CONSULTANT SERVICES AGREEMENT
BETWEEN
DEPARTMENT OF PUBLIC WORKS AND ENGINEERING
AUGUSTA GEORGIA COMMISSION

This Agreement is made and entered into this 1 q#- day of #1#;0-11 ,2002,

hereinafter called the "Consultant."
Whereas, the Owner desires to engage a qualified and experienced consulting firm to furnish
professional services for:
"Deans Bridge Road Municipal Solid Waste Landfill
Environmental/Hydrogeological Services"
Whereas, the Consultant has represented to the Owner that it is experienced and qualified to
provide the services contained herein and the Owner has relied upon such representation.
Now, therefore, in consideration of the mutual promises and covenant herein contained, it is
agreed by and between the Owner and the Consultant that the Consultant shall provide the
professional services of the project (see request for proposal- project scope of services).

SERVICES CRITERIA
Groundwater quality assessment and monitoring surfacewater, and storm water runoff quality
monitoring must be in accordance with section I "Project Requirements" of Part of this RFP and
shall be performed in accordance with Georgia Environmental Protection Division (EPD) Ru~es
and all applicable guidance documents, EPD approved Groundwater Monitoring PIan"for the
Facility, and the Facility latest storm water Pollution Prevention Plan.
The Consultant shall gather from the Owner all available data and information pertinent to the
performance of the services for the Project. The Owner shall have the final decision as to what
data and information is pertinent
The Consultant shall ensure that the data and information meet applicable standards as specified
herein.
The Consultant shall report in writing any discovery of errors or omissions contained in the data
and information furnished by the Owner.
The Consultant shall visit and become familiar with the Project site and shall become
acquainted with local conditions involved in carrying out this Agreement. The Consultant may
request that a representative of the Owner be present during the site visit.
The Consultant shall recommend and secure the Owner's approval of, the manner of project
results presentation and the methods to be used in the data evaluation so that this data can be best
utilized, as determined by the Consultant and approved by the Owner, in the orderly
preparation of Assessment Reports and compliance reports.

AMOUNT OF CONTRACT
It is agreed that the compensation hereinafter specified to perform the services (see Project Scope
of Services) required by this Agreement includes both direct and indirect costs chargeable to the
project, as further defined in Part IV Proposal Format Section E Fee Proposal ofRFP.
The maximum obligation of the Owner to the Consultant under the terms
of this Agreement shall be: $52.805.00 per year (two everits).
The contract will be for three years with a possibility of two one year extensions; however,
Owner will have an option to terminate the project incase of unsatisfactory service.
Note: Owner shall have the right to award only the part of the work if the Owner so desires.

GENERAL CONDITIONS
CONSULTANT COORDINATION
The Consultant shall cooperate fully with Federal and State official, consultants on adjacent
projects, municipalities and local government officials, utility companies, railroads, and others,
as may be directed by the Owner. Such cooperation shall include attendance at meetings,
discussions, and hearings, as may be requested by the Owner, furnishing plans and other data
produced in the course of work on the Project, as may be requested from time to time by the
Owner to effect such cooperation and compliance with all directives issued by the Owner in
accordance with this agreement.
It is understood and agreed that Federal and State regulators may have access to the work and be
furnished information as directed by the Owner.
RIGHT TO ENTER
The Consultant will notify all property owners or occupants of the intent to enter properties for
the purpose of accomplishing surveys or other field investigations in accordance with the
practices of the Owner. The Consultant shall discuss with and receive approval from the
Augusta Richmond County Public Works and Engineering Department prior to sending said
notices of intent to enter private property. Upon request by the Consultant, the Owner will
provide the necessary documents identifying the Consultant as being in the employ of the
Owner for the purpose described in the Agreement. If the property owner or occupant denies
the Consultant permission to enter, such incident will be reported to the Owner and the Owner
will initiate such action as is dictated by current policy and procedure.
ACCURACY OF WORK
The Consultant shall be responsible for the accuracy of the work and shall promptly correct its
errors and omissions without additional compensation.
Acceptance of the work by the Owner will not relieve the Consultant of the responsibility for
subsequent correction of any errors and the clarification of any ambiguities.
At any time during any phase of work performed by others based on data secured by the
Consultant under the Agreement, the Consultant shall confer with the Owner for the purpose
of interpreting the information obtained and to correct any errors or omissions made by it. The
Consultant shall prepare any plans or data required by the Owner to correct its errors or
omissions. The above consultation, clarification, or correction shall be made without added
'compensation to the Consultant. The Consultant shall give immediate attention to these
changes.

CHANGE IN THE WORK
The Owner may at any time as the need arises, order changes within the scope of the work
without invalidating the Agreement. If such changes increase or decrease the amount due under
the Contract Documents or in the time required for performance of the work, an equitable
adjustment shall be authorized by Change Order.
The Owner reserves the right to make at any time such alterations in the character of the work,as
the Owner may consider necessary or desirable to complete the proposed work in a satisfactory
manner and consistent with the intent of these Contract Documents. Notice of every such
alteration or change shall be given in writing to the Consultant by the Owner, and no such
alteration or change shall be considered as constituting a waiver of any of the provisions of these
Contract Documents or as nullifying or invalidating any of such provisions. Should any such
alteration or change result in an increase or decrease in the quantity or the cost of the work
described in these Contract Documents, the total amount payable under the Contract will be
accordingly modified. If alterations or changes are thus made, the contract time will be
correspondingly modified, if the Consultant so requests, before commencing the work
attributable to such alterations or changes.
It is understood and agreed that the Consultant shall perform all extra work that may be ordered
in writing by the Owner arising out of the modification of the Specifications or Drawings made
or approved by the Owner. For this extra work, the Consultant shall be compensated as
provided hereinafter and in the Change Order covering the additional services.
All Change Orders must be approved by the Owner and those governmental agencies whose
approval is required.
ADDITIONAL SERVICES
The Consultant may be required to perform additional services or tasks related to the work
outlined in the Scope of this Agreement that are specific to site conditions and are not typical in
nature. The Consultant shall, at the Owner's request, submit a proposal indicating manhours
and costs to the Owner for approval. The Consultant shall not begin on any task until the
Owner issues written authorization to proceed.
ENVIRONMENTAL ENGINEER
The Environmental Engineer or his duly appointed representatives shall act as the Liaison
Engineer between the Consultant and the Owner and all utilities, and authorities or
governments whose properties will be affected. The Consultant shall arrange for conferences
and exchanges of data and information and for necessary approvals.

All correspondence, data, information, and reports shall be directed to the Environmental
Engineer to provide for proper distribution to the parties concerned.
All conferences, including telephone conversations and decisions, shall be reduced to writing by
the Consultant and at least two (2) copies of the resumes shall be forwarded to the
Environmental Engineer within seven (7) calendar days of the event.
The Consultant shall meet with the Owner for review of the work or submit in writing a project
status update on event basis as determined by the Owner.
The Environmental Engineer will expedite any necessary decisions affecting the performance of
the Consultant's Agreement, but the Consultant shall not make use of the Environmental
Engineer's services on trivial or minor matters normally to be decided by the Consultant.
DELIVERY OF NOTICES
All written notices, demands, and other papers or documents to be delivered to the Owner
Under this Agreement shall be delivered to the Owner's office, 530 Greene Street, Room 701,
Augusta, Georgia 30911, Attention: Environmental Engineer, or at such other place or places as
may be subsequently designated by written notice to the Consultant. All written notices,
demands, and other papers or documents to be delivered to the Consultant under this Agreement
shall be directed to or at such a place or places subsequently to be designated in writing by the
Consultant to the Owner.
SUPERVISION AND CONTROL
The Consultant shall perform the services required to accomplish the work plan as stated above
under such control and supervision by the Owner as the Owner may deem appropriate.
COVENANT AGAINST CONTINGENT FEES
The Consultant shall comply with the relevant requirements of all Federal, State, County, or
local laws. The Consultant warrants that it has not employed or retained any company or
person, other than a bona fide employee working solely for the Consultant, to solicit or secure
this Agreement, and that it has not paid or agreed to pay any company or person, other than a
bona fide employee working solely for the Consultant, any fee, commission, percentage,
brokerage fee, gifts, or any consideration, contingent upon or resulting from the award or making
of this Agreement. For breach or violation of this warranty, the Owner shall have the right to
annul this Agreement without liability, or, at its discretion, to deduct from the Agreement price
or consideration, or otherwise recover, the full amount of such fee, commission, percentage,
brokerage fee, gift, or contingent fee.

EMPLOYMENT OF COUNTY'S PERSONNEL
The Consultant shall not employ any person or persons in the employ of the Owner for any
work required by the terms of this Agreement, without the written permission of the Owner
except as may otherwise be provided for herein.
REVIEW OF WORK
Authorized representatives of the Owner may at all reasonable times review and inspect the
project activities and data collected under the Agreement and amendments thereto. All reports,
drawings, studies, specifications, estimates, maps and computations prepared by or for the
Consultant, shall be available to authorized representative of the Owner for inspection and
review at all reasonable times in the main offices of the Owner. Acceptance shall not relieve the
Consultant of its professional obligation to correct, at its expense, any of its errors in work. The
Public Works and Engineering Department may request at any time and the Consultant shall
produce progress prints or copies of any work as performed under this Agreement. Refusal by
the Consultant to submit progress reports and/or plans shall be cause to withhold payment to the
Consultant until the Consultant complies with the Owner's request in this regard. The
Owner's review recommendations shall be incorporated into the plans/reports by the
Consultant.
RESPONSIBILITY FOR CLAIMS AND LIABILITY
The Consultant shall be responsible for any and all damages to properties or persons caused by
its employees, subcontractors, or agents, and shall hold harmless the Owner, its officers, agents,
and employees from all suits, claims, actions, or damages of any nature whatsoever to the extent
found to be resulting from the Consultant, its subcontractors, or agents in the negligent
performance or non-performance of work under this Agreement. These indemnities shall not be
limited by reason of the listing of any insurance coverage.
INSURANCE
The Consultant shall obtain and maintain through the contract period, including any time
extensions, the necessary insurance to protect the firm, subcontractors and the Owner. This
insurance shall include a minimum of $1,000,000 of General and Professional (Errors and
Omissions) liability coverage.
cOMPENSA TION
The Owner shall compensate the Consultant for services which have been authorized by the
Owner under the terms of this Agreement.

The Consultant may submit to the Owner per event invoice, in a form acceptable to the Owner
and accompanied by all support documentation requested by the Owner, for payment for the
services which were completed during the billing period. The Owner shall review for approval
said invoices. The Owner shall have the right to reject payment of any invoice or part thereof if
not properly supported, or if the costs requested or a part thereof, as determined solely by the
Owner, are unreasonably in excess of the actual stage of completion of each phase. The Own_er
shall pay each such invoice or portion thereof as approved, provided that the approval or
payment of any such invoice shall not be considered to be evidence of performance by the
Consultant to the point indicated by such invoice, or of receipt of acceptance by the Owner of
the services covered by such invoice': The Owner shall pay any undisputed items contained in
such invoices. '
The Consultant will indemnify and save the Owner or the Owner's agents harmless from all
claims growing out of the lawful demands of Subcontractors, laborers, workmen, mechanics,
materialmen, and furnishers of machinery and parts thereof, equipment, tools, and aU supplies,
incurred in the furtherance of the performance of the work. The Consultant shall, at the
Owner's request, furnish satisfactory evidence that all obligations of the nature designated above
have been paid, discharged, or waived. If the Consultant fails to do so the Owner may, after
having notified the Consultant, either pay unpaid bills or withhold from the Consultant's
unpaid compensation a sum of money deemed reasonably sufficient to pay any and all such
lawful claims until satisfactory evidence is furnished that all liabilities have been fully
discharged whereupon payment to the Consultant shall be resumed, in accordance with the
terms of the Contract Documents, but in no event shall the provisions of this sentence be
construed to impose any obligations upon the Owner to either the Consultant, his Surety, or any
third party. In paying any unpaid bills of the Consultant, any payment so made by the Owner
shall be considered as a payment made under the Contract Documents by the Owner to the
Consultant and the Owner shall not be liable to the Consultant for any such payments made in
good faith.
No separate payment will be made for any items specified in the General Conditions. Payments
for such items shall be included in the unit price and lump sum prices bid by the Consultant for
items listed in the Bid Schedule.
It is understood and agreed that the approval of the progress payment request and the paying of a
partial payment shall not be construed as acceptance of any work, materials, or products and
shall not relieve the Consultant in any way from his responsibilities and obligations under these
Contract Documents.
A partial payment will not be made when, in the judgment of the Owner or the Owner's
Engineer, the work is not proceeding in accordance with any of the provisions of these Contract
Documents.
ACCEPTANCE OF FINAL PAYMENT AS RELEASE
The acceptance by the Consultant of final payment shall be and shall operate as a release to the
Owner of all claims and all liability to the Consultant other than claims in stated amounts as

may be specifically excepted by the Consultant for all things done or furnished in connection
with this work and for every act and neglect of the Owner and other relating to or arising out of
this work. Any payment, however, final or otherwise, shall not release the Consultant or his
Sureties from any obligations under the Contract Documents or the Performance Bond and
Payment Bonds.
INDEMNIFICA TION
The Consultant will indemnify and hold harmless the Owner and the Owner's Engineer and
their agents and employees from and against all claims, damages, losses and expenses including
attorney's fees arising out of or resulting from the performance of the work, provided that any
such claim, damage, loss or expense is attributable to bodily injury, sickness, disease or death, or
to injury to or destruction of tangible property, including the loss of use resulting therefrom; and
is caused in whole or in part by any negligent or willful act or omission of the Consultant and
Subcontractor, anyone directly or indirectly employed by any of them or anyone for whose acts
any of them may be liable.
In any and all claims against the Owner or the Owner's Engineer or any of their agents or
employees, by an employee of the Consultant, Subcontractor, anyone directly or indirectly
employed by any of them, or anyone for whose acts any of them may be liable, the
indemnification obligation shall not be limited in any way by any limitation on the amount or
type of damages, compensation or benefits payable by or for the Consultant or any
Subcontractor under Workman's Compensation acts, disability benefit acts or other employee
benefits acts.
The Consultant shall require his insurance carrier to add the Owner and his agents as additional
insureds under the Consultant's general liability insurance policy with respect to the services
performed by the Consultant for the Owner.
CONTRACT DISPUTES
This Agreement shall be deemed to have been executed in Augusta Richmond County, Georgia,
and all questions of interpretation and construction shall be governed by the Laws of the State of
Georgia.
All claims, disputes and other matters in question between the Owner and the Consultant
arising out of or relating to the Agreement, or the breach thereof, shall be decided in the Superior
Court of Richmond County, Georgia. The Consultant, by executing this Agreement,
specifically consents to venue in Richmond County and waives any right to contest the venue in
the Superior Court of Richmond County, Georgia.

SEP ARA TE CONTRACTS
The Owner reserves the right to let other contracts in connection with this Project. The
Consultant shall afford other contractors/consultants reasonable opportunity for the execution
of their work and shall properly connect and coordinate his work with theirs. If the proper
execution or results of any part of the Consultant's work depends upon the work of any other
Consultant, the Consultant shall inspect and promptly report to the Engineer any defects'in such
work that render it unsuitable for such proper execution and results.
The Owner may perform additional work related to the Project by himself or he may let other
contracts containing provisions similar to these. The Consultant will afford the other
Consultants who are parties to such contracts (or the Owner, if he is performing the additional
work himself), reasonable opportunity for the execution of the work and shall properly connect
and coordinate his work with theirs.
If the performance of additional work by other Consultants or the Owner is not noted in the
Contract Documents prior to the execution of the Contract, written notice thereof shall be given
to the Consultant prior to starting any such additional work. If the Consultant believes that the
performance of such additional work by the Owner or others involves him in additional expense
or entitles him to an extension of the contract time, he may make a claim therefor as provided in
Sections "Change in the Work" and "Change in Contract Price".
SUBCONTRACTING
The Consultant may utilize the services of specialty Subcontractors on those parts of the work,
which, under normal contracting practices, are performed by specialty Subcontractors such as
analytical services.
The Consultant shall not award work to Subcontractor(s), in excess of twenty (20%) percent of
the Contract Price except analytical services, without prior written approval of the Owner.
The Consultant shall be fully responsible to the Owner for the acts and omissions of his
Subcontractors, and of persons either directly or indirectly employed by them, as he is for the
acts and omissions of person directly employed by him.
The Consultant shall cause appropriate provisions to be inserted in all subcontracts relative to
the work to bind the Subcontractors to the Consultant by the terms of the Contract Documents
insofar as applicable to the work of Subcontractors and to give the Consultant the same power
as regards terminating any subcontract that the Owner may exercise over the Consultant under
any provision of the Contract Documents.
Nothing contained in this Contract shall create any contractual relation between any
Subcontractor and the Owner.

The Consultant shall give his personal attention to the fulfillment of the Contract and shall at all
times keep the work under his control.
The Consultant may subcontract portions of the work; however, he shall not award any work to
any subcontractor without prior written approval of the Owner. The Owner's approval will not
be given until the Consultant submits to the Owner a satisfactory statement concerning the
proposed award to a subcontractor. "Work" as used herein, shall include the procuremenf and/or
fabrication and the installation of the equipment described in the Specifications.
The Consultant shall be as fully responsible to the Owner for the acts and omissions of his
subcontractors, and of persons either directly or indirectly employed by them, as he is for acts or
omissions of persons directly employed by him. All subcontractors shall be deemed to be agents
of the Consultant.
The approval of the Owner of any subcontractor shall not, under any circumstances, operate to
relieve the Consultant or his sureties of any of his or their obligations under these Contract
Documents. It is understood and agreed that all subcontracts and approvals of subcontractors
shall be based upon the requisite of performance by the subcontractor in accordance with these
Contract Documents; and should any subcontractor fail to perform his work to the satisfaction of
the Engineer, the Owner shall have the absolute right to rescind his approval at once and to
require the performance of such work by the Consultant or entirely or in part through other
approved subcontractors.
The Consultant shall submit a list of the names and addresses of proposed subcontractors,
together with the type of work to be provided, with his bid. The Consultant will not be allowed
to make changes in the list without the Owner's approval.
The Consultant shall cause appropriate provisions to be inserted in all subcontracts relative to
the work to bind subcontractors to the Consultant by the terms of these Contract Documents
insofar as applicable to the work of subcontractors and to give the Consultant the same power as
regards terminating any subcontract that the Owner may exercise over the Consultant under any
provision of these Contract Documents.
The Consultant shall inspect all work performed by subcontractors for compliance with these
Contract Documents.
TAXES, PERMITS AND LICENSES
The Consultant shall pay all applicable taxes levied by federal, state, and local governments and
obtain all permits on any part of the work as required by law in connection with the work. It is
understood and agreed that the cost of said taxes is included in the contract price(s) for the work.
The Consultant shall procure all temporary and permanent permits and licenses necessary and
incidental to the due and lawful prosecution of the work and shall pay all charges and fees, and
all costs thereof shall be deemed to be included in the contract price(s) for the work.

SPECIAL RESTRICTIONS
No site work shall be allowed after the hours of darkness or on Sunday and Holiday without
permission of the Owner.
EXISTING STRUCTURES AND UTILITIES
The existence and location of structures and underground utilities shall be investigated and
verified in the field by the Consultant before starting any site work. The Consultant shall be
held responsible for any damage to and for maintenance and protection of existing utilities and
structures.
TIME FOR COMPLETION AND LIQUIDATED DAMAGES
The date of beginning and the time for completion of the work are essential conditions of the
Contract Documents and each event shall be commenced and completed on the date specified in
the Facility Groundwater Monitoring Plan and Stormwater Pollution Prevention Plan.
The Consultant will proceed with the work at such rate of progress to insure full completion
within the contract time. It is expressly understood and agreed, by and between the Consultant
and the Owner, that the contract time for the completion of the work described herein is a
reasonable time, taking into consideration the average climatic and economic conditions and
other factors prevailing in the locality of the work.
If the Consultant shall fail to complete the work within the contract time or extension of time
granted by the Owner, then the Consultant will pay to the Owner the amount for liquidated
damages the sum of $500.00 for each calendar day that the Consultant shall be in default after
the time stipulated in the Contract Documents.
The Consultant shall not be charged with liquidated damages or any excess cost when the delay
in completion of the work is due to the following and the Consultant has promptly given written
notice of such delay to the Owner or Engineer.
1. To any preference, priority or allocation order duly issued by the Owner.
2. To unforeseeable causes beyond the control and without the fault of negligence of the
Consultant, including but not restricted to, acts of God or of the public enemy, acts of the
Owner, acts of another Contractor in the performance of a contract with the Owner, fires,
floods, epidemics, quarantine restrictions, strikes, freight embargoes and abnormal and
unforeseeable weather; and
3. To any delays of subcontractors occasioned by any of the causes specified in Paragraphs 1
and 2 of this Article.

The assessment of liquidated damages for failure to complete the WORK within the
CONTRACT TIME shall not constitute a waiver of the OWNER's right to collect any additional
damages which the OWNER may sustain by failure of the Consultant to carry out the terms of
his CONTRACT.
Time extensions, however, will not be granted for rain, wind, flood or other natural phenome.na
of normal intensity for the locality where WORK is performed. For purpose of determining
extent of delay attributable to unusual weather phenomena, a determination shall be made by
comparing the weather for at least any continuous one-fourth of the CONTRACT PERIOD
involved with the average of the preceding 5 year climatic range during the same time interval
based on US Weather Bureau statistics for the locality where the WORK is performed.
PRE-COMMENCEMENT CONFERENCE
A pre-commencement conference shall be held at an acceptable time to the Owner and the
Consultant prior to the "Notice to Proceed" to coordinate the work and satisfy all requirements
of the Contract Documents. The Consultant will be required to, prior to contract execution, to
submit project schedule to exhibit project understanding and conformance with this operational
deadlines.
CONTRACT TERMINATION
Pursant to O.c.G.A. 36-60-13, this Agreement shall terminate absolutely and without further
obligation on the part of the Owner at the close of the calendar year in which this Agreement is
executed and at the close of each succeeding calendar year for which the agreement may be
renewed by the parties hereto.
This Agreement shall nevertheless automatically be renewed unless the Owner provides written
notice to the Consultant of its intention to terminate the Agreement at least thirty days prior to
the close of the calendar year for which the Agreement is presently effective between the parties
and/or has been renewed by the Owner. This Agreement shall obligate the Owner solely for
those sums payable during the initial term of execution or in the event of renewal by the Owner
for those sums payable in such individual renewal terms.
Notwithstanding the foregoing language, the Consultant agrees to continuously render the
professional services specified by the Agreement to the Owner for such terms or renewal terms
as are effective pursuant to this Agreement and for which the Owner agrees to pay in accordance
with the terms of the Agreement or any future amendments thereto.
The Owner may terminate this contract in part or in whole upon written notice to the
Consultant. The Consultant shall be paid for any validated services under this Contract up to
the time of termination.

PERSONNEL
The Consultant represents that it has secured all personnel necessary to complete this
agreement, none of whom shall be employees of, or have any contractual relationship with, the
Owner. Primary liaison with the Owner will be through its designeelProject Manager. All of
the services required hereunder will be performed by the Consultant under his supervisi~m, and
all personnel engaged in the work shall be fully qualified and shall be authorized or permitted
under law to perform such services.
All professional personnel, including ~ubcontractors, engaged in performing services for the
Consultant under this agreement are indicated as Project Team in Consultant Proposal and
incorporated herein by reference. No changes or substitutions shall be permitted in the
Consultant's key personnel as set forth herein without the prior written approval of the Owner
or his designee.
The Consultant shall employ in responsible charge of supervision and design of the work only
persons duly registered in the appropriate category; and further shall employ only qualified
surveyors in responsible charge of any survey work.
The Consultant shall endorse all reports, contract plans, and survey data. Such endorsements
shall be made by a person duly registered in the appropriate category by the Georgia State Board
of Registration for Professional Engineers and Land Surveyors, being in the full employ of the
Consultant and responsible for the work prescribed by this agreement. ?

ELECTRONIC DOCUMENTS
The Consultant shall submit electronic files of all project related documentation to Owner
according to RFP - Section Finished Product.
CONFIDENTIALITY
The Consultant agrees that its conclusions and any reports are for the confidential information
of the Owner and that it will not disclose its conclusions in whole or in part to any person
whatsoever, other than to submit its written documentation to the Owner, and will only discuss
the same with it or its authorized representatives. Upon completion of this agreement term, all
documents, reports, maps, data and studies prepared by the Consultant pursuant thereto shall
become the property of the Owner and be delivered to the Augusta Environmental Engineer.
Articles, papers, bulletins, reports, or other materials reporting the plans, progress, analyses, or
results and findings of the work conducted under this agreement shall not be presented publicly
or published without prior approval writing of the Owner.
It is further agreed that if any information concerning the project, its conduct, results, or data
gathered or processed should be released by the Consultant without prior approval from the

Owner, the release of same shall constitute grounds for termination of this agreement without
indemnity to the Consultant, but should any such information be released by the Owner or by
the Consultant with such prior written approval, the same shall be regarded as public

Introduction and Background
Augusta Georgia currently owns approximately 1,177 acres southwest of Augusta., Georgia, which is the
site of the existing Deans Bridge Road MSW Facility, Active and closed sections of the Solid Waste
Facility comprise approximately 130 acres of the total property, Closed section is designated as ILAJI!B
and active section is designated as ne. Each section has a separate groundwater monitoring (GW)
network, 31 groundwater wells monitor section ILAJIIB section and 23 groundwater wells monitor
section lIe. These wells are installed at variable depths to monitor regional \\'ater table and two perched
water tables (see anached tables),
Augusta Georgia is seeking proposals from qualified professional environmental firms with at least three
years experience in perfonning landfill groundwater quality assessment and monitoring surface water,
and stonnw:ller runoff quality monitoring in the State of Georgia, These services shall be performed in
accordance with Georgia Environmental Protection Division (EPD) Rules and all applicable guidance
documents, EPD approved Groundwater Monitoring Plan for the Facility, and the Facility latest
SIOT111\\'ater Pollution Prevention Plan,
L Project Requirements
A. Project Scope of Services
Augusta, Georgia requires the services of a professional environmental consultant to provide professional
seryices for this landfill project. The contract will be for three years with possibility of two more years
e\.'1ension; ho\\'ever Augusta will have an option to terminate the project incase of unsatisfactory service,
The selected consultant will provide professional services as required by the Facility's Groundwater
Monitoring Plan including additional indicator parameters requested by the Facility, The selected
consultant \\'ill also provide professional ser,ices as required by the Facility stormwater management
plan to comply \\'ith State SIOrmwater general permit for industrial acti\'ities,
Laboratory detection limits shall meet the EPD required limits, The selected consultant shall re-sample
and re-test any sampling point with no additional compensation if any data might be rejected by the EPD
due to failure to meet detection limit requirements,
The selected consultant \\'ill provide minimum of two hard copies and one electronic copy of all
submittals including supporting data &. calculations to Augusta. Georgia for owner's use, This is in
addition to EPD submittals, Professional services required for this project include:

Groundwater Sampling & Testing
· Each year two semiannual sampling events will be performed and each cvent will entail the sampling of
54 groundwater monitoring wells in Landfill Sections II-A & Il-B (31 wells) and lI-C (23.' wells),
Sampling shall be conducted each year in the Month of March and September. Each event shall include
provision to re-sample and re-analyze the groundwater at five (5) points,
· Each sampling event shall include field and laboratory QNQC sampling & testing, A field blank shall
be taken at least once for each day that groundwater wells are sampled if reusable sampling equipment is
used,
· Sample collection field data shall include information minimum of: initial well volume (gallons), number
of volume removed, total purge volume (gallons), pH, conductivity (flS/cm), temperature (OF), and
turbidity C\rus) ,
· Each sample shall be tested for pollutants listed in 40 CFR pan 258 under Appendix 1 volatile organics
(5W-846 Method g260B): 1.2-Dibromoethane & 1,2-Dibromo-3-chloropropane (5W-846 Method 8011);
and Appendix 1 Metals (5\\'"-846 Method 6010/7000 series),

Surface Water Sampling & Testing
· Surface water is monitored around the site as required by the Facility EPD approved Groundwater
I\'lonitoring Plan, Sampling & testing information shall be incorporated into the Facility semiannual
groundwater monitoring repon, Samples shall be collected from the surface water at four sampling
points semi-annually, Surface water sampling should be conducted in conjunction with groundwater
sampling events, However, sampling events shall not be conducted when stream flow conditions are
below the 7-day, lO-year minimum flow (7Q I 0) condition, When a scheduled sampling event is
impacted by this condition, an alternate schedule to complete the required sampling event shall be
established,
· Each sample shall be tested for pH, conductivity (flS/cm), temperature eF), D,O. (mg/L); chloride
(MCA\VW 300,1), COD (MCAWW 410.4), TOC (MCA~W 415,1), cyanide (MCA\VW 335.4), and
metals [arsenic, cadmium, chromium, lead, nickel, selenium, silver, zinc (SW-846 Method 6010B)]
Potentiometric Surface Maps
Potentiometric surface maps shall be prepared for the combined landfill sections (IWIlB and IIC) for each
groundwater sampling event separately for regional water bearing, zone and for the two perched water tables.

The direction of groundwater flow and hydraulic gradient for the regional water bearing zone and the two
perched water tables shall be determined and reported for each sampling event by a registered Professional
Geologist in the State of Georgia, Generated maps and relevant information shall be documented in the
semiannual groundwater monitoring report for Phase ILAJIIB and also in report for Phase 11C. Each
potentiometric surface map will be cenified by the Professional Geologist.
Statistical Data Evaluation and Trend Analysis
A statistical analysis .bf the groundwater analytical results shall be ,generated and documented in the
groundwater monitoring report, Statistical data evaluation shall be performed for landfill sections
ILAJIIB and lIC following each sampling event. The statistical analysis will be completed in accordance
with the ASTM method PS 64-96 provisional standard guide for developing statistical approaches for
groundwater detection monitoring program and applicable EPD regulations and/or guidelines, The
Facility is presently using DumpStat software and will prefer to continue its use, The Facility is not
responsible to provide the selected contractor with 3 copy of the statistical analysis software, The
sta!istical eval uation shall include:
· Charactcrization of monitoring well concentrations including the means and standard deviations;
· A comparison of the groundwater monitoring results with water quality criteria to identin'
constituents \\'hich arc close to and/or have exceeded the water quality criteria:
· A comparison of groundwater monitoring results to the existing tolerance inte[\'al:
· A statistical comparison between inter- and intra-well monitoring results to identify any
statistically significant evidence of contamination, Utilize A?\iOVA parametric and/or non-
parametric analyses, as appropriate to the distribution of the data, to examine statistical
differences; and
· Tabulated Trend analyses for the contaminants for all the wells, Prepare graphs of the trends in
concentr.uions versus time for up to five constituents detected in up to five monitoring wells,
Typ~ of constituents included in trend analysis might vary from well to well.
Landfill Gas Extraction Vs Groundwater Qualit). Impact Analysis
Groundwater quality at the Facility is impacted by landfill gas buildup, Landfill gas e:-..'traction (LFG) impact
analysis around the area of concern shall be performed to evaluate effectiveness of the c:-..'traction points in that
area. Impact analysis will require comparison of historic. and existing LFG system operating conditions and
groundwater quality improvement within the area of concern. .Analysis shall also address any needed
changes/adjustment in e:-..'traction pressure at any of the e:\.lraction wells.
Stormwater Annual Sampling & Testing
· Annual stormwater sampling and testing is required under the Facility eXlstmg storm water permit.
Samples shall be collected at four sedimentation outfalls during a representative stormwater event as
outlined in the Georgia General Stormwater Permit (GAROOOOOO). A "first flush" grab s::unple shall be

collected from each of the four outfalls within 30 minutes (or as soon as thereafter as practical, but not to
exceed one hour) of the first noticeable discharge from each respective outfall.
· The date and duration of the storm event sampled, estimated rainfall measurement, and elapsed time
since last measurable storm shall be recorded.
· Each sample shall be tested for total magnesium, dissolved magnesium, COD, TDS, TKN, TOC, oil and
grease, turbidity, pH, total arsenic, total barium, total cadmium, total cyanide, total lead, total mercury,
to~ selenium, and total silver.
Stormwater Quarterly Discharge Inspections
· Inspect storm water discharges from each of the four outfalls during a representative storm event on a
quancrly basis (four inspections per year), The inspt:ction process shall include a visual exarriination of
the storm water within 30 minutes (or as Soon thereafter as pr.lCtical, but not to exceed one-hour) of the
first noticeable discharge from each respective outfall during a respective storm event.
· Samples of the discharge shall be collected in cle:rr glass containers, one per outfa1l, and taken to a well-
lit area for cxamination,
· Tne visual examination shall document the color, odor, clarity, floating solids, senled solids, suspended
solids, foam, oil, scum, turbidity, any materials associated with municipal of domestic sewage and
industrial waste, and any other objectionable conditions.
· Information shall be recorded on Visual Examination Record Form provided by the Facility,
If required samples could not be collected over the coursc of the visual examination period as a result of adverse
conditions, the Consultant shall document the reason for not performing the visual examination and provide these
records with the completed Visual Examination Record Forms to the Facility,
Project 1\'1anagement
· Provide regular updates on project progress, schedule, budget and other project issues requmng
O\mer input. A formal meeting shall be conducted at the Facility to communicate an" critical
information, if need arise,
Finished Product
A draft copy of finished product for each event for each landfill phase shall be submined to Augusta, Georgia for
review. The selected Consultant shall address and include Augusta, Georgia comments in final finished product
prior to reproduction and distribution of final document to required entities, The selected firm shall deliver
following reports in accordance with the project schedule,
· Provide minimum of two hard copies and one electronic copy of the Professional Geologist Certified
Groundwater Monitoring Reports for Landfill Section IIAIllB including supporting data & calculations

B. Utilities
There is no water or electricity at the requested work site, however, water (in limited quantities) and
power is a\';lllable at the landfill offices and arrangements should be made to obt:1in the' necessary
utilities,
C. Schedule
The anticipated start date for the project is March 2001, Selected firm will be required, prior to contract
execution, to submit project schedule to exhibit project understanding and conformance with this
operational deadline,
D. Waste Handling and Disposal
The selected firm shall be responsible to make required arrangements for proper storage of purged water
generated :lS a result of ground\\'31er sampling event and equipment decontamination process, The
selected firm will be allowed to transfer purged water to a containment pond located at e:lStern side of the
L:mdfill Ph:lSe ll-C. 1t will be the selected firm responsibilities to transpon purged water from individual
points to the final disposal location, Non-liquid non-hazardous waste can be disposed in the Facility
active phase, .A.ny other waste generated as a result of the tasks performed under this proposal shall be
disposed off by the selected firm without any additional compensation,
II. Professional Environmental Qualifications
· Qualifying professional environmental firms must demonstrate experience in conducting landfill
groundwater quality assessment and stormwater monitoring for industrial activities in the State of
Georgia. References shall be provided to verify project experience, In addition, the firm must have a
registered Professional Geologist in the State of Georgia on staff who has a minimum of five years of
experience conducting groundwater monitoring assessments for landfills. '
· Qualifying professional environmental firms must have three ongoing landfill groundwater monitoring
assessment projects in the State of Georgia,
· The successful firm must obUlin and maintain through out the contract period, including any time
e:\.'tensions, the necessary insurance to protect the firm, subcontractors and the Augusta Georgia, This
insurance will include a minimum of $1,000;000 of General and Professional (Errors and Omissions)
liability coverage.

III. General Conditions
Contract Disputes
The Contract Agreement shall be deemed to have been executed in City of Augusta Georgia, and all
questions of interpretation and construction shall be governed by the Laws of the State of Georgia,
All claims, dispute and other matters in question between the Augusta and the selected Laboratory arising out
Of.' relating to the Agreement, or the breach thereof, shall be decided in the Superior Court of Richmond
County, Georgia, The selected finn, by executing the Contract specifically consents to venue in Richmond
County and waives any right to contest the venue in the Superior Court of Richmond County, Georgia,
Subcontracting
The selected finn my utilize the services of specialty Subcontractors on those parts of the work, which, under
normal contracting practices, are perfonned by specialty Subcontractor such as anal~1ical ser\'ices.
The selected finn shall not award work to Subcontractor(s) in excess of 20% of the Contact Price, without
prior written approval of the Augusta,

The selected finn agrees that its plans, conclusions and repons are for the confidential infonnation of the
Augusta and that it will not disclose its conclusions in whole or on part to any person whatever other than to

IV. Proposal Format
The proposal shall be organized into the following sections providing sufficient detail to address the RFP
requirements,
A. Firm Overview
Provide finn's capabilities and overview. Shall include finn's history including years of service, office
locations, executive officers, and services offered by the finn.
B. Project Team
Provide finn's proposed project team, individual responsibility, team organization, work e:\.'perience
(resumes) and finn's general business background, Site work (groundwater sampling) personnel shall

include a minimum of one degreed professional member, preferably a Professional Geologist registered
in the Sure of Georgia, experienced in landfill groundwater sampling, This individual will be required to
be on Site during each monitoring event and participate in or supervise the groundwater/storm water
sampling activities, Subcontractors and anal:tical laboratory proposed for perfonning the project tasks
must be identified in the proposal for review, Provide proposed laboratory statement of qualification ~d
list of ongoing landfill water quality assessment projects,
C. Qualifications
Provide qualifications of the finn and project experience including Owners name, address, contact and
telephone number for references of successful similar projects or work, Finn qualifications shall address
the requirements of this RFP,
Provide qualifications of the laboratory proposed for the project,
Pro\'idc qualifications of the subcontractors,
D. Technical Approach
Provide a detailed technical approach outlining all required tasks to accomplish the project requirements
set fonh in Section IT of this RFP, Approach shall also include sequence of planned fieldwork (such as
water level measurements, well purging, field parameters testing, actual sampling, etc,), Turbidity could
become problem at some sampling points, Approach shall describe meo.sures that would be adopted to
handle turbidity,
E. Fee Proposal
Submit charges for selyices to be perfonned and a per event cost breakdo\\n into these sections:
ground\\,:lter (including surface water) sampling and testing, potentiometric surface maps, statistical data
evaluation and trend analysis, LFG eAtraction impact analysis, ground\\'ater (including surface water)

Selected firm shall submit a detailed project schedule, prior to contract execution, to exhibit project
undersunding and to provide a basis for the execution of the work. This schedule must identify tasks and

include critical milestones and tasks on the critical path,
G. Financial Information

V. Evaluation Criteria
Selection of the professional engineering consultant will be based on the following criteria:
1, Specialized Experience of Firm (15%)
This includes specialized experience directly related to the project, demonstrated ability to complete the
work within the required schedule and budget, and depth of in-house and subcontractor support,
This also includes laboratory experience, qualifications and QA./QC procedures.
2, Project Personnel (20%)
This includes the role, commitment and qualifications of key personnel in the areas assigned,
3, Approach to Work (20%)
This is to include the approach to the project scope as described, the understanding of the project scope
and schedule of work and interfacing of tasks,
4. Cost (40%)
Include a complete cost breakdown for personnel, sampling, testing, data analysis, mapping, drafting,
reponing, material costs, etc,
5, Other Considerations (5%)
This will be at the County's discretion and may include financial stability, comments from references,

GROUNDWATER SAMPLING/fESTING PROCEDURES
Static groundwater level measurements will be recorded at each monitoring well prior to
purging. The measurements will be made with a pre-cleaned "Solinst" electronic water
level detector and will be reported to the nearest 0.01 foot based on a fixed point on the top
of the well casing.
Th~' existing 54 monitoring wells will be purged with the dedicated bottom loading Teflon@
bailers with the existing or new nylon rope until three well volumes are removed, or the
well was evacuated of all water. All purged groundwater will be disposed of in the
secondary containment area discussed in the RFP
EMA personnel collected groundwater samples once the wells had recharged. Field
measurements of turbidity, pH, conductivity, and temperature will be recorded
concurrently with sample collection.
All groundwater samples will be submitted to AES for the Appendix I volatile organic
compounds (V0Cs) and EDB and DBCP by SW-8461 method 8260/8011 and Appendix I
metals by SW-846 method 6010/7000 series. The groundwater samples will also be analyzed
for the indicator parameter list (pH, conductivity, cations, anions, total dissolved solids,
iron, and total organic carbon) per the methods listed in the RFP. EMA has included the
price for one trip blank sample to monitor for volatile organic compound cross-
contamination between samples during shipment and storage.
SURFACE WATER SAMPLING AND TESTING
In addition to the groundwater sampling, three surface water samples will be collected
from adjacent South Prong Creek (SW A-l, SWC-1, and SWC-3) and one surface water
sample will be collected from the discharge at the sediment basin (SWC-2). The samples
were collected in the laboratory-supplied sample containers by the grab method using new
disposable Nitrile gloves. Field measurements of dissolved oxygen, pH, conductivity, and _
temperature will be performed concurrently with sample collection. The surface water
samples will be submitted to AES for analysis of COD, chloride, cyanide, Toe, and select
list metals. The analytical results will be compared with the Georgia In-stream Water
Quality Standards for evaluation purposes.
DIRECTION OF GROUNDWATER flOW
Potentiometric surface maps for the regional water table (Zone 3) and for the two perched
water tables (Zones 1 and 2) will be prepared semiannually based on the measured
groundwater elevations by EMA's State of Georgia Professional Geologist, Yo Sumartojo or
John Schwaller.

STATISTICAL OAT A EVALUATION AND TREND ANALYSIS
As requested in the RFP, statistical data evaluations will be performed for Landfill Sections
II-A / II-B and II-C following each sampling event A general summary of the EPD
requirements for statistical data evaluations for landfill gTOundwater monitoring is as
follows:
i) An analysis of variance (ANOY A) based on ranks followed by multiple
comparisons procedures to identify statistically significant evidence of
contamination. The method will include estimation and testing of the contrasts
between each compliance well's median and the background median levels for
each constituent; and
ii) comparison of the monitoring results with water quality criteria to identify
constituents which are close to and/ or have exceeded the water quality criteria.
Groundwater historical data and the most recent groundwater results will be analyzed
using EMA's registered copy of the statistical software, DUMPStat Yersion 2.1.1, to
determine if statistically significant concentrations of contaminants are present in the
groundwater from the Facility. Upgradient versus downgradient comparisons will be
made for the inorganic parameters (metals) using prediction intervals. A prediction
interval is a statistical interval based on the concentrations of chemical constituents in
background samples to which future observations from the same population are expected
to be present If a constituent concentration from a downgradient monitoring well does not
exist within the prediction interval, then it is evident that this constituent does not come
from the same population and that there is statistical evidence of contamination. If a
constituent is not present in upgradient samples (background detection frequency equals
zero), then the laboratory reporting limit becomes the upper limit for the prediction
interval Therefore, for VOCs and other non-naturally occurring constituents, it is an
indication of a significant exceedance if that constituent is detected above the reporting
limit in a downgradient well.
A trend of the contaminant concentrations over time will be conducted for all wells.
Graphs of the trends in the contaminant concentrations for up to five constituents detected
in up to five monitoring wells will be prepared on a semiannual basis and will be included
in the semiannual groundwater and surface water monitoring report as directed by
Augusta-Richmond County.
LANDffiL GAS EXTRACTION VERSUS GROUNDWATER QUALITY IMP ACI'
ANALYSIS
. The semiannual groundwater and surface water monitoring report will include an
evaluation conducted by one of EMA's Professional Geologists to determine the
effectiveness of the gas extraction system on the groundwater quality at each extraction
point The trend in contaminant concentrations within the groundwater and a summary of
operating conditions provided by the current LFG system operator will be used for
evaluation purposes.

STORMW ATER ANNUAL SAMPLING & TESTING
The annual storm water sampling will be conducted in accordance with Georgia's general
industrial storm water permit (GAROOOOOO). The requirements presented in ,the RFP and
the existing Storm Water Pollution Prevention Plan (SWP3) for the Dean's B~dge Road
Landfill will be followed. '
It is EMA's understanding that four outfalls will be sampled during a "representative"
storm event at the Facility and the results reported in an annual summary report within 15
business days following the sampling event. The representative storm event for the annual
sampling event must meet the following two criteria to be considered representative: '
· the storm event must have a volume greater than 0.1 inch; and
· the storm event must occur after a minimum of 72 hours from the previous
storm event having a volume greater than O.l-inch.
A "first flush" grab sample will be collected from each outfall within 30 minutes (or as soon
thereafter as practical, but not to exceed one-hour) of the first noticeable discharge from the
outfall. The sample will be collected in accordance with the procedures and practices
described in your existing Storm Water Pollution Prevention Plan (SWP3) and the
procedures outlined in the USEP A' s guidance document "Guidance Manual for the
Preparation of NPDES Permit Applications for Storm Water Discharges Associated With
Industrial Activity", EP A-50S 8-91-002, Apri11992.
The samples will be analyzed for total magnesium, dissolved magnesium, chemical oxygen
demand (COD), total dissolved solids (IDS), total kjeldahl nitrogen (TKN), total organic
carbon (IOC), oil and grease, pH, total arsenic, total barium, total cadmium, total cyanide,
total lead, total mercury, total selenium, and total silver. The date and duration of the storm
event sampled, estimated rainfall measurement, and elapsed time since last measurable
storm will also be recorded. The results of the annual storm water sampling event will be
provided to Augusta-Richmond County in a summary report.
STORMWATER QUARTERLY DISCHARGE INSPEOlONS
An EMA representative will conduct quarterly inspections of the discharge from the four
outfalls. The criteria for inspection will be the same as presented above for the annual
sampling. The requirements presented in the RFP and the existing SWP3 for the DeaI}' s
Bridge Road Landfill will be followed.
~SHED PRODUcr (REPORT PREPARATION)
All required draft and final hard copy and electronic copies of the semiannual groundwater
and surface water monitoring reports, the annual stormwater reports, and all associated
analytical data will be provided to Augusta-Richmond County in accordance with the RFP.
Augusta-Richmond County's Environmental Engineer and EPD's Project Geologist (Ms.
Carole Wintle) is already familiar with the content of our reports for this type of work.
