CONTRACT FOR MAINTENANCE OF HIGHWAYS
NUMBERED 3393MB
THIS AGREEMENT made and entered into this ,{ to # day of
'/. "'t\ec.r> \')'\.'b e r-; 2004, by and between the Department of Transportation of Georgia
(hereinafter called the Department), the County Administrator and Board of Commissioners
of the Augusta-Richmond County (hereinafter called the County), and the City Commission
Chairman and the City of Hephzibah (hereinafter called the City) to be effective on the

WITNESSETH:
WHEREAS, the County and the City are being notified that a section of Windsor Spring
Road (Augusta-Richmond County Road 65) will be added to the State Highway System and
designated as State Route 1128 until scheduled improvements are completed; and
WHEREAS, the Department, the County, and the City agree that it will be
advantageous to all parties hereto, as well as to the traveling public, for the County and City
to continue to accommodate utilities and to fully maintain the aforementioned County Road
(Augusta-Richmond County Road 65) while the section of roadway is on the State" Highway
System; and
WHEREAS, the parties hereto are acting under the authority of the Constitution of the
State of Georgia, Article-IX, Section III, paragraph I (1983).
NOW THEREFORE, in consideration of the sum of One Dollar by each of the parties
to the other in hand paid, the receipt whereof is hereby acknowledged, and the mutual
covenants herein contained, the parties hereto agree as follows:

1) The County and City will continue to fully maintain, as may be required by law for a
ounty road, within their respective jurisdictions and within the limits of rights-of-way of
he Augusta-Richmond County Road 65, while designated as State Route 1128. Said section
f roadway is shown on the attached sketch map marked "Exhibit A" which by reference is
. ncorporated herein and made a part of this instrument for the purpose of describing the road
o be maintained under this agreement.
2) To the extent authorized by law, the County and City agree to indemnify and hold
armless the DepartmeIlt from all suits, claims for damages, or causes of action brought on
ccount of the County's or City's failure to perform those maintenance activities required by
his contract as associated with the aforementioned State Route.
3) The Department agrees that the section of roadway will remain on the State Highway
ystem and designated as State Route 1128 until the improvement is completed. The
epartment shall provide written notice to the County and City as to the date that State Route
1128 is r~moved from the State Highway System and the date of final termination of this
