EASEMENT DEED
'ROJECT: 80500 -Spirit Creek Force Main & Gravity Sewer
'ARCEL IDENTIFICATION NUMBER: 234-0-004-00-0 ADDRESS: 4405 Old Savannah Road
(n/k/a Mike Padgett Hwy.)
THIS INDENTURE made and entered into thi~ day Of ~AI_J~_ 2005, between Simmons
lanagement, L.P. and Wyman B. Simmons, hereinafter referre~R, and Augusta,
,eorgia, a political subdivision under the laws of Georgia, hereinafter referred to as AUGUSTA;
WITNESSETH, that Owner, for and in consideration of the sum of ONE DOLLAR ($1.00) in hand
nd truly paid by Augusta at and before the sealing and delivery of these presents, and other valuable
onsideration, the receipt whereof is hereby acknowledged, has granted, bargained, sold, conveyed and
onfirmed, and by these presents does grant, bargain, sell, convey and confirm unto Augusta, its
uccessors and assigns, an easement in perpetuity under, across and through the hereinafter described
arcel of land.
Said easement consists of 6,043 Square Feet, more or less, as shown on a plat prepared by
:ranston, Robertson & Whitehurst, P.C., dated December 21,2004, attached hereto and made a part
ereof, to which reference is made for a more accurate and complete description of the metes, bounds
nd courses, and being for the purpose of laying, relaying, replacing, installing, extending, operating,
~pairing and maintaining pipelines transporting and carrying utility services, and all other purposes that
lay be necessary for this project as well as future projects.
Owner does also grant unto Augusta a temporary easement consisting of 4,112 Square Feet,
lOre or less, as shown on said plat. Said easement is granted together with the right to dig such trenches
I said parcel of land as may be necessary for the Project, to pile thereon the material excavated, and to
aul pipe, supplies and equipment connected with the construction and maintenance thereof, over, along
nd across the said parcel of land. Said temporary easement shall expire at the completion and final
cceptance of the Project by Augusta.
Owner does also grant, bargain, sell and convey unto Augusta, its successors and assigns, the
ght, but not the duty to clear, and keep clear, all trees, undergrowth and other obstructions from said
ermanent easement, along with the free right of ingress and egress to and from said permanent
asement for this purpose and all other purposes stated in this document.
Owner does agree that no other utilities may be constructed within the aforesaid easement in
erpetuity except by written permission of the Augusta Utilities Department.
Owner, his successors, heirs, assigns and legal representatives, after the completion of this
'roject, shall have the right to use said parcel of land in any manner not inconsistent or interfering with

rights herein granted, excludinq, however, the right to plant thereon any trees or other vegetation that
y interfere with the laying, relaying, replacing, installing, extending, operating, repairing and
intaining of pipelines transporting and carrying utility services and also excludinq the right to erect,
Istruct or maintain thereon any buildings, structures, or other permanent improvements.
TO HAVE AND TO HOLD the aforesaid rights, ways, easements, privileges and appurtenances
o Augusta, its successors and assigns, in perpetuity.
And Owner, his successors, heirs, assigns and legal representatives shall and will forever warrant
I defend unto Augusta, its successors and assigns, the rights, ways, easements privileges and
lurtenances conveyed herein, against the claim of any person or persons whomsoever.
