" ,.. ~ State of Georgia County of Richmond This agreement is made and entered into this -1sL day of January .2001 by and between the Richmond County Board of Health/Smoke Detector Program (hereinafter referred "Board") and the Augusta-Richmond County Fire Department (hereinafter referred "Fire Department"). In consideration of the premise and legal consideration stated in this agreement the Board and the Fire Department hereby agree as follows: I. Fire Department agrees: A The Fire Department will monitor and coordinate all program related activities in high hazard areas. B. At least twenty (20) firefighters in high hazard areas will receive training on how to use program data collection forms, conduct fire safety education and follow home visit procedures. C. Home visits will be conducted as follows: 1. 2001 home visits or 1300 smoke detector installations completed by June 30, 2001. 2. Distribute one "10 Tips for Fire Safety" brochure to participating residents. D. Inspect all existing smoke detectors and/or install new lithium battery detector in home of participating residents. E. Provide documentation of home visits and smoke detector installations. II. Board agrees: A Pay Fire Department lump sum amount of $6,996 for coordinator, monitorship, and completion of the smoke detector program. B. Provide necessary materials for smoke detector installation/inspection. C. Pay Fire Department lump sum amount of $8,004 for completion of2001 home visits or the installation of 1300 smoke detectors, whichever should be first completed. D. Provide necessary report formats which are in accordance with the Georgia Division of Public Health requirements. . . III. Both parties agree: A. Neither the Board nor the Fire Department shall discriminate against any person on basis of race, sex, age, religion or national origin. B. This contract will be begin January 1,2001 And end June 3D, 2001 . C. This contract may be terminated by either party upon written notification of such intent due to default or for cause. State of Georgia County of Richmond This agreement is made and entered into between the Richmond County Board ofHealth.,Smoke Detector Program~referred to as "Board" and Augusta-Richmond County Fire Department hereinafter referred to as "Contractor". Whereas the Board desires to obtain the services of a Community Assessment and Education T earn for Richmond County operating under the auspices of the Richmond County Board of Health, and Now, therefore, in consideration of the promises and mutual covenants herein contained, the parties agree as follows: ARTICLE I: SERVICES TO BE PERFORMED BY THE CONTRACTOR During the term of this agreement the Contractor agrees to provide Community Assessment and Education Team duties as described in the attached Scope of Services, which Scope of Services is hereby incorporated herein and made a part of this agreement. ARTICLE II: CONTRACTOR AND BOARD JOINTLY AGREE A. B. c. D~ The Board will reimburse the Contractor four hundred fifty dollars ($450.00) to include all travel expenses at the completion of the scope of services. The Contractor agrees to provide the Board with a completed Bill for Services Rendered (Form 5357 Rev. 11/90) by the fifth (5th) day ofthe first month offollowing quarter following services rendered. The Board agrees to pay Contractor on or about the tenth (10th) day of the first month of the following quarter following notification of services rendered. This contract is not to exceed four hundred fifty dollars ($450.00). That during the term of this contract, the Contractor is not an employee or agent of the Board, but is an independent contractor who exercises professional judgement and is not subject to the director of control of the Board. With mutual agreement, this agreement may be renewed or extended at the expiration of the aforementioned term on a year-to-year basis. Said renewal or extension shall be upon the same rate and conditions as herein set forth. ARTICLE ill: AL TERA TIONS OR MODIFICATION No modification or alteration of this agreement will be valid or effective unless such modification is made in writing and signed by both parties and affixed to this agreement as an amendment. ARTICLE IV: TERMS OF CONTRACT This contract is effective January 1, 2001 and will terminate February 28,2001 unless terminated earlier under other provision of this contract. ARTICLE V: CANCELLATION OF CONTRACT This contract may be canceled by either party by giving to the other party at least thirty (30) days written notice by certified mail of its intentions. If termination is effective under this article, payment by the Board to the Contractor will be based on the percentage of completion of required services by the Contractor. The signers of this agreement certiry that the provisions ofOCGA 45-10-20 through 45-10-24, as amended, which prohibits and regulates certain transactions between certain state officials, employees and the State of Georgia, have not been violated and will not be violated in any respect. The Contractor will inspect 90 homes from the attached list to determine if smoke detector is operational and present. If battery is not operational or present, it will be replaced. If smoke detector is not operational or present, it will be replaced. The contractee will be responsible for supplying the Contractor with replacement batteries and detectors. 2. The Contractor will complete the enclosed list of homes with the necessary information to indicate if the home was inspected, whether the battery and detector was present, whether the battery and detector was operational AND whether the battery or detector was replaced. This list will be turned in to the Contractee at the completion of the scope of servIces. 3. The Contractor will submit a Bill for Services Rendered (Form 5357 Rev. 11/90) at the completion ofthe scope of services.
