THIS AGREEMENT, made and entered into this 2'1 day of 'f ~1 ,2009, by and between AUGUSTA, GEORGIA, a political subdivision of the State of Georgia (hereinafter referred to as "AUGUSTA"), and THOMAS W. HITT AND RUTH HITT, (hereinafter referred to as "THOMAS W. HITT AND RUTH HITT"); WITNESSETH: WHEREAS, TROY D. HUNT (hereinafter referred to as "OWNER") on March 1, 1993 gave to THOMAS W. HITT AND RUTH HITT a Security Deed to the property described on Exhibit A, to secure a certain indebtedness to BANK and said Security Deed is recorded in the Office of the Clerk of the Superior Court of Richmond County, Georgia, in Realty Reel 413, page 494. WHEREAS, OWNER has granted an Easement dated .JC-L,. .. ~~ V1 l,K:)oJ' to AUGUSTA across the property described on Exhibit A, the origin of which is to be recorded in the Office of the Clerk of the Superior Court of Richmond County, Georgia; and WHEREAS, THOMAS W. HITT AND RUTH HITT are willing to subordinate the lien of their said Security Deed dated March 1, 1993 to any interest that AUGUSTA may have in the above referenced easement. NOW, THEREFORE, in consideration of the premises and the mutual covenants and promises hereinafter contained and the duties to be undertaken, THOMAS W. HITT AND RUTH HITT do hereby agree and declare that the lien of the Security Deed from OWNER to THOMAS W. HITT AND RUTH HITT, dated March 1,1993, -, . . Book 01161 :1657 Augusta - Richmond County 2008004042 01/28/2008 15:46:26.01 and recorded in the Office of the Clerk of the Superior Court of Richmond County, Georgia in Realty Reel 413, page 494, is and forever shall be subject, subordinate and inferior in lien right and dignity at all times to the easement from OWNER to AUGUSTA which is to be recorded in the aforesaid Clerk's Office. WHEREFORE, THOMAS W. HITT AND RUTH HITT has caused this instrument to be executed, all on the date above first written. THOMAS W. Reference is hereby made to said plat for a more complete and accurate description ofthe metes, bounds and location of said property. This property is conveyed subject to Protective Covenants applicable to said subdivision which are filed for record in the aforesaid Clerk's Office in Realty Book 18-C at page 394.
