ROBERTS (hereinafter referred to as "OWNER") on February 24, 2006 gave to BANK an Open-End Deed to Secure Debt to the property described on Exhibit A, to secure a certain indebtedness to BANK and said Open-End Deed to Secure Debt is recorded in the Office of the Clerk of the Superior Court of Richmond County, Georgia, in Realty Reel 1043, page 1677. WHEREAS, OWNER has granted an Easement dated ,:)i,J ilL 3D J..IJ/J'l to AUGUSTA across the property described on Exhibit A, the original of which is to be recorded in the Office of the Clerk of the Superior Court of Richmond County, Georgia; and WHEREAS, BANK is willing to subordinate the lien of said Open-End Deed to Secure Debt dated February 24, 2006 and recorded in Realty Reel 1043, page 1677, to any interest that AUGUSTA may have in the above referenced easement. NOW, THEREFORE, in consideration of the premises and the mutual covenants and promises hereinafter contained and the duties to be undertaken, BANK does hereby agree and declare that the lien of the Open-End Deed to Secure Debt from OWNER to BANK, dated February 24, 2006, and recorded in the Office of the Clerk of the Superior Court of Richmond County, Georgia in Realty Reel 1043, page 1677, is and , . Book 01183: 1793 Augusta-Richmond County 200803160907/09/2008 14:18:29.01 Exhibit A All that lot or parcel of land, with improvements thereon, situate, lying and being in the State of Georgia, County of Richmond, being known and designated as Lot 4, Block C, of Section Two, Pinnacle Place Subdivision, as is more particularly shown on a plat thereof recorded in the Office of the Clerk of the Superior Court of Richmond County, Georgia, in Reel 206, at pages 1295-1300; reference is hereby made to said plat for a more complete and accurate description as to metes, bounds, and location of said property. This property is conveyed subject to restrictions of record in said Clerk's Office in Reel 208, at page 1116, and to any easements of record.
