AGREEMENT FOR CONSULTANT SERVICES
BETWEEN
WESTERN ECONOMIC SERVICES, LLC
AND
AUGUSTA, GEORGIA
FOR PREPARATION OF A HOUSING MARKET ANALYSIS
AND HOMELESS NEEDS ASSESSMENT FOR THE
2010 CONSOLIDATED PLAN
THIS AGREEMENT is made and entered into this 22nd day of October, 2008, by and
between Augusta, Georgia, by and through the Augusta-Richmond County Commission, as the
Implementor of the Community Development Block Grant Program (hereinafter referred to as
"Grantee") and Western Economic Services, LLC, (hereinafter referred to as "Consultant").
WITNESSETH
WHEREAS, the Grantee has entered into a contract with the U. S. Department of
Housing and Urban Development, hereinafter referred to as HUD, providing for financial aid to
the Grantee under the Housing and Community Development Act of 1974, as amended; and
WHEREAS, the City as a Grantee of federal housing and community development
funds from HUD, is required to complete a Consolidated Plan for receipt of Community
Development _Block Grant, HOME Investment Partnerships, Emergency Shelter Grant and
Housing Opportunities for Persons with AIDS funds; and
WHEREAS, the Consolidated Plan is a s-year strategic plan identifying the city's
housing and community development needs for low and moderate income persons and
neighborhoods an<;l a long-term strategy for meeting those needs; and
WHEREAS, the Grantee desire to engage the services of a consultant to research data,
conduct a needs assessment and prepare a report of the City's housing market and its housing
and homeless needs; and
WHEREAS, it is in the best interest of the Grantee to cooperate in the selection and
hiring of a consultant to investigate, research and prepare the housing market analysis and a
housing and homeless needs assessment; and
NOW, THEREFORE, in consideration of the promises, covenants and agreements
herein contained, the parties mutually agree as follows:
1. STATEMENT OF WORK. The Grantee hereby agree to utilize funds made
available under this Agreement only for the purpose of implementing the above-mentioned
activity as more fully described in Attachment A - Scope of Work which is attached hereto and
made a part hereof as if fully rewritten.
2. TERM. The Term shall begin upon execution of this Agreement by both parties
hereto, and shall be completed by March 30, 2009.

3. FUNDING AMOUNT. The Grantee agrees to fund the work associated with this
Agreement up to but not to exceed Twenty-Nine Thousand, Five Hundred Twenty Dollars and
no cents ($29,520.00), in accordance with the budget attached hereto, marked Attachment B-
Budget, and by this reference made a part hereof. In the event the Grantee determines that it
becomes necessary to amend the Budget, it may be done administratively so long as the total
amount of this Agreement is not exceeded.
4. PROHIBITION AGAINST PAYING FOR ANY SERVICE RENDERED OR
EXPENSE INCURRED PRIOR TO THE DATE OF THIS AGREEMENT. Grantee agree
that funds made available by this Agreement may only be disbursed for services rendered or
expenses incurred after the date this Agreement has been signed by both parties hereto (the
"Effective Date" of this Agreement). No funds shall be expended for any service rendered or
expense incurred prior to such date.
5. INDEPENDENT CONTRACTOR Grantee agrees that any Consultant hired
pursuant to this Agreement shall perform all work and services described herein as an
independent contractor and not as an officer, agent, or employee of the Grantee. The
Consultant shall have exclusive control of and the exclusive right to control the details of the
services and work performed and of all persons performing the same and shall be solely
responsible for the acts and omissions of its officers, agent, employees, contractors and
subcontractors, if any. Nothing shall be construed as creating a partnership or joint venture
between Grantee and Consultant. No person performing any of the work or services described
in Attachment A, Scope of Work, shall be considered an officer, agent, or employee of the
Grcmtee, nor shall any such person be entitled to any benefits available or granted to employees
of the Grantee.
6. SUBCONTRACTS, SUCCESSORS AND ASSIGNS. Grantee agrees that any
Consultant hired pursuant to this Agreement, may not.subcontract, assign or transfer any of the
work or services described in Attachment A, Scope of Work, without the prior written approval
of the Grantee. Any work or services subcontracted, assigned or transferred shall be specified by
written contract or agreement.
7. OWNERSHIP OF PROPERTY. Grantee agrees that at the expiration or in the
event of any termination of this Agreement that any Memoranda, Maps, Drawings, Working
Papers, Reports and other similar documents produced in connection with this Agreement shall
become the property of the Grantee.
8. LAW TO GOVERN. This Agreement is entered into and is to be performed in
the State of Georgia. The law of the State of Georgia shall govern the rights, obligations, duties
and liabilities of the parties to this Agreement and shall govern the interpretation of this
Agreement.
9. WAIVER This Agreement shall be construed in a manner that a waiver of any
breach of any provision of this Agreement shall not constitute or operate as a waiver of any other
breach of such provision or of any provisions, nor shall any failure to enforce any provision
hereof operate as a waiver of such provision or of any other provision.
10. AMENDMENT. This Agreement may be modified or amended only by a written
agreement duly executed by the parties hereto or their representatives.

11. ENTIRETY. This Agreement and the attachments attached hereto contain the
entire Agreement between the parties as to the matters contained herein. Any oral
representations or modifications concerning this Agreement shall be of no force and effect.
12. SEVERABILITY. This Agreement shall be severable, if any part or parts of this
Agreement shall for any reason be held invalid or unenforceable by a court of competent
jurisdiction, all remaining parts shall remain binding and in full force and effect.
13. NOTICES. All notices or other communications required by this Agreement
shall be personally served or sent by U. S. mail addressed to the party as follows:

Attachment A - Scope of Work
The Consultant will be responsible for carrying out the tasks listed below for preparation of the
housing market analysis and the housing and homeless needs assessment:
I. TASKS - Consultant
. Phase I - Orientation Meeting
Purpose of meeting is to meet with Grantee staff to discuss the roles and responsibilities
of the parties, the work schedule and the deliverables.
. Phase II - Data Collection and Analysis
1. Extract pertinent economic, demographic, and housing data from the 2000
Census. The data will be segmented by block group or census tract.
2. Offer perspective on trends seen in these key data elements:
a. Population
b. Households and average household size, by tenure
c. Household and family income, by income range
d. Percent of income spent on housing, including cost burdens, by tenure
e. Median rents and home values
f. Rental and homeowner vacancy rates
g. Total number of housing units, by type of dwelling
h. Units with incomplete plumbing or kitchen facilities
i. Degree of overcrowding and severe overcrowding in the units
3. Extract pertinent economic, demographic, racial composition, ethnicity, and age
cohort data from the 2000 Census. Some of this data will be used to create the
city's priority needs tables 1A and 2A, prescribed by HUD. Key data elements
are:
a. Number of households, by size
b. Number of households having less than 30 percent Median Family Income
(MFI), 31 to 50 percent MFI, 51 to 80 percent MFI, 81 to 95 percent MFI, and all
above 95 percent MFI. This data will be adjusted for family size. Data will be
available for all of the county and municipality geographic areas addressed in the
plan. This data will be further broken down by owner and renter households, and
then by elderly, small and large renter households, to satisfy CHAS Table 2A.
c. Number of people, by race and ethnicity
d. Racial and low-income concentrations
e. Age cohorts of the population, with particular attention paid to the elderly and
frail elderly
f. Number of disabled people
i. Three age groups (5 to 15, 16 to 65, and over 65)
ii. Types of disabilities .
g. Number of institutionalized people in group and non-group quarters. The census
estimates of individuals in emergency and transitional shelters (if available - or
over 100) will be compared to the data from the periodic homeless counts
appearing in the continuum of care.
h. Number of households experiencing housing cost burdens for the year 2000 will
be drawn from the number of households spending from 30 to 50 percent of their

income on housing, with severe cost burdens for those spending more than 50
percent of their income on housing.
1. Identify the median value of homeowner units and average rents on two
geographic maps, which will be incorporated into the main document.
4. Prepare five geographic maps that focus on block groups:
a. Minority racial concentrations
b. Hispanic ethnicity concentrations
c. Low-income concentrations
d. Median gross rent
e. Median home value
S. Begin analysis of the lead-based paint hazards, quantifying the prospective risks of
rental and homeowner units within Augusta. This information will be augmented
with data received from pertinent city agencies that perform or oversee blood lead
test levels, particularly in children.
6. Evaluate all returned surveys and process the data.
7. Analyze the building permit data over the 1980 through 2007 period as it relates to
single-family, duplexes, tri- and four-plex buildings and multifamily structures with
five or more units. Value of single-family new construction will be developed over
this same time period as well.
8. Evaluate the demolitions data received from the City.
9. Collect available labor force, employment, and unemployment statistics at the county
level from data that will span at least the 1990 through 2007 time period.
10. Collect Bureau of Economic Analysis information describing full and part-time
employment in the county from 1969 through 2006.
a. This information will also include real average earnings per job, per capita
income, dividends, interest, rental income, and total personal income.
TASKS - City of Augusta
Provide the following to Consultant:
1. Continuum of Care Application with gap analysis.
2. Any City mental health plans or related elderly and disabilities plans with contact
person's names.
3. Current Augusta Housing Authority inventory to include location of units, acquisition or
new construction, development sources and tenant type.
4. Data pertaining to public housing and Section 8 tenant-based waiting lists and
household attributes to include family type, race, ethnicity and unit size.
S. Residential demolitions that have occurred within the City from 2000 through present.
6. Contact information for City agency that performs blood-lead level testing in children.
. Phase III - Present Preliminary quantitative and qualitative findings from
data collection and analysis.
1. Complete resident survey process and analyze surveys.
2. Develop summary of preliminary findings from surveys.
