We will periodically review Augusta, Georgia's progress pertaining to the terms of the Agreement, and will be available for technical assistance as needed. EPD will provide one on one and group environmental compliance training periodically during the year. To request one on one technical assistance please contact Lon RevaH, our Scrap Tire Management Program Manager, at (404) 362-4500. Our office will inform you of group training offered during the year. Also attached are the Scrap Tire Enforcement and Education Quarterly Report forms, which are to be submitted every three months to summarize activities of the quarter. To request reimbursement, pay special attention to the terms of the Agreement, and submit your request with all support documentation to Janet Hardin at the above address. AGREEMENT This Agreement made and entered into this 3f.D day of .:h.tL-!v, ,2001, by and between the Georgia Department of Natural Resources, Environm tal Protection DIvIsIon (hereinafter, "EPD"), and Augusta, Georgia (hereinafter, "GRANTEE") I. RECITALS WHEREAS, the State of Georgia is interested in the promotion of the health and welfare of its citizens; and WHEREAS, cooperative efforts of the state and local governments are beneficial to the citizens of Georgia; WHEREAS, Section 12-8-37,1. of O.c.G.A. provides that EPD may grant and administer funds for the purpose specified therein; and WHEREAS, certain funds were appropriated by the General Assembly for the purposes set forth herein; and ' WHEREAS, GRANTEE warrants that it has the authority to expend monies for the purposes set forth herein; and WHEREAS, GRANTEE, in a duly held meeting, adopted a resolution, which is attached hereto and incorporated by reference, approving this Agreement and authorizing the acceptance hereof: NOW, THEREFORE, in consideration of the mutual promises and other good and valuable consideration set forth below (the receipt and sufficiency of which is acknowledged by the respective parties), the parties hereby agree as follows: II. TERMS AND CONDITIONS A.TERM The initial term of this Agreement shall commence July 1, 2001, upon execution by all parties hereto, and shall thereafter continue for a period of one (1) year. This Agreement may be renewed for one (1) additional year upon written mutual consent of the parties. Each respective renewal shall be upon the same terms and conditions, and shall be effected at least thirty (30) days prior to expiration of the initial or then current term of this Agreement. - I - 1 ,. .. B. SCOPE Subject to the terms and conditions hereinafter set out, EPD hereby agrees to reimburse GRANTEE $56,104.00 over the course of this Agreement plus any additional amounts amended into the awarded budget by mutual agreement. EPD agrees to reimburse GRANTEE for those sums hereinafter expended for the purposes and uses set forth and described in GRANTEE'S application attached hereto as Exhibit "A" and incorporated herein and made a part hereof. Grantee must also comply with the "Expectations of Local Code Enforcement Officers" attached hereto as Exhibit "B", and with the "Expectations of Local Education Programs" attached hereto as Exhibit "C". All exhibits are incorporated herein and made a part hereof (hereinafter, the items in Exhibit" A" , Exhibit "B", and Exhibit "C" will be referred to as "Allowable Purposes"). C. PAYMENT (1) A request for reimbursement of expenditures for Allowable Purposes (hereinafter, "Request for Reimbursement") shall be submitted to EPD on forms designated by EPD. Requests for Reimbursement may be submitted as and when respective tasks are completed in connection with the Allowable Purposes by GRANTEE provided, however, no more than a total of one (1) Request for Reimbursement shall be submitted by GRANTEE to EPD within any given ninety (90) day period. The request for Reimbursement shall be submitted to the following person at EPD: Janet Hardin, Environmental Project Administrator, 4244 International Parkway, Suite 104, Atlanta, Ga. 30354. (2) Before a Request for Reimbursement will be considered by EPD, the respective tasks for which reimbursement is sought must first have been completed by GRANTEE and a quarterly report (see paragraph H) documenting such must first have be.en submitted by GRANTEE. Equipment expenses may not be reimbursed, at the option of EPD, until a minimum of ninety (90) days of progress on work plan activities has been documented. (3) Upon receipt of all required documentation, EPD will conduct its review of the Quarterly Report and the Request for Reimbursement, and, thereafter, provide written notification to GRANTEE as to which portion cjf the requested funds will be reimbursed to GRANTEE (hereinafter, "Reimbursed Costs"). Except as may otherwise be provided herein, payment of the Reimbursed Costs shall be made within thirty (30) days of EPD' s written notification to GRANTEE of its approval thereof. In no event shall GRANTEE be entitled to receive more than a total of the awarded budget pursuantto this Agreement. '-: . . .'" ..<,,[ Reimbursement Request Form Instructions I. Please submit reimbursement requests quarterly, with a quarterly report of activities and accomplishments. Reimbursement requests will be accepted any time within the months of October, January, April and July. Any requests received during another month may be held until the next quarter. 2. Make sure the items fit within your approved budget. The items should also coincide with the activities explained in the quarterly report. 3. Receipts must be included for all items purchased. If you are requesting reimbursement of personnel expenses, copies of the City/County ledger, or any other official documentation is acceptable. 4. Receipts must be organized within the major budget categories as they appear on the reimbursement request form. For example, all receipts for "supplies" should be separated 'with a staple or pC\perclip and labeled "supplies." If the receipts include purchases for which you are not requesting reimbursement, highlight or circle the charges that you would like reimbursed. Please total all receipts within a budget category and write this amount under "reimbursement requested," 5. If an item's application to your Local Environmental Compliance Program is not obvious, please write an explanation of how you used the item at the bottom of the receipt. 6. If you are requesting reimbursement for printed materials, please include examples, such as copies of brochures or drawings of an advertisement design. 7. Exhibit C Expectations of Local Education Programs The educational component funded by this grant is required to: I. Promote tire recycling and reuse. \. 2. Promote citizen involvement in tire abatement programs. 3. Educate tire dealers in the requirements of the Scrap Tire Management Program. 4. Coordinate a comprehensive environmental education program including the promotion of solid waste management, waste reduction and recycling. 5. Communicate and coordinate efforts with the entity responsible for enforcement, as well as any local recipients of the GEFA Recycling and Waste Reduction grants, to help ensure that effective methods are being used to convey to citizens, school children, industry, and other local government departments the importance of proper solid waste management and the consequences of noncompliance with state and local environmental ordinances. 6. Communicate and coordinate efforts with other local natural resource managers. 7. Submit a report of activities to EPD on a quarterly basis on forms provided by EPD. RIGHT TO INSPECT WORK EPD, the State Auditor of Georgia, or their authorized representatives shall, during normal business hours, have the right to enter into the premises of GRANTEE and/or all subcontractors, or such other places where the work for which the Reimbursed Costs have been provided, for the purpose of inspecting, monitoring, or otherwise evaluating such work. H. PERIODIC REPORTS At least once every three (3) months throughout the course of this Agreement (inclusive of the in'itial term and all renewal periods)~ GRANTEE shall submit a written report to EPD. The written report shall include any information with respect to the Reimbursed Costs and activities related to the Allowable Purposes under the Agreement. Said report shall be submitted to EPD in a format designated by EPD and is due fifteen days after t~e end of the quarter. I. RELATIONSHIP OF THE PARTIES Neither GRANTEE rior any of its respective agents, servants, employees or subcontractors shall become or be deemed to become an agent, servant or employee of EPD as a result of this Agreement. Provided further, this Agreement shall not be construed so as to create a partnership or joint venture between GRANTEE and EPD. J. TRADING WITH STATE EMPLOYEES The parties certify that this Agreement does not and will not violate the provisions of O.c.G.A. g 45-10-20 et seq, in any respect. K. TERMINATION This Agreement may be terminated by EPD for any or all of the following reasons: for any default by GRANTEE; for the convenience of EPD; and in the event sufficient funds no longer exist for the payment of EPD's obligations hereunder. Each of these is described in the following paragraphs. (1) Termination for Default The failure of GRANTEE to comply with any term, condition, or provision of this' Agreement shall, at the option of EPD, constitute a default by GRANTEE, Lack of progress in completing the activities described in Exhibits A, Band C during the first 120 days, or any time thereafter, . shall also, at the option of EPD, constitute a default by GRANTEE. In the event of default, EPD shall notify GRANTEE in writing by hand-delivery or by certified or registered mail, return receipt requested, of the specific act or omission of GRANTEE which constitutes default. GRANTEE shall have fifteen (15) days from the date of receipt of such notification to cure such default.; provided, however, if, in the sole discretion of EPD, GRANTEE'S default poses an . , - 4 - 1 . imminent danger to the safety and health of the general public, EPD may require in the written notification that GRANTEE cure the default within a time period less than fifteen (15) days. In the event of default, and during the above specified grace period, performance under the Agreement shall continue as though the default had never occurred. In the event the default is not cured in fifteen (15) days (or within such other time period as required by EPD in th~ written notification of default to GRANTEE), EPD may, at its sole option, terminate this Agreement for default. Such termination shall be accomplished by written notice of termination forwarded to GRANTEE by certified or registered mail and shall be effective at the close of business on the date specified in the notice. Upon effective termination of this Agreement as provided herein, GRANTEE shall not be entitled to any further payments pursuant to this Agreement (regardless of whether such payments may have previously been approved by EPD), and shall immediately return to EPD all Reimbursed Costs (or, in the case of a default due to use of the Reimbursed Costs for non-Allowable Purposes as described in Paragraph D above, such portion of the Reimbursed Costs as was used for the non-Allowable purposes) previously paid to GRANTEE, The remedies provided EPD herein shall be in addition to and not in lieu of any other remedies that EPD may have by reason of GRANTEE'S breach of this Agreement. (2) Termination for Convenience EPD may terminate this Agreement in whole or in part whenever, for any reason, EPD shall determine that such termination is in the best interest of the State of Georgia. In the event that EPD elects to terminate the Agreement pursuant to this provision, it shall so notify GRANTEE by certified or registered mail, return receipt requested. The termination shall be effective as of the date specified in the notice. Upon effective termination of this Agreement as provided herein, GRANTEE shall not be entitled to any further payments pursuant to this Agreement (regardless of whether such payments may have previously been approved by EPD) (3) Termination for Unavailability of Funds Notwithstanding any other provision of this Agreement, the parties hereto agree that the charges hereunder are payable by EPD from the Solid Waste Trust Fund. In the event that the source of payment for the total obligation no longer exists or is insufficient with respect to the matters addressed herein, in the sole discretion of EPD and of the State, then this Agreement as to all such matters or, as the case may be, as to any of the matters addressed under this Agreement, shall terminate without further obligation of EPD and the State as of that moment. The certification of EPD and the State of the events stated above shall be conclusive. Should funding cease or otherwise become unavailable, this Agreement will immediately become null and void. ASSIGNMENT GRANTEE shall not assign its right to receive Reimbursed Costs, or any obligations required of it pursuant to this Agreement without the express written consent of EPD. U. HOLD HARMLESS OBLIGATIONS (a) GRANTEE shall hold EPD, its agents and employees, harmless from any and all claims resulting from or arising out of the grant, including, without limitation, damage claims for injury to persons or property. In the event a lawsuit is filed against EPD for the State of Georgia in connection with the Agreement, GRANTEE shall, at its own expense, be entitled to and shall have the duty to participate in the defense of the lawsuit if EPD gives GRANTEE immediate notice in writing of the institution of such suit, permits GRANTEE to fully participate in the defense of the suit, and gives GRANTEE all available information, assistance and authority or enable GRANTEE to do so. No settlement or compromise of any claim, loss or damage asserted against EPD or the St~te shall be binding upon EPD or the State unless expressly approved in writing by EPD and the State. PLAN LOCAL GOVERNMENT ENFORCEMENT AugUsta Richmond County Government is entering its third year of enforcing the clean up of scrap tire piles and other solid wastes in the Augusta Richmond County area. As the second largest local jurisdiction in the state, there are approximately 170 scrap tire generators. The third year grant would be utilized for maintaining salary and wages of the code enforcement officer, as well as operating costs and training. Also, we would like to purchase new equipment. Georgia EPD has funded the following grants; 1st year grant': $65,800 2nd year grant- $29,325 Augusta Richmond County contributes $9775.00 2nd year grant- $35,000 (On going) Augusta Richmond County contributes $8750.00 Augusta Richmond County has a population of approximately 210,000. The Augusta Richmond County License & Inspection Department and Metro Augusta Clean & Beautiful have continued to produce effectiveernorcement and education programs and the Environmental Enforcement Officer will work in conjunction with Metro Augusta Clean & BeautifuJ,. The officer will help with properiy educating and informing citizens, industry and Qther local government departments with the importance of proper solid waste management and the consequences of non compliance with state and local scrap tire/solid waste ordinances. In outlining a detailed work plan for our environmental enforcement, we have summarized the following areas that we feel are of the greatest importance. 'Ci J Augusta Richmond County will make plans to pursue salvage yards that are in violation of local ordinances and state laws. We plan to make cases against salyage yards for the successful removal of scrap tires and solid waste. Also, there are plans to hold education forums relating to environmental issues. Local Government Enforcement Officer has held neighborhood meetings with government officials. We will continue to conduct the following activities: The environmental officer will take photos, count and measure scrap tire piles. The activity will be conducted throughout the year and the environmental enforcement officer will identify existing scrap tire sites. By identifying the illegal dump sites, the environmental enforcement officer will have citations Written to the property owner. Scrap Tire generators, carriers, and sorters will be inspected for state identification number, permits for using scrap tires, record keeping of manifests, the transporting of scrap tires and storage of scrap tires. This activity will be conducted every quarter. Augusta Richmond County is in compliance with Georgia Solid Waste Act and Rules. Augusta Richmond County has been complying With the "Expectations of Local Code Enforcement Officers." Major accomplishments in 2000: Augusta Richmond County has been successfully removing scrap tires and solid waste from salvage yards. In 2000, Augusta Richmond County successfully removed approximately 20,000 thousand scrap tires which cases were made against. There were three hundred forty- two complaints, forty-four citations, two hundred thirty- five verbal and written warnings, eighty- three illegal dump investigations, and one hundred seventy- four generator inspections. It is with pleasure that Metro Augusta Clean and Beautiful has the opportunity to apply for the education grant. We are extremely pleased with the progress we have made with the scrap tire educational program. In the third year program, we will continue to encourage reduction, reuse and recycling of scrap tires and recyclables through promotion of: Educational Program - the purpose of the education program is to encourage reduction, reuse and recycling of scrap tires and recyclables through promotion of: . Good tire maintenance practices, the recovery of scrap tires for beneficial reuse, and the importance of supporting recycling of scrap tires and other recyclables through consumer purchasing practices. . Reduction, reuse and recyciing of recovered m~terials and solid waste. . Environmental conservation and stewardship. The educational program established as part of the Local Environmental Compliance Program will be coordinated with enforcement activities. The education program will be used to: . Increase consumer and generator awareness about the importance of their role in recycling and preventing the creation of new scrap tit-e piles. . Communicate the problems created as a result of the illegal dumping of scrap tires and the cost of cleaning up illegally dumped scrap tires and promote the programs available to stop illegal practices. Contact EPD staff within the first month of hiring to schedule an initial orientation meeting. 2. Attend enforcement training as directed by EPD staff. 3. Keep accurate and complete support documentation of day to day activities, including hours worked, cases, and inspections. 4. Inventory and assess the number of illegal dumps including scrap tire piles located within the regulatory boundary. a. Issue citations or notices of violation for dumpers or property owners. b. Notify EPD of dumps that are not cleaped up, c. Prioritize the scrap tire piles according to potential danger to human health and the environment. d. Seek local and state assistance for clean up. e. Keep records on how many tires are cleaned up and by whom. 5. Inspect all scrap tire generators at least once per year: a. Do they have an EPD issued scrap tire generator identification number? b. . Are they using permitted scrap tire carriers? c. Are they maintaining copies of completed manifests? Are the manifests completed properly? d. Are the scrap tires being transported only to an end user or to a scrap tire processor or disposal facility approved by EPD? e. Is the number of scrap tires on site within the allowable storage limits? f. Are their Scrap Tire Fee Reports current? 6. Inspect scrap tire sorters quarterly: a. Do they have an EPD issued scrap tire generator identification number? b, Do they have an EPD issued Carrier Permit (if required)? c. After sorting the tires, are they properly re-manifesting the disposition of the scrap tires from the sorting operation to an EPD approved end user or processor? d. Are they maintaining records oftires received, sorted, and scrap tires removed? e. Are their quarterly sorter reports current? f. Is the number of scrap tires on site within the allowable storage limits? g. Are they processing and removing at least 75% of tires received during the quarter? h. Are they in compliance with all other requirements of processing facilities? r. 7. Inspect scrap tire carriers... a. When a generator inspection. identifies a carrier who is improperly completing manifests or failing to return manifests to generators, or b. When a problem carrier is identified by illegal dumping or a complaint. 8. Assess and address problems or complaints involving: a. Littering b. Open burning c. Improper management of construction and demolition waste d. Yard trimmings collection and disposal e. Other local solid waste management problems f. Review local ordinances that address these problems and recommend revisions where necessary. 9. The Environmental Code Enforcement Officer shall not be the local issuing authority for erosion and sedimentation (E&S) control, but the officer may assist in identifying violations, educating the regulated community on E&S avoidance and writing citations. 10. Communicate and coordinate with the entity responsible for education, as well as any local recipient of a GEF A Recycling and Waste Reduction grant, to help ensure that effective methods are being used 'to convey to citizens, school children, industry, and other local government departments the importance of proper solid waste management and the consequences of noncompliance with state and local solid waste ordinances. 11. Communicate and coordinate with the local DNR Wildlife Resources Conservation Officer as well as other resource agencies such as the Georgia Soil and Water Conservation Commission, Georgia Forestry Commission, US Fish and Wildlife Service, Georgia Power, etc. 12. Communicate on a regular basis with EPD Scrap Tire Program staff. 13. Submit a report of the above activities and grant work tasks to EPD on a quarterly basis on forms provided by EPD.
