ENCROACHMENT PERMIT AGREEMENT
WHEREAS, a survey was made by H. Lawson Graham & Associates, Inc., H. Lawson
Graham, R.L.S., dated October 14, 2005 REV., which is recorded in the Office of the Clerk of
the Superior Court of Richmond County, Georgia, in Plat Book 4, page 22, depicting LOT 2
(0.07 Ac.)(Richmond County Tax Map and Parcel Number 035-4-455-02-0)(currently owned by
SMOKEY WATER PROPERTIES, LLC) and LOT 1 (0.04 Ac.)(Richmond County Tax Map
and Parcel Number 035-4-455-01-0)(currently owned by William O. Key, Jr.) with
improvements; and,
WHEREAS, said survey discloses improvement encroachments into the right of way of
Starnes Street from both lots; and,
WHEREAS, it is obvious that said encroachments as depicted upon the above referenced
plat have been in place for a considerable period of time; and,
WHEREAS, it would impose a considerable financial hardship on the present and future
property owners of said properties for the grantor herein to require removal of the encroachments
from the city right of way; and,
WHEREAS, the ownerS of said property have agreed for themselves and their successor
and assigns by accepting delivery and the recording of this instrument that if at any time in the
future the encroaching improvements are 'destroyed, tom down or otherwise removed from the
city right of way that they will not be rebuilt into said right of way.
NOW THEREFORE, for and in Consideration of the premises, and of ONE (51.00)
Dollar in hand paid at and before the sealing and delivery of these presents, the receipt whereof
is hereby acknowledged, AUGUSTA, GEORGIA, a political subdivision of the State of

Georgia, as party of the first part, hereinafter called Grantor, has granted, bargained, sold,
aliened, conveyed and confirmed, and by these presents does grant, bargain, sell, alien, convey
and confirm unto SMOKEY WATER PROPERTIES, LLC, a limited liability company
organized and existing under the laws of the State of Georgia, and WILLIAM O. KEY, JR., as
their interest might appear, as party or parties of the second part, hereinafter called Grantee(s)
(the words "Grantor" and "Grantee(s)" to include hislher/their/its respective heirs, successors and
assigns where the context requires or permits) a limited pennit as described above to encroach
into the city right of way of Starnes Street with the improvements as shown on the above
referenced plat.
The grantor further agrees in consideration of grantees covenants herein against
rebuilding not to require the removal of said encroachments from its right of way and to exercise
caution not to cause harm to said improvements when necessarily working within the vicinity of
said encroachments.
