RELEASE~ AD ELEMENT AGREEMENT

This RELEASE AND SE TLE T AGREEMENT is made and entered
into this j~~ day of F uary, 2000, by and between DONNA T.
MURRAY ("MURRAY") and OGUSTA, GEORGIA, a political subdivision
of the State of Georgia, the AUGUSTA-RICHMOND COUNTY COMMISSION,
the AUGUSTA-RICHMOND COUNTY BOARD OF TAX ASSESSORS, and their
officials, officers, agents, representatives, and employees
("AUGUSTA") .
WIT N E SSE T H:
WHEREAS, MURRAY is an employee of the Augusta-Richmond
County Board of Tax Assessors; and
WHEREAS, MURRAY has filed Civil Action File No CV 198-229,
DONNA T. MURRAY V. HARRISON F. SEARS, ET AL , In the United
States District Court for the Southern District of Georgia, and
WHEREAS, MURRAY alleges that she was subject to
discrimination by Defendants in violation of Title VII of the
Civil Rights Act of 1964, U.S.C. ~ 2000e et seq, the Civil Rights
Act of 1991, 42 U.S.C. ~1981a, 42 U.S.C.~~ 1983 and 1988, the
First, Fifth, Thirteenth and Fourteenth Amendments of the United
States Constitution, and the laws of the State of Georgia; and
WHEREAS, the parties desire to resolve this dispute under
the terms and conditions of this RELEASE AND SETTLEMENT
AGREEMENT.
NOW, THEREFORE, for and in consideration of the mutual
promises and covenants contained herein, and other good and
valuable ~onsideration, the receipt and sufficiency of which are
hereby acknowledged, the parties hereto, intending to be legally
bound, do hereby agree as follows:
1. PAYMENT TO MURRAY. Upon the execution of this RELEASE
AND SETTLEMENT AGREEMENT, AUGUSTA shall adjust MURRAY
to a pay rate of Fifty- Three Thousand Three Hundred
and Eighty Dollars ($53,380) per year, and pay the
amount of Fifty Thousand Dollars ($50,000) to MURRAY in
full and complete settlement of MURRAY's claims and any
claim for attorneys fees and/or costs pursuant to 42

U.S.C. ~ 1988 or otherwise.
2. DISMISSAL. MURRAY agrees to execute all documents
necessary to dismiss with prejudice the Civil Action
File No. CV 198-229, DONNA T. MURRAY V. HARRISON F.
SEARS, ET AL.
3. RELEASE. In consideration for the promises and
covenants made by AUGUSTA herein, MURRAY hereby
releases, and forever discharges and by these presents
does for herself, her heirs, executors, administrators,
successors, and assigns, hereby remise, release and
forever discharge the Augusta, Georgia, the Augusta-
Richmond County Board of Tax Assessors, and any and all
of their elected officials, officers, agents,
employees, representatives, heirs, administrators,
successors and assigns, of and from any and all claims,
demands, rights or causes of action, direct or
indirect, known or unknown, which she may now have or
which might accrue to her in the future, which relate
in any way to her past employment with Richmond County
and/or Augusta, Georgia.
4. NO ADMISSION OF LIABILITY. MURRAY acknowledges and
agrees that the resolution of this dispute through this
RELEASE AND SETTLEMENT AGREEMENT does not constitute an
admission of liability by AUGUSTA, Harrison Sears, the
Augusta-Richmond County Commission, the Augusta-
Richmond County Board of Tax Assessors or its elected
officials, officers, agents, employees,
representatives, or attorneys, it being expressly
understood that they deny liability to and for damages
alleged by MURRAY in connection with the dispute and
that this RELEASE AND SETTLEMENT AGREEMENT evidences a
compromise settlement of a doubtful and disputed claim
and is entered into to avoid the delays and risks of
litigation.
5. MISCELLANEOOS. This RELEASE AND SETTLEMENT AGREEMENT
shall be governed by and construed in accordance with
the laws of the State of Georgia. This RELEASE AND
SETTLEMENT AGREEMENT is the entire agreement between
the parties, and may not be amended or revised except
by in writing signed by both parties. Time is of the
essence of this RELEASE AND SETTLEMENT AGREEMENT.
