HomeMy WebLinkAboutAUGUSTA YOUTH CENTER FIRST AMENDMENT CDBG ORIGINAL FIRST AMENDMENT CONTRACT BETWEEN AUGUSTA, GEORGIA & AUGUSTA YOUTH CENTER, INC. YEAR 2005 COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG) This First Amendment to the CONTRACT executed by and between the Parties on January 1, 2005, is made and entered into on the 22nd day of February 2006, by and between AUGUSTA, GEORGIA, (hereinafter referred to as "GRANTEE"), and AUGUSTA YOUTH CENTER, INC. (hereinafter referred to as "SUB-RECIPIENT"). WHEREAS, GRANTEE desires to amend the ORIGINAL CONTRACT to allow the SUB-RECIPIENT to effectively and efficiently administer its AUGUSTA YOUTH CENTER, INC., PROGRAM; WHEREAS, SUB-RECIPIENT has determined that this amendment is in its best interest and has agreed to the said amendment; NOW THEREFORE, in exchange for their mutual good and valuable . consideration, the receipt and sufficiency of which each P ARTI acknowledges, and intending to be legally bound, GRANTEE and SUB-RECIPIENT agree to amend said CONTRACT as follows: (1) Paragraph (7), on the Original Contract shall be stricken in its entirety and shall be replaced with the following language: 7. COMPENSATION "The Sub-recipient shall be paid a total consideration of $~5.000 for the full performance of the services specified under this Agreement. Any cost above this amount shall be the sole responsibility of the Sub-recipient. The Sub-recipient shall submit monthly requests for payments to the Augusta Housing and Economic Development Department (AHEDD). Compensation shall be allowed on a reimbursement basis, only after expenditures have been incurred by the Sub-recipient and proper supporting documentation has been submitted in conformity with. the approved and executed budget document which is attached to this Agreement as Appendix C, incorporated herein by reference. Year 2005 Community Development Block Grant Program Augusta Youth Center Tutorial Program Page 2 of3 case, payment will be made subject to receipt of a reimbursement request for payment from the Sub-recipient specifying and certifying that such expenses have been ~ncurred and expended in conformance with this Agreement and that the Sub-recipient is entitled to receive the amount requested under the terms of this Agreement. Clients' eligibility data shall be included with said reimbursement request. Payments will be made on a monthly basis only with a 30-day turnaround period by Grantee. Requests for payments must be received by Grantee not later than the 15th day of each calendar month for work performed during the preceding calendar month. The Sub-recipient shall not claim reimbursement from the Grantee for that portion of its obligations which has been paid by another source of revenue. The Sub-recipient shall notify the Grantee in writing of all authorized personnel who shall be empowered to file requests for payment pursuant to this Agreement." (2) Appendix (B), Paragraph 2 of GOALS. OBJECTIVES. AND TASKS shall be stricken in its entirety and shall be replaced with the following language: "Community Development Block Grant (CDBG) funds will be used for the salaries of the executive director, assistant director, and all center staff, to purchase vehicle liability insurance and property liability insurance, purchase vehicle fuel, pay utilities, pest control and internet service, to purchase office supplies, food for the after school program, cleaning supplies, and program materials and supplies." (3) Appendix (C) shall be stricken in its entirety and shall be replaced with the following language: Appendix (C) "On January 1, 2005 Commission approved a CDBG in the amount of $20,000. On February 22, 2006 Commission approved an additional CDBG in the amount of $15,000. To date the total amount funded for the project is $35,000. Out of the total amount that has been awarded, $20,000.00 to cover the expense of salaries has already been expended.
