This Agreement made and entered into this I day of ~~ ,2003, by and
between the Georgia Department of Natural Resources, Env' nmen I ProtectlOn DIvIsIOn
(hereinafter, "EPD"), and the Augusta-Richmond County (hereinafter, "GRANTEE")
I. RECITALS
WHEREAS, the State of Georgia is interested in the promotion of the health and welfare of its
citizens; and
WHEREAS, cooperative efforts of the state and local governments are beneficial to the citizens
of Georgia;
WHEREAS, Section 12-8-37.1. ofO.C.G.A. provides that EPD may grant and administer funds
for the purpose specified therein; and
WHEREAS, certain funds were appropriated by the General Assembly for the purposes set forth
herein; and
WHEREAS, GRANTEE warrants that it has the authority to expend monies for the purposes set
forth herein; and
WHEREAS, GRANTEE, in a duly held meeting of its Board of Commissioners, adopted a
resolution, which is attached hereto and incorporated by reference, approving this Agreement and
authorizing the acceptance hereof:
NOW, THEREFORE, in consideration of the mutual promises and other good and valuable
consideration set forth below (the receipt and sufficiency of which is acknowledged by the
respective parties), the parties hereby agree as follows:
II. DEFI~ITIONS
Allowable Purposes: For the purposes if this Agreement, allowable purposes are defined as the
approved activities outlined in Exhibit A (the GRAt"fTEE application) and the basic EPD
requirements that are listed in Exhibits Band C. These activities are later referred to in the
scope, Section B, of this Agreement. Activities which are not considered allowable purposes
shall include, but are not limited to, animal control, septic tank inspections, building code
inspections, and business license inspections.
Default: A default is a breech of this Agreement resulting from one or more of the following
situations:
I. GRANTEE does notadhere to the scope of the Agreement,
2. GRANTEE does not comply with certain requirements explained in this Agreement,
or
3. GRANTEE uses equipment or supplies for non-allowable purposes.

III. TERMS AND CONDITIONS
A. TER'VI
The initial term of this Agreement shall commence July 1,2003, upon execution by all parties
hereto, and shall thereafter continue for a period of one (1) year. This Agreement may be
renewed for one (I) additional year upon written mutual consent of the parties. Each respective
renewal shall be upon the same terms and conditions, and shall be effected at least thirty (30)
days prior to expiration of the initial or then current term of this Agreement.
B. SCOPE
Subject to the terms and conditions hereinafter set out, EPD hereby agrees to reimburse
GRANTEE $52,792.00 over the course of this Agreement plus any additional amounts amended
into the awarded budget by mutual agreement. EPD agrees to reimburse GRANTEE for those
sums hereinafter expended for the purposes and uses set forth and described in GRAt'J'TEE'S
application attached hereto as Exhibit "A" and incorporated herein and made a part hereof.
GRANTEE must also comply with the "Expectations of Local Code Enforcement Officers"
attached hereto as Exhibit "B", and with the "Expectations of Local Education Programs"
attached hereto as Exhibit "C". All exhibits are incorporated herein and made a part hereof
(hereinafter, the items in Exhibit "A", Exhibit "B", and Exhibit "C" will be referred to as
"Allowable Purposes").
C. PAYMENT
(1) A request for reimbursement of expenditures for Allo\yable Purposes (hereinafter, "Request
for Reimbursement") shall be submitted to EPD on forms designated by EPD. Requests for
Reimbursement may be submitted as and when respective tasks are completed in connection with
the Allowable Purposes by GRANTEE provided, however, no more than a total of one (1)
Request for Reimbursement shall be submitted by GRANTEE to EPD within any given ninety
(90) day period. The request for Reimbursement shall be submitted to the following person at
EPD: Janet Foster, Environmental Project Administrator, 4244 International Parkway,
Suite 104, Atlanta, Ga. 30354.
(2) Before a Request for Reimbursement will be considered by EPD, the respective tasks for
which reimbursement is sought must first have been completed by GRANTEE and a quarterly
report (see paragraph H) documenting such must first have been submitted by GRANTEE.
(3) Upon receipt of all required documentation, EPD will conduct its review of the Quarterly
Report and the Request for Reimbursement, and, thereafter, provide written notification to
GRAt'J'TEE as to which portion of the requested funds will be reimbursed to GRANTEE
(hereinafter, "Reimbursed Costs"). Except as may otherwise be provided herein, payment of the
Reimbursed Costs shall be made within thirty (30) days of EPD's written notification to
GRAt'\!TEE of its approval thereof. In no event shall GRAt'ITEE be entitled to receive payment
for more than the awarded budget pursuant to this Agreement.
(4)The following person(s) are hereby designated as being authorized to receive payment of the
Reimbursed Costs on behalf of GRANTEE:

The above person(s) may be substituted or changed by GRANTEE upon written notice to
EPD pursuant to paragraph 0 below.
D. USE OF FU:\TDS
The Reimbursed Costs must have been used only for the Allowable Purposes designated herein
and for no other purpose. Equipment purchased with grant funds must be for Allowable
Purposes with the only exceptions being severe weather, natural disasters, or other local
emergencies. In the event EPD detennines that the Reimbursed Costs (or portion thereot) have
been utilized for any non-Allowable Purpose, EPD shall be entitled to treat such unauthorized
use of the Reimbursed Costs as a default by GRAt'\fTEE pursuant to the provisions of Paragraph
K (1) below.
E. BUDGET CHANGES
The GRANTEE must request approval prior to the expenditure of any funds for any and all
budget changes. A reallocation of tunds may be requested by submitting a budget revision in the
same format used in the original application. The request shall be accompanied by a narrative
justification for the proposed reallocation. Approval will not be given to those requests for
reallocation which do not support the goals and objectives of the grant program.
F. ACCOGNTING RECORDSIRIGHT TO INSPECT
(1) Accounting System/Records Retention Requirements
GRANTEE agrees to maintain an accounting system which meets the requirements of the
Government Accounting Standards Hoard (hereinafter "GASH"). The accounting system shall
maintain books, records, documents, and other evidence which pertain to and sufficiently support
(in accordance with GASB) the Reimbursed Costs provided to GRANTEE pursuant to this
Agreement (hereinafter collecti vely, "Records"). Accounting procedures, policies, and Records
shall be completely open to State audit at any time during and for a period of five (5) years from
the date of payment of the Reimbursed Costs, and GRANTEE shall preserve and make available
such accounting procedures, policies and Records during such time period. GRANTEE may,
with the prior written consent of EPD, and in fulfillment of its obligation to retain Records as
required by this paragraph, substitute photographs, microphotographs or other authentic
reproductions of Records, after the expiration of two (2) years following the date of payment of
the respective ReImbursed Costs to which such Records relate, unless a shorter period is
authorized by EPD with the concurrence of the State Auditor or his duly authorized
representative. PermiSSIOn to substitute Records as provided herein shall be within the sole
discretion of EPD.

(2) Case Files/Records Retention Requirements
GR.A1'\TTEE agrees to maintain an inspection and case documentation filing system which
documents work performed under this Agreement. The filing system shall maintain inspection
reports, written correspondence, and pictures related to scrap tire, solid waste and other
environmental compliance activities. These Records shall be completely open to State audit at
any time during the contract period and for a period of three (3) years from the contract
expiration date.
GRANTEE shall also abide by the provisions of the Georgia Open Records Act (GORA) when
information is requested from the public.
(3)Audit Requirements
The State standards for audits of contractors, and programs conducted under this Agreement are
applicable to this section and are incorporated by reference as though fully set out herein.
G. RIGHT TO INSPECT WORK
EPD, the State Auditor of Georgia, or their authorized representatives shall, during normal
business hours, have the right to enter into the premises of GRANTEE and/or all subcontractors,
or such other places where the work for which the Reimbursed Costs have been provided, for the
purpose of inspecting, monitoring, or otherwise evaluating such work.
H. PERIODIC REPORTS
At least once every three (3) months throughout the course of this Agreement (inclusive of the
initial term and all renewal periods), GRANTEE shall submit a written report to EPD. The
written report shall include any information with respect to the Reimbursed Costs and activities
related to the Allowable Purposes under the Agreement. Said report shall be submitted to EPD
in a format designated by EPD and is due fifteen days after the end of the quarter. Failure to
submit timely reports may constitute a default pursuant to section K of this Agreement.
I. RELA TIONSIDP OF THE PARTIES
Neither GRANTEE nor any of its respective agents, servants, employees or subcontractors shall
become or be deemed to become an agent, servant or employee of EPD as a result of this
Agreement. Provided further, this Agreement shall not be construed so as to create a partnership
or joint venture between GRANTEE and EPD.
J. TRADlNG WITH STATE EyIPLOYEES
The parties certify that the execution of this Agreement does not and will not violate the
provisions ofO.C.G.A. S 45-10-20 et seq. in any respect.

K. TER\'liNATION
This Agreement may be terminated by EPD for any or all of the following reasons: for any
default by GRAt'TTEE; for the convenience of EPD; and in the event sufficient funds no longer
exist for the payment of EPD's obligations hereunder. Each of these is described in the following
paragraphs.
(1) Termination for Default
The failure of GRAt'TTEE to comply with any term, condition, or provision of this Agreement
shall, at the option of EPD, constitute a default by GRANTEE. Lack of progress in completing
the activities described in Exhibits A, Band C during the first 90 days, or any time thereafter,
shall also, at the option of EPD, constitute a default by GRANTEE.
In the event of default, EPD shall notify GRANTEE in writing by hand-delivery or by certified or
registered mail, return receipt requested, of the specific act or omission of GRAt'ITEE which
constitutes default. GRANTEE shall have fifteen (15) days from the date of receipt of such
notification to cure such default.; provided, however, if, in the sole discretion of EPD,
GRANTEE'S default poses an imminent danger to the safety and health of the general public,
EPD may require in the written notification that GRAt'ITEE cure the default within a time period
less than fifteen (15) days. In the event of default, and during the above specified grace period,
performance under the Agreement shall continue as though the default had never occurred. In
the event the default is not cured in fifteen (15) days (or within such other time period as
required by EPD in the written notification of default to GRANTEE), EPD may, at its sole
option, terminate this Agreement for default. Such termination shall be accomplished by written
notice of termination forwarded to GRAt'TTEE by certified or registered mail and shall be
effective at the close of business on the date specified in the notice.
Situations that EPD considers to be automatic default of this Agreement and may require the
immediate termination of this Agreement without the opportunity of cure, include:
a. GRAt"l'TEE fails to hire an environmental compliance officer within 90 days of
GRANTEE's receipt of the fully executed Agreement, or
b. GRANTEE has been placed in default a second time.
Upon effective termination of this Agreement as provided herein, GRANTEE shall not be
entitled to any further payments pursuant to this Agreement (regardless of whether such
payments may have previously been approved by EPD), and may be required to immediately
return to EPD Reimbursed Costs and physical equipment previously paid to GRANTEE pursuant
to the schedule described in section N. The remedies provided EPD herein shall be in addition to
and not in lieu of any other remedies that EPD may have by reason of GRANTEE'S breach of
this Agreement.
(2) Termination for Convenience
EPO may terminate this Agreement in whole or in part whenever, for any reason, EPO shall
determine that such termination is in the best interest of the State of Georgia. In the event that
EPO elects to terminate the Agreement pursuant to this provision, it shall so notify GRANTEE
by certified or registered mail, return receipt requested. The termination shall be effective as of
the date specified in the notice. Upon effective termination of this Agreement as provided

hereln, GRANTEE shall not be entitled to any further payments pursuant to this Agreement
(regardless of whether such payments may have previously been approved by EPD)
(3) Termination for Unavailability of Funds
Notwithstanding any other provision of this Agreement, the parties hereto agree that the charges
hereunder are payable by EPD from the Solid Waste Trust Fund. In the event that the source of
payment for the total obligation no longer exists or is insufficient with respect to the matters
addressed herein, in the sole discretion of EPD, then this Agreement as to all such matters or, as
the case may be, as to any of the matters addressed under this Agreement, shall terminate without
further obligation ofEPD as of that moment. The certification ofEPD of the unavailability of
funds stated above shall be conc1uslve. Should funding cease or otherwise become unavailable,
this Agreement will immediately terminate. Upon effective termination of this Agreement as
provided herein, GRANTEE shall not be entitled to any further payments pursuant to this
Agreement (regardless of whether such payments may have previously been approved by EPD).
L. GOVERNING LAW
This Agreement shall be construed in accordance with the laws of the State of Georgia.
M. FORCE MA.JEURE
The parties hereto shall not be responsible for any failure or delay in the performance of any
obligations hereunder caused by acts of God, flood, fire, war or public enemy.
N. CONTL~UING OBLIGATION
In the event of GRANTEE'S failure to re-apply to EPD for on-going Local Environmental
Compliance Program funding, EPD may require the GRANTEE to return the folJowing
equipment, or the cash equivalent of its current value, based on the folJowing schedule:
1. EPD may ask that a vehicle be returned to EPD if the GRANTEE does not
remain in the grant program for a minimum of three (3) years.
2. EPD may ask that LCD projectors and surveilJance cameras be returned to EPD
if the GR.A1'-JTEE does not remain in the grant probrram for a minimum of two (2)
years.
3. EPD may ask that personal computers, laser printers and scanners be returned to
EPD if the GRANTEE does not remain in the grant program for a minimum of
one (1) year.
O. NOTICES
All notices under this Agreement shall be deemed duly given: Upon delivery, if delivered by
hand; or three days after posting, if sent by Registered or Certified Mail, Return Receipt
Requested; to a party hereto at the address set forth below or to such other address as a party may
designate by notice pursuant hereto.

P. WAIVER
The waiver by EPD of any breach of any provision contained in this Agreement shall not be
deemed to be a waiver of such provision on any subsequent breach of the same or any other
provision contained in this Agreement. No such waiver or waivers shall serve to establish a
course of performance between the parties contradictory to the terms hereof.
Q. AUTHORlTY/OPEN MEETINGS
GRANTEE warrants that it has full power and authority to enter into and perform this
Agreement, and that the person signing on behalf of GRANTEE has been properly authorized
and empowered to enter into this Agreement. GRANTEE certifies that in approving this
Agreement that it has complied with the requirements of Chapter 14 of Title 50 of the Official
Code of Georgia Annotated regarding open meetings. GRANTEE further acknowledges that it
has read this Agreement, understands it and agrees to be bound by it.
R. SEVERABILITY
If any term or provision of this Agreement shall be found to be illegal or unenforceable then,
notwithstanding, this Agreement shall remain in full force and effect and such term or provision
shall be deemed stricken herefrom.
S. HEADINGS
The paragraph headings used in this Agreement are for reference purposes only and shall not be
deemed a part of this Agreement.

T. AMENDMENTS IN WRITING
No amendment to this Agreement shall be effective unless it is in writing and signed by duly
authorized representatives of the parties.
U. ASSIGNNIENT
GRANTEE shall not assign its right to receive Reimbursed Costs, or any obligations required of
it pursuant to this Agreement without the express written consent of EPD.
V. HOLD HARtvLLESS OBLIGATIONS & INDElYINITY
(a) GRANTEE shall'hold EPD, its agents and employees, harmless from any and all claims
resulting from or arising out of the grant, including, without limitation, damage claims for injury
to persons or property. In the event a lawsuit is filed against EPD or the State of Georgia in
connection with the Agreement, GRANTEE shall, at its own expense, be obligated to and shall
have the duty to participate in the defense of the lawsuit ifEPD gives GRANTEE notice in
writing of the institution of such suit, permits GRANTEE to fully participate in the defense of
the suit, and gives GRA1'\J'TEE all available information, assistance and authority or enable
GRANTEE to do so. No settlement or compromise of any claim, loss or damage asserted against
EPD or the State shall be binding upon EPD or the State unless expressly approved in writing by
EPD and the State.
(b) GRA1'\J'TEE has submitted an application for the funds herein, and expressly acknowledges
that EPD, its agents and employees, in passing through such funds, has neither assumed nor
undertaken any legal duties to GRANTEE or others. GRANTEE agrees to make no claims or
demands against EPD, its agents or employees, for any damages that may result from or arise out
of the disbursement of the funds hereunder, even if such claims or demands are made against
GRANTEE.
W. CONFLICTS OF INTEREST
GRANTEE hereby attests that all of the officials of GRA1'ITEE have certified that they have not
violated any applicable conflict of interest law under either state law (O.C.G.A. ~~ 45-10-20
through 45-10-28 and 36-67 A-lthrough 36-67 A-4) or under any local ordinance, charter, rule, or
regulation and that they shall comply with same throughout the term of this Agreement.
X. COPYRIGHT
No report, surveys, or other documents produced in whole or in part under this Agreement shall
be the subject of any application for copyright by or on behalf of GRANTEE.
Y. DRUG-FREE WORKPLACE
GRANTEE hereby certifies that:

(1) A drug-free workplace will be provided for GRANTEE'S employees during the
performance of this Agreement; and
(2) It will secure from any subcontractor hired to work in a drug-free workplace the following
written certification: "As part of the subcontracting agreement with (Contractor's Name),
(Subcontractor's Name) certifies to the Contractor that a drug-free workplace will be provided
for the subcontractor's employees during the performance of this Agreement pursuant to
paragraph 7 of subsection B of Code Section 50-24-3."
Z. ENTIRE AGREEMENT
This Agreement constitutes the entire agreement between the parties with respect to the subject
matter; all prior agreements, representations, statements, negotiations, and undertakings are
superseded hereby.

LOCAL GOVERNMENT ENFORCEMENT
Augusta Richmond County Government is entering its fifth year of enforcing the clean
up of scrap tire piles and other solid wastes in the Augusta Richmond County area. As the
second largest local jurisdiction in the state, there are approximately 260 automotive
shops that are scrap tire generators. This grant would be utilized for maintaining salary
and wages ofthe code enforcement officer, as well as hiring an additional code
enforcement officer, operating costs, training, and the purchase of a new vehicle. We
will also purchase new equipment and software.
Georgia EPD has funded the following grants:

3rd year grant - $33,560 (On going) Augusta Richmond County contributes $8390.00

Augusta Richmond County has a population of approximately 210,000. The Augusta
Richmond County License & Inspection Department and Metro Augusta Clean &
Beautiful have continued to produce effective enforcement and education programs and
the Environmental Enforcement Officers will work in conjunction with Metro Augusta
Clean & Beautiful. The officers will help with properly educating and informing
citizens, industry and other local government departments with the importance of proper
solid waste management and the consequences of non compliance with state and local
scrap tire/solid waste ordinances.
In outlining a detailed work plan for our environmental enforcement, we have
summarized the following areas that we feel are of the greatest importance.
As the workload continues to grow for our code enforcement officer, we will need to hire
for an additional officer. Augusta-Richmond County currently has approximately 260
scrap tire generators and the number continues to escalate as new automotive businesses
move into the area. The additional code enforcement officer's duties will include
inspecting scrap tire generators, carriers, and sorters. Both code enforcement officers
will need to have to drive 4 x 4 pick up trucks, as they will share the same duties.
Although the current program is a proven success, we have set higher standards for the
year ahead to involve more community programs, more physical involvement, and better
environmental awareness to the business owners, as well as residents concerning the
crucial elements of the environmental issues of our area.
Augusta Richmond County will continue to make plans to pursue salvage yards that are
in violation of local ordinances and state laws. We plan to make cases against salvage
yards for the successful removal of scrap tires and solid waste. Also, there are plans to
hold education forums relating to environmental issues. Local Government Enforcement
Officer has held neighborhood meetings with government officials.
We will continue to conduct the following activities:
The environmental officer will take photos, count and measure scrap tire piles. The
activity will be conducted throughout the year and the environmental enforcement officer
will identify existing scrap tire sites. By identifying the illegal dumpsites, the
environmental enforcement officer will have citations written to the property O'Nner.
Scrap Tire generators, carriers, and sorters will be inspected for state identification
number, permits for using scrap tires, record keeping of manifests, the transporting of
scrap tires and storage of scrap tires. This activity will be conducted every quarter.
Augusta Richmond County is in compliance with Georgia Solid Waste Act and Rules.
Augusta Richmond County has been complying with the "Expectations of Local Code
Enforcement Officers."
Major accomplishments in 2002:
Augusta Richmond COWlty has been successful removing scrap tires, solid waste, and
cleaning up other environmental hazards. In 2002, Augusta Richmond COWlty
successfully removed approximately 2,600 scrap tires that were properly disposed. There
were a total of three hundred fifty- two complaints, twenty-six citations, eighty-nine
written warnings, one hundred twenty-six illegal dump investigations, and one hundred
eighteen generator inspections. Fifty-five solid wastes clean up have been made.
We will continue to progress each year as we establish better relationships between
government and private industry.
2003
GOALS & WORK PLAN
My main focus for the upcoming year is to foster further awareness to the current scrap
tire dealers/automotive facilities, and solid waste handlers concerning environmental
regulations, and issues. I currently issue an updated annual newsletter that includes any
changes or constant problem areas that seem to be common amongst a majority of the
scrap tire generators.
To implement a new "Yard Maintenance" program for the numerous amount of salvage
yards in Augusta-Richmond County (current generators), and continue working through
there issues. The maintenance program will better enforce the various problems such as,
scrap tires, used fluid recovery, containment, and disposal.
Augusta-Richmond County also seems to contain several Inert landfills, permitted and
non-permitted, while holding the last count of 153 total (accounted for). Although this is
a large number, most are closed and have not performed the closure procedures(s).
Therefore I have designed an amendment to the current code to revise environmental
issues such as "Inert Landfills", and other problem areas, and anticipate this in full
operation by late spring.
In closing I would like to add that I hope to maintain the network of individuals from
various governmental departments, beginning with the Health Dept., Fire Dept., Sheriffs
Dept., Marshals Dept. Local EPD, LE, Atlanta EPD, and the other ECEO's throughout
the state, and can honestly declare that the improvements that have taken place could not
have happened without these individuals ability to identify an environmental problem,
while assisting during the enforcement procedure.
This program is a success as a direct result of the dedication and focus on continuous
training by the EPD, Scrap Tire Unit.
Without this program and the documented evidence of the positive impact that has
resulted, we would only have the same escalating environmental concerns due to lack of
manpower from a starving budget. Furthermore with the growing support from local
officials and of course the entire Department of Natural Resources, the future of this
program is only going to excel!

community, through litter prevention, beautification and solid waste education.

ENVIRONMENTAL EDUCA TION
SCRAP TIRE GRANT 2003-2004
EDUCA TION/SOLID WASTE PROGRAMS - include, but are not Itinited to the
following:
1. School Education -
A) The Emily Earth Program, a curriculum school year that includes scrap tire education.
B) Make a Difference Video/educational program.
2. Earth Day Activities - Aprt122, 20.0.3
3. National Recycling Day - November 20.0.3
4. The Great American Cleanup - full month of April and part of May
5 Telephone Book Recycling Program - June-July 20.0.3
6. Rivers Alive - River Cleanup - September and October
7 The newspaper/magazine recycling program with schools and churches year round
8. PET- plastics recycling education and collection
9. Annual Christmas Tree Recycling - January 20.0.4
10. The adopt-a-highway/road program year round
11. Updating website year round
12. Respond to numerous daily calls seeking cleanups of community and dOIly solid waste
disposal options for litter.
13. Dispense disposable cardboard trash boxes for community events.
14. Provide a library of educational materials, and videos for education and general public.
15 Public Speaking - as requested
16. Community exhibits - as requested, /e. Boy Scouts, Girl Scouts, Exchange Club Fair and
Civic groups.
17 Cell Phone Recycling.
18. Ink Jet Cartridges Recycling.
19. Hold 4 Community forums on Solid Waste Management.
20. Other activities which are developed throughout the year.
21. Recruit volunteers.
Metro Augusta Clean and Beautiful, Inc. has continued to experience a tremendous of
growth over the past year- Community demand has created a need for increased hours for
both educators. Both WIll work 5 days per week, total of 35 hours. We are extremely please
with our growth.
For coordination and implementation of the above and additional programs, we feel it
necessary to have 2 part time educators.

scrap tire last report
SOUD WASTE MANAGEMENT
Solid waste collection was made mandatory for Augusta-Richmond County in
2002. The city of Augusta has contracts with local haulers to perform this
task. Implementing the mandatory collection has made a tremendous difference in
the appearance of our city. A limited recycling pick-up program is offered by the
city but Metro Augusta has a comprehensive drop off recycling locations
throughout the city for many items. This has worked well but MACB would like to
implement a regional recycling faCility and is currently writing a grant application
to GEFA to perform a feasibility study.
Future goals of our soltd waste management program are as follows:
Reduction through education - Ensure that every citizen is education as to why,
how and where to properly dispose of waste products, environmental concerns
regarding the different options, as well as the various options that is available for
recycling. The environmental enforcement office, staff and volunteers of Clean
and Beautiful are in the schools on a weekly basis with various educational
programs.
REDUCTION THROUGH COMMUNITY AND BUSINESS BASED PROGRAMS - The
adopt-a-highway program is a very popular program in our area volunteers are
very involved. Our adopt-a-stream program is also very popular. Businesses have
implemented the ink jet and cell phone recycling program for us.
REDUCTION THROUGH AVAILABILITY OF PICK-UP SITES - Clean and Beautiful
has at least 40 newspaper/magazine containers, placed throughout the county,

especially at schools and churches for community use. 1/3 of the proceeds
received from the sale of products are returned to the schools for their
environmental programs. The county government and Publix's Supermarket has
placed containers in their parking lots for convenient.
REDUCTION THROUGH SCHOOL SYSTEM BASED PRESENTATIONS - These are
presented on a regular basis with programs available for grades K -12.
BASIC ORIENTED PROGRAMS:
Compliance program - Discourage illegal dumping and littering.
Third quarter 2003 - Utilize the media to assist in educating the public on how to
properly dispose of various waste items and locations as to where the items can
be taken. Clean and Beautiful already does this in the way of a hotline, provIded
by BFI and the local newspaper, staff, community exhIbits, and a 3 page resource
booklet.
Compliance program - REDUCE HIGHWAY UTTERING
Targeted activity - First quarter 2004. PrOVIde educational opportunities to the
local haulers on how and why the loads must be secured, the penalties of not
complying. Oral presentations and printed materials will be offered.
Compliance program - Reduce burning of waste materials
Targeted activity - First quarter 2004, Utilizing all media outlets, educate the
public regarding the regulations controlling burning of household waste as well as
the penalties for non compliance.
Compliance Program - Discourage improper use of automotive waste products.
Targeted Activity - Second quarter 2004 PrOVide information to automotive
shops regarding the proper disposal of waste oil batteries and various waste
generated by their businesses.
Having the funding for a fill time environmental off/cer has allowed ARC to
become in pro-activities that would not have been accomplished. The compliance
and education by our part time educator and volunteers has been most effective
in reducing illegal dumping and littering throughout the county.

Inspecting tire dealers for compliance wit scrap tire disposal regulations has been
instrumental education of scrap tire dumps as well as reducing the number of
scrap tires stored on the premises.
Having the funding for a environmental compliance office and an environmental
educator has expanded our program into a well developed, well respected program
and we are extremely appreciative of this opportunity.

Expectations of Local Environmental Code Enforcement Officers
The Environmental Code Enforcement Officer's primary responsibilities are to:
1. Contact EPD staff within the first week of hiring to schedule an initial orientation
meeting.
2. Attend enforcement training as directed by EPD staff.
3. Keep accurate and complete support documentation of day-to-day activities, including
hours 'vvorked, cases, and inspections.
4. Inventory and assess the number of illegal dumps including scrap tire piles located
within the regulatory boundary.
a. Issue citations or notices of violation for dumpers or property owners.
b. Notify EPD of dumps that are riot cleaned up.
c. Prioritize the scrap tire piles according to potential danger to human health and
the environment.
d. Seek local and state assistance for clean up.
e. Keep records on how many tires are cleaned up and by whom.
5. Inspect all scrap tire generators at least once per year:
a. Do they have an EPD issued scrap tire generator identification number?
b. Are they using permitted scrap tire carriers?
c. .Are they maintaining copies of completed manifests? Are the manifests
completed properly?
d. Are the scrap tires being transported only to an end user or to a scrap tire
processor or disposal facility approved by EPD?
e. Is the number of scrap tires on site within the allowable storage limits?
f. Are vectors (mosquitoes, flammable vegetation, etc.) being controlled?
g. Are there any other solid waste violations?
h. Are their Scrap Tire Management Fee Reports current?
6. Inspect scrap tire sorters quarterly:
a. Do they have an EPD issued scrap tire generator identification number?
b. Do they have an EPD issued Carrier Permit (if required)')
c. After sorting the tires, are they properly re-manifesting the disposition of the scrap
tires from the sorting operation to an EPD approved end user or processor?
d. i.\re they maintaining records of tires received, sorted, and scrap tires removed?
e. Is the number of scrGp tires on site within the allowable storage limits?
f Are they in compliance with all requirements applicable to generators:
g. In lieLl of the 75% recycled, used or re-used provision, are they in compliance with
all other requirements applicable to processing facilities?
7. Inspect scrap tire carriers...
a. When a generator inspection identifies a carrier who is improperly
completing manifests or failing to return manifests to generators, or
b. 'When a problem carrier is identified by illegal dumping or a complaint.
8. Assess and address problems or complaints involving:
a. Littering
b. Open burning
c. Improper management of constmction and demolition waste
d. Yard trimmings collection and disposal
e. Other local solid waste management problems
f. Review local ordinances that address these problems and recommend
revisions where necessary.
9. The Environmental Code Enforcement Officer shall not be the local issuing
authority for erosion and sedimentation (E&S) control, but the officer may assist
in identifying violations, educating the regulated community on E&S avoidance
and writing citations.
10. Communicate and coordinate with the entity responsible for education, as well as
any local recipient of a GEF A Recycling and Waste Reduction grant, to help
ensure that effective methods are being used to convey to citizens, school
children, industry, and other local government departments the importance of
proper solid waste management and the consequences of noncompliance with
state and local solid waste ordinances.
11. Communicate and coordinate with the local DNR Wildlife Resources
Conservation Officer as well as other resource agencies such as the Georgia Soil
and Water Conservation Commission, Georgia Forestry Commission, US Fish
and Wildlife Service, Georgia Power, etc.
12. Communicate on a regular basis with EPD Scrap Tire Program staff.
13. Submit a report of the above activities and grant work tasks to EPD on a quarterly
basis on forms provided by EPD. Progress reports are due to EPD fifteen days
after the end of the quarter.
