'" '11' ../ t. ; . . AGREEMENT THIS AGREEMENT is made and entered into this I g ~ day of A-~v: \ 2001, by and between Summerville Neighborhood Association, Inc. and J\UG USTJ\, GEORGIA ("Augusta"). This agreement will remain in effect for one (1) year. WHEREAS, The Summerville Neighborhood AssociaLion, Inc. will accept the responsibility to staff, develop and implement sound programs for the best interest of this community; and WHEREAS, The Summerville Neighborhood Association, Inc. deliberated that it would be beneficial to both the Augusta Richmond County taxpayers and local Augusta residents for The Summerville Neighborhood Association, Inc., and the Augusta Recreation and Parks Department (ARPD) to jointly operate l-Iickman Park. NOW, THEREFORE, for and in consideration of the mutual promises and the covenants contained herein, and other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the parties agree as follows: A. Responsibilities of Summerville Neighborhood Association, lnc. The Summerville Neighborhood Association, Inc. shall provide adequate staffing of Hickman Park, which shall include the following features: 1. Hours of Operation - Fall, Winter and Spring (September - May) ~/[onday - Friday 3:00 P.M.- 6:00 P.M.; Summer Oune -August) Monday - Friday 11:00 A.M. - 5:00 P.M. at a minimum. Weekend operations scheduled as needed. 2. The Summerville Neighborhood Association, Inc. shall provide sta~l for all rentals at facility and follow the rental guidelines provided by the Augusta Recreation and Parks Department, and shall have all volunteer (,.. ,,',,' staff execute and keep on file a Volunteer Release Form (See Staffing Requirements Attachment) 3. The Summerville Neighborhood Association, lne. shall issue keys for Hickman Park to a representative of the Summerville Neighborhood Association, Inc. 4. The Summerville Neighborhood Association, Inc. shall maintain an inventory of all supplies furnished by the (ARPD) of Hickman Park and shall perform general maintenance of the interior/exterior of Hickman Park, which includes mopping, sweeping, and picking up their litter from grounds. ~c S'dff.u~ Rc~u;,c.uc"" AUddu"c;'r)9~ 5. The Summerville Neighborhood Association, Inc. shall formulate programs and activities for Hickman Park as well as maintain a current safety inspection of all existing playground equipment. In the event that any equipment is deemed unsafe, that equipment must be properly labeled unsafe and Recreation personnel must be contacted immediately. 6. The Summerville Neighborhood Association, Inc. must follow all safety guidelines set forth by the Augusta Recreation and Parks Department which include notifying the Augusta Recreation and Parks Department immediately in the following cases: break-ins property damage, or emergencies. 7. The Summerville Neighborhood Association, Inc. shall be covered under the Volunteer Protection Act of 1997,42 U.S.c. 14501, et secl. 8. All revenues received by Summerville Neighborhood Association, Ine. for services rendered at f-lickman Park shall be expended for materials, supplies or other services that directly effect the operations of Hickman Park. ., . Responsibilities of Augusta Recreation and Parks Department The Augusta Recreation and Parks Department shall be responsible for assisting The Summerville Neighborhood Association, Inc. in the operation of Hickman Park as follows: 1. Supply all utilities. 2. Perform all repairs and normal maintenance for the upkeep of the facility (painting, pesticide treatment, etc.) 3. Provide for trash collection from existing canister on grounds. 4. Provide for stripping/waxing of Hoors within the facility as needed. 5. Supply both programming and janitorial supplies as budgeted and approved by Augusta Commission. 6. Provide administrative guidance and staff representatives for assistance as required to fulfill the terms of the agreement. 7. Supply all capital purchases, as needed, depending on funding. 8. Provide assistance with special events that are programmed by the Summerville Neighborhood Association, Inc. 9. Provide all necessary guidelines/manuals concerning building rentals and safety questions. 10. Assume responsibility for break-ins and emergency situations that may anse. 11. Assume responsibility for liability not provided for in the Volunteer Protection Act to the Summerville Neighborhood Association, Inc. C. Responsibilities of Augusta Recreation and Parks during the terms of the agreement: \', '. "1 . ~ .. ' 1. Install security alarm system. 2. Repair existing sidewalks as needed. 3. Repair ceiling in north activity room. 4. Install outdoor grills as needed. 5. Install additional rule signs as needed. 6, Install mail slot on from door of center. The Augusta Recreation and Parks Department shall also provide the following departmental contacts for d1e Summerville Neighborhood Association, Inc.: 1. Joanie Smith - Program Manager: (work) 796-5025,240-4550 (pager) This Agreement contains ilie entire agreement of d1e parties, and no representatives, inducements, promises or agreements, oral or od1erwise, between d1e parties not embodied herein shall be of any force or effect. Eid1er party hereto, however, may terminate iliis Agreement by giving to ilie oilier party a notice in writing of not less ilian 30 (d1irty) days, said notice to be forwarded by certified mail, return receipt requested, to the parties.
