CONTRACT
THIS AGREEMENT, made and entered into this 1 -\::!- day of C!>~~ , one
. thousand nine hundred and ninety-six, between the Augusta-Richmond County Commission-Council
of Augusta, Georgia, as party ofthe first part (hereinafter called the Owner) and Beam's Pavement
Maintenance Company. Inc. party of the second part (hereinafter called the Contractor), Witnesseth:
Whereas, the Owner desires the improvements and construction' of certain ,airport
improvements hereinafter more particularly described, and the Contractor desires to furnish and
deliver all the material and to do and perform all the work and labor for said purposes:
Now, therefore, in consideration of the promises, the mutual covenants herein contained and
the sum of one dollar ($1.00) by each of the parties to the other in hand paid, the receipt whereof is
hereby acknowledged, the parties hereto agree as follows:
1. The Contractor promises and agrees to furnish and deliver all the material and to do and
perform all work and labor required to be furnished and delivered, done and performed in and about
the improvements and construction of an addition to the General Aviation Apron and an asphalt
overlay for the North Taxiway. In the strict and entire conformity with the provisions of this
Contract, the construction plans, and specifications prepared by CSRA Testing and Engineering Co.,
Inc., copies of which are hereto attached, and which said plans and specifications are hereby made
a part of this agreement as fully and to the same effect as if the same had been set forth at length in
the body ofthis agreement.
2. . The 'Owner agrees and promises to pay to the Contractor for said work, when cOI1?pleted
in accordance with the provisions of this Contract the price as set forth in the said proposal, four
hundred seven thousand. three hundred sixty seven dollars & 60/100 ($ 407.367.60) payments to
be made as provided in said specifications upon the terms set forth in the said specifications and
pursuant to the terms of this Contract.
3. The said work shall be done in accordance with the laws of the State of Georgia under the
direct supervision, and to the entire satisfaction of the Engineer, subject at all times to the inspection
and approval of the owner, or his agents.
4. The decision of the Eng,ineer upon any questions connected with the execution of this
agreement or any failure or delay in the prosecution of the work by the said contractor shall be final
and conclusive.

. 5. Georgia Prompt Pay Act. This Agreement is intended by the parties to, and does,
supersede any and all provisioris ofthe Georgia Prompt Pay Act, O.C.G.A. ~ 13-11-1, et seq. In
the event any provision of this Agreement is inconsistent with any provision of the Prompt Pay Act,
the provisions of this Agreement shall control.
6. Consent to Jurisdiction. All claims, disputes and other matters in question between the
Owner and 'the Contractor arising out of or relating to the Agreement or the breach thereof, shall be
decided in the Superior Court of Richmond County, Georgia. The Contractor, by executing this
Agreement, specifically consents to venue. in Richmond County and waives any right to contest the
venue in the Superior Court of Richmond County, Georgia.
7. Retainage. Notwithstanding any provision of the law to the contrary, the parties agree
that no interest shall be due Contractor on any sum held as retainage pursuant to this Agreement and
Contractor specifically waive any claim to same.

performing labor in the prosecution of the WORK provided in such contract,
and any authorized extension or modification thereof, including all amounts

contract between the Augusta-Richmond County Commission and Beam's
Pavement Maintenance Company, Inc., for improvements on the General
Aviation Apron at Bush Field. Also enclosed are copies of the
