HomeMy WebLinkAboutSpecial County Sales And Use Tax Augusta Richmond GA DOCUMENTNAMESpeC/aJ UilAYSlIes d/ld /!s(/d;C DOCUMENTTYPE As reC!J7eJL-I YEAR: !l ()O 0 BOX NUMBER: I D FILE NUMBER: JJjf9t/ ;( NUMBER OF PAGES: STATE OF GEORGIA ) SPECIAL COUNTY SALES AND COUNTY OF RICHMOND ) USE TAX AGREEMENT TIDS AGREEMENT, made and entered intn this ".v./lff!r Angnst ,2000, between AUGUSTA, GEORGIA, a political subdivision ofthe State of Georgia, hereinafter referred to as "County" and THE CITY OF BLYTHE, a municipal corporation under the laws of the State of Georgia, hereinafter referred to as "Blythe"; WITNESSETH: WHEREAS, the County and Blythe contemplate the passage of a Special County 1 % Sales and Use Tax for five years effective January 1, 2001, pursuant to the provisions of Title 48, Chapter 8, Article 3 of the Code of Georgia; and WHEREAS, the County and Blythe desire to work together on certain capital outlay projects for the improvement and enbancement of the County and Blythe utilizing the proceeds of said tax. NOW, THEREFORE, for and in consideration oftbe premises and the mutual covenants herein contained, tbe benefits and detriments flowing to and from each of the parties hereto, tbe parties agree as follows: (1) The County agrees to allocate to Blythe monthly, as received by the County, 0.1706 percent ofthe said Special County 1% Sales and Use Tax to be used by Blythe for tbe construction of tbe projects set forth on "Exhibit A" attached hereto and incorporated herein by reference, and Blythe agrees to use such funds solely and exclusively for such purpose and within the maximum cost limitationj'as set forth on said ~~Exhibit A"; the manner, order and extent to wbich sucb projects are to be commenced and completed to be within the discretion of Blythe. 1 (2) Blythe w~rrants.and represents that the estimated maximum costs of the projects as set forth in "Exhibit A" are accurate in the best judgment of Blythe. Blythe shall not use any portion of Blythe distributions to payoff and general obligation debt of Blythe. Blythe shall keep the distributions in a separate account from other funds of Blythe and shall not commingle the Blythe distributions with other funds of Blythe prior to their expenditure. Blythe shall maintain a record of each and every Blythe project for which the proceeds of the Tax are used. A schedule shall be included in each annual audit of Blythe which shows the amount of estimated costs for each Blythe project, amounts expended on each Blythe project in prior years, amount expended on each Blythe project in the current year and the estimated percentage of completion of each Blythe project. The auditor shall verify and test expenditures of each Blythe project sufficient to express an opinion thereon in accordance with generally accepted government auditing standards. (3) The County's financial obligation to fund the construction of said projects shall not extend past the said amount of 0.1706 percent as set forth in paragraph numbered 1 above, and Blythe's obligation to construct such projects is limited to only that construction which can be performed with the funds paid to Blythe by County pursuant to this agreement. (4) The parties acknowledge that imposition of the Tax is subject to approval by the qualified voters of Richmond County in a referendum which will be called for September 19, 2000. The provisions of this Agreement are conditioned upon and subject to the approval of the imposition of the tax in this referendum. In the event that the imposition of th~ tax is not approved, all obligations of the parties under this Agreement shall thereafter be null and void and of no further force and effecJ and no party hereunder shall have any liability to any other party hereunder for any matter contained herein. 2 (5) Each of t~e part.ies hereto warrants and represents to the other that it will comply with all of the requirements of the laws of the State of Georgia, the resolution providing the extension of said tax and providing for a referendum thereon and the provisions of this Agreement and take such other actions as may be necessary to insure that the validity of the collection of the Tax shall be maintained throughout the period that the Tax is to be imposed. (6) This Agreement constitutes the entire agreement between the parties as to the matters described herein and may not be amended except by an instrument in writing signed by the duly authorized officers of each of the parties hereto. Replace water line along Smith Road and U.S. Highway No.1 $51,000.00 2. Improve water delivery system to eliminate dead end lines and complete water system loop $60,000.00 3. Construct water well, well house, install pumping station equipment, and connect to water system $60,000.00 4. Renovate and improve existing building to which City offices will be located $72,958.00 TIER TWO PROJECTS: Maximum Cost 1. Renovate and improve library $60,000.00 2. Renovate and improve Blythe Community Center $40,000.00
