Tax Map 70-3: Parcel 56.11
County Reference 87-056
Attached hereto is an easement on the Wheeless Road Project, for
your review and recording. Also attached is an agreement from Mr.
Carter, for the right to use the pond as a detention area and to
perform periodic maintenance, including silting.
As you know, this agreement has to be approved by the Commission
Council. Upon approval and recording, please return the original
to this office for our records.

AGREEMENT
THIS INDENTURE made this ~ day of January, 1996, by
and between Corbin C. Carter, . a resident of Richmond County,
Georgia, as party of the first part, and Richmond County, Georgia,
a political subdivision of the State of Georgia, as party of the
second part;
WIT N E SSE T H:
The party of the first part, for and in consideration of
the sum of One Dollar ($1.00) and other good and valuable
consideration, cash in hand paid, receipt whereof is hereby
acknowledged, has granted, bargained, conveyed and by these
't presence does grant, bargain, and convey unto the party of the
second part, its successors and assigns, a permanent easement in
and to the pond consisting of approximately 7.74 acres, commonly
referred to as Courtney's Pond, same being located on Tax Map 70-3,
Parcel 56.11, for the purposes of use as a detention and/or
retention pond.
The party of the first part further grants, bargains, and
conveys unto the party of the second part, its successors and
assigns, the right to perform periodic maintenance activities to

the pond and dam on said parcel of land, with the removal and
,proper disposal of silt, trash and/or debris of all types that
limit the storage capacity of the pond or restrict water movement
through said pond. The disposal of said materials shall b~ to a
location off-site of the parcel of land.

hand and caused same to be executed by its duly authorized
