NEGOTIATED SETTLEMENT AGREEMENT
1. The following Agreement refers to Charge No. 110A13900, on file with the
Equal Employment Opportunity Commission (EEOC) under The Equal Pay Act
of 1963. as amended. Title VII of the Civil Rights Act of 1964. as amended. and
The Americans with Disabilities Act of 1990.
2. In exchange for satisfactory fulfillmeq.t by Respondent of the promises
contained in paragraph (3) of this Agreement, the Charging Party agrees
not to institute a lawsuit with respect to the above referenced charge. '
3. In exchange for the promises of Charging Party contained in paragraph (2)
of this Agreement, the Respondent 'agrees to:
a. increase Charging Party's annual salary to $41, 174.25. This increase will
begin with the applicable pay period immediately following the EEOC
District Director's signature on this agreement.

b. pay the Charging Party the lump sum of$10,000, less no taxes and no other
deductions, which represents compensatory settlement of this charge and is
excludable from gross income and is not considered wages or back pay for
any allege~ punitive and emotional damages in accordance with the
Internal Revenue Code. Payment will be made within .10 working days
from the date of the signature of this agreement by the EEOC District
Director of the Atlanta District Office. The Respondent will issue the
appropriate Form 1099 during, the applicable distribution cycle; the
Charging Party is responsible for all local, state and federal tax reporting
requirements.

c. the Charging Party will not be harassed, intimidated, retaliated against or
penalized in any future considerations for wage increases, promotions,
transfers, or other employment related matter because_of proceedings
arising under Charge No. 110A13900.
4.
It is understood that this Agreement does not constitut.e an admission
by the Respondent of any violation of The Equal Pay Act of 1963, as amended,
Title VII of the Civil Rights Act of 1964, as amended, and the Americans With
Disabilities'Act of 1990.
5.
The Respondentagrees to provide written notice to Charles Mitchell,
Supervisor, of Enforcement Unit 2 of the Atlanta District Office within 10
days of satisfying each obligation specified in paragraph (3) of this
Agreement. -

The following paragraph is deemed incorporated as a part of this
Agreement if and when sighed by EEOC Office Director.
7..1n reliance on the_promises made in paragraphs {2), (3), (5) and {6),
EEOC agrees to terminate the investigation which it has begun and
not to use th~ above, referenced charge as the jurisdictional basis for
a civil action under The Equal Pay Act of 1963, as amended, Title VII of the
Civil Rights Act of 1964, as amended, or the Americans with Di,sabilities Act ,of
.1990. EEOC does not waive or in any manner limit its right to investigate or
seek relief in any other charge including, but not limited to a charge filed by
a member of the Commission against the Respondent.
