ar institutian afthe State ar Caunty gavernment, may enter into. ar re:ceive payment under any subcantract authorized by this contract, unless such services were rc:mdered at times far which such persans were nat being campensated by the department, agency ar institutian afthe State or Caunty'gavernment emplaying him ar her. Full-time court employees or Department of Juvenile Justice personnel are not eligible to receive paymentfor services rendered at any time under this contract. In no. event shall the Cantractar during the term afthis agreement apply far funds fram any orher saurce -- Caunty, State ar Federal -- or receive payment for services rendered under this contract ,is such payment wauld be used to. supplant funds granted to. the Cantractor fram any ather source far the same services and far the same clients as are the subject af this contract.' This prahibition will not apply, however, if ih accepting funds fram such other saurces -- Caunty, State ar Federal -- Contractor expands the type and/or number of services and/or clients it serves. ~.. ,f'> . " l' :;.' E. PAYMENT The Contractor agrees to provide services to each eligible child referred by the judge. The Contractor is to submit to the County a monthly statement showing the dates and times worked, the name.s. of the children for whom services were provided, a brief description of the services provided, , the total number of hours worked, the hourly rate of payment and the total amount owed. The rate of payment for any services shall not e~ceed th~ rates prescribed in the contract for provision of Purc:hase of Services between the County and the Council. In no event shall the total payment under this contract exceed $ C) 000 ' F. EFFECTIVE DATE Al'fD TE&.~'iATION This contract will be effective as of the date agreed upon by both parties and shall temunate on the ls1 day of October 2005. All requests for payment must be submitted no later than the 30th day ()fthe following month of service. And any request submitted after the lQth day of the following month of service must be sent registered mail. However, either party hereto may . temlinate this contract at any time prior to the aforesaid expiration date for cause and the County may terminate this contract at its convenience, upon written notice to the other party, thirty (30) days prior to the termination date. Payment may be obtained as provided herein for services actually rendered up to the date of termination. G. DISPlrIES, APPEALS, Ai'ffi REl\-lEDIES Any dispute concerning a question of fact arising under this contract which is not disposed of .' by agreement shall be decided n the following manner. The contracting parties shall reduce to wri1:ing their opposing arguments and submit them to the Children and Youth Coordinating Council, hen~after referred to as "CYCC". They'shall also provide a copy of their argument to the other contracting parry. The CYCC shall set a time for hearing within thirty (30) days of the receipt of the initial argument, at which time an administrator appointed by the CYCC shall decide the issue. The decision of the administrator shall be final a..'1.d conclusive unless determined othenvise by a court of competent jurisdiction. Pending final decision of a dispute hereunder, the Contractor shall proceed diligently with the performance ofthe contract and in accordance with the terms of the contract. However, the Contractor shall retain the right to terminate the contract as provided in Section F above. The administrator may consider questions of law in reaching a decision, however, this decision on the question of law by the administrator is not final. H. STATE Al'ID FEDERU REGULATIONS This contract is subject to all regulations and rules placed on contracts of this type by the Office of Juvenile Justice and Delinquency Prevention (OJIDP) and the CYCC. This contract and all rights and obligations thereunder; including matters of construction, validity a..'1.d performance, she.ll be governed by the laws of Georgia. The CYCC, OJIDP, the Comptroller General of the United States, the Council, and the County, or any of their duly authoriz.ed representatives shall have access, for the purpose of audit ~d . ... .. . ~. ~.. . ---.:.: .~ . .. .' .' , .~ e:xamination to ariy books, documents, papers, and records of the Contractor that are pertinent to this grant. I. INTEGRATION AND MODIFICATION , This contract represents the sole and entire agreement'between the Contractor and the County and all offers, negotiations, or agreements between the parties are merged herein. No modification of the contract is binding unless it is in writing and signed by the parties hereto. , ' Time is of the essence of the contract.
