Dear Lena:
I am enclosing herewith the recorded Release and Covenant Running with
the Land between Claudia B. Davison, et al. and Augusta, Georgia, in connection with
their residence at 2710 Ingleside Drive, Augusta, Georgia. This release is dated April
1, 1999 and has been recorded in the office of the Clerk of the Superior Court of
Richmond County, Georgia, on Reel 639, pages 1564-1567.

RELEASE AND COVENANT RUNNING WITH THE LAND
KNOW ALL MEN BY THESE PRESENTS, that the undersigned CLAUDIA
B. DAVISON, JAMES DAVISON, A1K1A JIMMY DAVISON, ATLANTIC MORTGAGE &
INVESTMENT CO., WACHOVIA BANK, N.A. and THE UNITED STATES OF AMERICA,
through its Internal Revenue Service, for the consideration of Twelve Thousand and
No/100 ($12,000.00) Dollars, in hand paid, receipt whereof is hereby acknowledged,
have remised, released, and forever discharged for themselves, their heirs, assigns and
successors in title, AUGUSTA, GEORGIA, THE AUGUSTA-RICHMOND COUNTY
COMMISSION, its successors and assigns, Commissioners, agents, employees and all
other persons, firms and attorneys of and from any and all claims, demands, rights, and
causes of action of whatsoever kind and nature, past, present and future, arising from
and by reason of any and all known and unknown, foreseen and unforeseen property
damages caused by any settling and foundation problems in and around the real
property known as 2710 Ingleside Drive, Augusta, Richmond County, Georgia 30909,
which property is described as follows:
ALL that tract or parcel of land, with improvements thereon, situate, lying
and being in the State of Georgia, County of Richmond and being known
and designated as Lot 5 and the Westernmost 25 feet of Lot 4, Block "A",
Section I of Berckmans Hills Subdivision, as shown more particularly on a
plat of said subdivision which is recorded in the office of the Clerk of the
Superior Court of Richmond County, Georgia in Realty Book 26-L, page
124, to which plat reference is hereby made for the purpose of providing
a more complete and accurate description as to the metes, bounds,

The aforesaid damages are alleged to have resulted from Jj6fk Yhn~%~:51
Richmond County and/or Augusta, Georgia, and/or The City Council of Augusta,
Georgia, in and around Rae's Creek. This release specifically includes any and all acts
and omissions by the parties released occurring on, before or since December 1, 1994,
when the undersigned entered into a certain release and indemnity agreement with
Richmond County, Georgia.
In further consideration of this release, the undersigned agree that this
release shall be a covenant running with the land to bind themselves and their
successors in title so as to forever bar any future claim against the parties released for
work done in and around Rae's Creek in the vicinity of the above described property on
or before the date hereof. This release and covenant shall be filed in the real estate

records in the office of the Clerk of the Superior Court of Richmond County, Georgia
properly indexed.
The undersigned further agree to indemnify, hold harmless and defend
Augusta, Georgia, the Augusta-Richmond County Commission, and each of its
Commissioners, officials, officers, agents, or employees from any and all loss, liability,
costs, damages, fines, penalties and forfeitures (whether in contract or tort) incurred by
Augusta, Georgia and/or any of its Commissioners, officials, officers, agents and
employees arising or alleged to have arisen, directly or indirectly, from work done in and
around Rae's Creek near the above described property. The undersigneds' obligation
under this indemnity agreement shall apply regardless of whether Augusta, Georgia or
any of its Commissioners, officials, officers, employees or agents were or are actively
or passive negligent. This indemnification shall include all costs incurred by those
indemnified in investigating and defending any claim, including without limitation,
the cost of investigation, defense, attorney's fees, witness fees, court costs and the like.
