,THIS AGREEMENT, made and entered into this /r day of
-kvll ,2008, by and between AUGUSTA, GEORGIA, a political subdivision
of the State of Georgia (hereinafter referred to as "AUGUSTA"), and RAYMOND
SCARLETT AND BEVERL Y SCARLETT, (hereinafter referred to as "LENDER");
WITNESSETH:
WHEREAS, ELMIRA ROULHAC (hereinafter referred to as "OWNER") on
May 15,2006 gave to LENDER a Security Deed to the property described on Exhibit A,
to secure a certain indebtedness to LENDER and said Security Deed is recorded in the
Office of the Clerk of the Superior Court of Richmond County, Georgia, in Realty Reel
1057, page 2401.
WHEREAS, OWNER has granted an Easement dated
-M II ,t!, J I, ZOcY to AUGUSTA across the property described on Exhibit A,
the original of which is to be recorded in the Office of the Clerk of the Superior Court of
Richmond County, Georgia; and
WHEREAS, LENDER is willing to subordinate the lien of its said Security Deed
dated May 15, 2006 to any interest that AUGUSTA may have in the above referenced
easement.
NOW, THEREFORE, in consideration of the premises and the mutual
covenants and promises hereinafter contained and the duties to be undertaken, LENDER
does hereby agree and declare that the lien of the Security Deed from OWNER to
LENDER, dated May 15, 2006, and recorded in the Office of the Clerk of the Superior
Court of Richmond County, Georgia in Realty Reel 1057, page 2401, is and forever shall

be subject, subordinate and inferior in lien right and dignity at all times to the easement
from OWNER to AUGUSTA which is to be recorded in the aforesaid Clerk's Office.
WHEREFORE, LENDER has caused this instrument to be executed on the date above
first written.

ALL THAT LOT OR PARCEL OF LAND. together with all buildings and
improvements thereon, situate. lying and being in the 1660th D.G.M., in the State
of Georgia, County of Richmond. fronting 88.9 feet, more or less. on the Soutb
side of Phinizy Road and being known and designated as Lot No. 11 on a plat of
Cypress Acres made by Edwin Epstein, January 30, 1951 and recorded in the
Office of the Clerk of Superior Court of Richmond County, Georgia. in Realty
Book 18-C, Page 395. Reference is hereby mnde to said plat for a more complete
and accurate description as to metes, bounds and location of said property.
SAID property is more specifically sbown and designated as to metes. bounds
aad description on a plat made by Billy B. Beazley, dated June 19. 1969 and
recorded in said Clerk's Office in Realty Book 36-R, page Z73.
SAID property is conveyed subject to any and all applicable easements,
restrictions and to covenants recorded in aforesaid clerk's office in Realty Book
I8-G, page 217.
ALSO, all tbat lot or pnrcel of land, situate, lying and being in then 16601b
G.M.D. of Richmond County. Georgia, South of Phinizy Road. containing 0.404
acre and being designated as Tract "8" on a plat made by Brian G. Besson.
Registered Land Surveyor, dated November 17. 1982, recorded in said Clerk's
Office in Realty Reel 157, page 2336. Reference is hereby made to said plat for a
more complete and accurate description of said property hereby conveyed. Said
lot is contiguous to Lot no. 11 of the Cypress Acres Subdivision.
