MUTUAL FIREFIGHTING ASSISTANCE AGREEMENT

This mutual agreement entered into this P -- day of ~ ,
200 I, by and between Fort Gordon, on behalf of the Fort Gordon Department, and
Augusta, Georgia, on behalf of the Augusta-Richmond County Fire Department.
WHEREAS~ if it is deemed to be in the public interest to execute a Mutual
Firefighting Agreement wherein each of the fire departments assist the others in major
firefighting effort,
THEREFORE, in consideration of the mutual benefit to be derived by
both the Fort Gordon Fire Department and the Augusta-Richmond County Fire
Department it is hereby agreed:
1, SERVICE: In the event of a major fire, or under circumstances,
which indicate that a major fire might develop within areas of either of the department's
responsibility, mutual assistance in combating the fire or the threat will be rendered by
the force not directly involved by the dispatching of fire equipment and personnel to the
scene of the Fort Gordon Fire Department or the Augusta-Richmond County Fire
Department as the case may be.
2, REQUESTING ASSISTANCE: Assistance
Agreement may be requested or authorized by the following officials:
under
this
(a) For the Fort Gordon Fire Department's Chief or Assistant
Chief,
(b) For the Augusta-Richmond County Fire Department, the
Chief or Deputy Chiefs or their chosen representative.
3, SCOPE OF AUTHORITY: The Chief of the Fort Gordon Fire
Department shall bear the authority for directing all activities within its
protection area, while the Chiefs of the Augusta-Richmond County Fire
Department, shall bear the authority for directing all activities under this
Agreement.
4, COST AND REMUNERATION: No compensation will occur
or become due for any service rendered under the Agreement.
5, RESPONSIBILITY AND LIABILITY: Neither organization
will assume responsibility for damages to property as a result of firefighting activities
made at the request of other organizations,

If circumstances change during the firefighting of a fire to the extent that it
is necessary to recall personnel and fire equipment from the scene to answer a call
elsewhere, that actions is not to be considered a breach of this Agreement.
6, DAMAGE TO EQUIPMENT: No liability is assumed by
either party of damage to the equipment used by the other party.
7, DEATH OR PERSONAL INJURY: Each party hereby
waived all claims against the other party for compensation for any loss, damage, personal
injury or death occurring in consequence for performance of this Agreement.
8, TERMINATION: Either party of this Agreement may
terminate this Agreement at any time by giving thirty (30) days written notice to the other
party, and no services will be rendered by either party after the effective date of
termination,
