THIS AGREEMENT, made and entered into this .27 nJ-- day of
/1A.A;~ , 2006, by and between AUGUSTA, GEORGIA, a political subdivision
of the State of Georgia (hereinafter referred to as "AUGUSTA"), and REGIONS BANK,
(hereinafter referred to as "BANK");
SUBORDINA nON AGREEMENT
WITNESSETH:
WHEREAS, BALDEMAR PINEDA, JR., (hereinafter referred to as "OWNER")
on September 7, 2001 gave to BANK a Security Deed to the property described on
Exhibit A, to secure a certain indebtedness to BANK and said Security Deed is recorded
in the Office of the Clerk of the Superior Court of Richmond County, Georgia, in Realty
Reel 749, page 1779.
WHEREAS, OWNER has granted an Easement dated
IAo..y-:-.t. 3-/~ . ___ to AUGl!STf\ across the property described o~ Exhibit A,
the ongmal of WhICh IS to be recorded m the Office of the Clerk of the Supenor Court of
Richmond County, Georgia; and
WHEREAS, BANK is willing to subordinate the lien of its said Security Deed
dated September 7, 2001 to any interest that AUGUSTA may have in the above
referenced easement.
NOW, THEREFORE, in consideration of the premises and the mutual
covenants and promises hereinafter contained and the duties to be undertaken, BANK
does hereby agree and declare that the lien of the Security Deed from OWNER to BANK,
dated September 7, 2001, and recorded in the Office of the Clerk of the Superior Court of
Richmond County, Georgia in Realty Reel 749, page 1779, is and forever shall be

subject, subordinate and inferior in lien right and dignity at all times to the easement from
OWNER to AUGUSTA which is to be recorded in the aforesaid Clerk's Office.
WHEREFORE, BANK has caused this instrument to be executed by its duly
authorized officers and seal affixed, all on the date above first written.

Exhibit A
All that lot or parcel of land, with improvements. thereon, lying in Richmond County,
Georgia, and consisting of 1.70 acres, more or less, and fronting 366.45 feet, more or
less, on the North side of Meadowbrook Drive, and extending back on its western
boundary a distance of 200.47 feet, more or less, and on its Eastern boundary a distance
of 183.86 feet more or less, to a rear or northern width of 357.62 feet more or less.
Reference is made to plat of subject property by Harbin Land Surveyors recorded in the
Office of the Clerk of Superior Court of Richmond County, Georgia in Reel 719, page
402 for a more complete and accurate description of the metes, bounds and location of
said property.
Subject to an'easement in favor of Southern Bell recorded in said Clerk's Office in Realty
Reel 313, page 1455.
