Jordan, Jones &' Gou 1 d; nq, I nc. , a Corporation authorized to do business in Georgia, hereinafter called the "Consultant." Whereas, the Owner desires to engage a qualified and experienced consulting firm to furnish professional services for: "Site Acceptability Studies and Design for Municipal Solid Waste Landfill In the State of Georgia" Whereas, the Consultant has represented to the Owner that it is experienced and qualified to provide the services contained herein and the Owner has relied upon such representation. Now, therefore, in consideration of the mutual promises and covenant herein contained, it is, agreed by and between the.Owner and the Consultant that the Consultant shall pr6vide the professional services of the project (see scope of seryices). 2 Augusta-Richmond County Landfill Engineering Consultant Service Agreement March 2001 -; ., .. , , , /" . DESIGN CRITERlA Investigations and evaluations required for MSW Subtitle D landfills permitting, design and operation must be in accordance with section D of "Project Requirements" Part of this RFP and all other federal, State and local applicable Rules and Regulations. The Consultant shall gather from the Owner all available data and infonnation pertinent to the performance of the services for the Project. The Owner shall have the final decision as to what data and information is pertinent i The Consultant shall ensure that the data and information meet applicable standards as specified herein. The Consultant shall report in writing any discovery of errors or omiSSIons contained in the data and information furnished by the Owner; The Consultant shall visit and become familiar with the Project site and shall become acquainted with local conditions involved in carrying out this Agreement. The Consultant may \ request that a representative of the Owner be present during the site visit. The Consultant shall recommend and secure the Owner's written approval of, the manner of project plans presentation and the methods to be used in the plan preparation so that these plans can be best utilized, as determined by the Consultant and approved by the Owner, in the orderly preparation of the detailed construction contract plans, specifications, and contracts. Upon receipt of the Owner's written approval of the manner of the project plan presentation and methods of plan preparation, the Consultant shall proceed with implementation of plan preparation. 3 Augusta-Richmond County Landfill Engineering Consullant Service Agreement March 2001 .. .. AMOUNT OF CONTRACT It is agreed that the compensation hereinafter specified to perform the services (see Project Scope of Services) required by this Agreement includes both direct and indirect costs chargeable to the project, as further defined in Part IV Proposal FOffi1at Section E Fee ProposalofRFP. The maximum obligation of the Owner to the Consultant under the terms of this Agreement shall be: $454,607 Note: Owner shall have the right to award only the part ofthe work if the Owner so desires. 4 Augusta-Richmond County Landfill Engineering Consultant Service Agreement March 200 I .~ " '. ' ,. !. GENERAL CONDITIONS CONSULTANT COORDINATION The Consultant shall cooperate fully with Federal and State official, consultants on adjacent projects, municipalities and local government officials, utility companies, railroads, and others, as may be directed by the Owner. Such cooperation shall include attendance at meetings, discussions, and hearings, as may be requested by the Owner, furnishing plans and other dafa produced in the course of work on the Project, as may be requested from time to time by the Owner to effect such cooperation and compliance with all directives issued by the Owner in accordance with this agreement. It is understood and agreed that Federal and State regulators may have access to the work and be furnished informa~ion as directed by the Owner. COORDINATION WITH THE NATIONAL GEODETIC SURVEY If a National Geodetic Survey control point is found during the surveying phase, it is to be identified and brought to the attention of the Environmental Engineer. If it is to be affected based on the proposed desigp, at the direction of Environmental Engineer, the Consultant shall contact the National Geodetic Survey (NGS) advisor at the Georgia Department of Community Affairs (DCA) and request data on geodetic control points during the preliminary evaluation phase of project design. (Address: NGS c/o DCA, 1200 Equitable Building; Atlanta, Georgia 30303. Telephone: 404-656-5527, FAX: 404-656-9792). Consultant shall provide the NGS Advisor with a clear copy of the pertinent USGS 7.5' Quad sheet(s) showing the project location. Preliminary information, even in rough outline, is sufficient to allow the advisor to determine impact of the proposed project on NGS and USGS control points. Continued coordination with the advisor to relocate and/or preserve affected control points will be maintained throughout the project life. This coordination shall be implemented as soon as possible after receipt of Notice to Proceed by the Owner. SURVEY CONTROL Establish horizontal control referenced to Georgia State Plane East Coordinates (N.A.D. 83) applying the appropriate grid factors to each measure. Vertical control shall be tied to the North American Vertical Datum (1988). Additional permanent control (minimum of two locations) shall be established by the Consultant in areas outside of the anticipated construction areas and surface drainage areas. This is to ensure project control re-establishment after construction. 5 Augusta-Richmond County landfill Engineering Consultant Service Agreement Mareh 2001 , " , l,,1 ,. , .. t; II Control monuments shall be of concrete with a brass disk in the top. If monuments to be reset are NGS or USC & GS monuments, reset monuments shall be in accordance with NGS Standards as regards to material, depth, size, etc. Concrete control monuments shall be four (4) feet in depth and at least twelve (12) inches in diameter unless conditions dictate otherwise. Deviation from this length shall be approved by the Owner Engineer. A No.4 rebar shall be set in the concrete or in lieu of a rebar and brass disk, an aluminum magnetic cap may be used. COORDINATION WITH UTILITIES i Where privately, publicly or cooperatively owned utility companies will require rearrangements in connection with the proposed construction, the Consultant shall furnish prints or sepias for the utility owners as directed by the Owner and check the utilities' submitted plans for avoidance of conflicts with the landfill construction details or with the facilities of other utilities. This may require numerous submittals to the utility companies. The Consultant shall also submit a final set of construction plans to all effected utilities. The Consultant shall make no commitments with the utilities which are binding upon the Owner. RlGHT TO ENTER The Consultant will notify all property owners or occupants of the iiltent to enter properties for the purpose of accomplishing surveys or other field investigations in accordance with the practices of the Owner. The Consultant shall discuss with and receive approval from the Augusta Richmond County Public Works and Engineering Department prior to sending said notices of intent to enter private property. Upon request by the Consultant, the Owner will provide the necessary documents identifying the Consultant as being in the employ of the Owner for the purpose described in the Agreement. If the property owner or occupant denies the Consultant permission to enter, such incident will be reported to the Owner and the Owner will initiate such action as is dictated by current policy and procedure. ACCURACY OF WORK The Consultant shall be responsible for the accuracy of the work and shall promptly correct its errors and omissions without additional compensation. Acceptance of the work by the Owner will not relieve the Consultant of the responsibility for subsequent correction of any errors and the clarification of any ambiguities. At any time during the construction of the improvement provided for by the plans or during any phase of work performed by others' based on data secured by the Consultant under the Agreement, the Consuitant shall confer with the Owner for the purpose of interpreting the information obtained and to correct any errors or omissions made by it. The Consultant shall prepare any plans or data required by the Owner to correct its errors or omissions. The above consultation, clarification, or correction shall be made without added compensation to the 6 Augusta-Richmond County Landfill Engineering Consultanl Service Agreement March 2001 , . , t,' " . Consultant. The Consultant shall give immediate attention to these changes so there will be a minimum of delay to others. CHANGE IN THE WORK The Owner reserves the right to make at any time such alterations in the character of the work as the Owner may consider necessary or desirable to complete the proposed work in a satisfactory manner and consistent with the intent of these Contract Documents. Notice of every such alteration or change shall be given in writing to the Consultant by the Owner, and no such alteration or change shall be considered as constituting a waiver of any of the provisions of these Contract Documents or as nullifying or invalidating any of such provisions. Should any such alteration or change result in an increase or decrease in the quantity or the cost of the work described in these Contract Documents, the total amount payable under the Contract will be accordingly modified. If alterations or changes are thus made, the contract time will be correspondingly modified, if the Consultant so requests, before commencing the work attributable to such alterations or changes. It is understood and agreed that the Consultant shall perform all extra work that may be ordered in writing by the Owner arising out of the modification of the Specifications or Drawings made or approved by the Owner. For this extra work, the Consultant shall be compensated as provided hereinafter and in the Change Order covering the additional services. All Change Orders must be approved by the Owner and those governmental agencies whose approval is required. ADDITIONAL SERVICES The Consultant may be required to perform additional services or tasks related to the work outlined in the Scope of this Agreement that are specific to site conditions and are not typical in nature. The Consultant shall, at the Owner's request, submit a proposal indicating manhours and costs to the Owner for approvaL The Consultant shall not begin on any task until the Owner issues written authorization to proceed. ENVIRONMENT AL ENGINEER The Environmental Engineer or his duly appointed representatives shall act as the Liaison Engineer between the Consultant and the Owner and all utilities, and authorities or govenunents whose properties will be affected. The Consultant shall arrange for conferences and exchanges of data and information and for necessary approvals. 7 Augusta-Richmond County Landtill Engineering Consultant Service Agreement March 200 I .. , . '. . ~ t.. ,.' " . All correspondence, data, information, and reports shall be directed to the Environmental, Engineer to provide for proper distribution to the parties concerned. All conferences, including telephone conversations and decisions, shall be reduced to writing by the Consultant and at least two (2) copies of the resumes shall be forwarded to the, Environmental Engineer within seven (7) calendar days of the event. The Consultant shall meet with the Owner for review of the work or submit in writing a project status update on a regular monthly basis as determined by the Owner. .' The Environmental Engineer will expedite any necessary decisions affecting the performance of the Consultant's Agreement, but the Consultant shall not make use of the Environmental Engineer's services on trivial or minor matters normally to be decided by the Consultant. DELIVERY OF NOTICES All written notices, demands, and other papers or documents to be delivered to the Owner Under this Agreement shall be delivered to the Owner's office, 530 Greene Street, Room 701, Augusta, Georgia 30911, Attention: Environmental Engineer, or at such other place or places as may be subsequently designated by written notice to the Consultant. All written notices, demands, and other papers or documents to be delivered to the Consultant under this Agreement shall be directed to or at such a place or places subsequently to be designated in writing by the Consultant to the Owner. SUPERVISION AND CONTROL The Consultant shall perform the services required to accomplish the work plan as stated above under such control and supervision by the Owner as the Owner may deem appropriate. COVENANT AGAINST CONTINGENT FEES The Consultant shall comply with the relevant requirements of all Federal, State, County, or local laws. The Consultant warrants that it has not employed or retained any company or person, other than a bona fide employee working solely for the Consultant, to solicit or secure this Agreement, and that it has not paid or agreed to pay any company or person, other than a bona fide' employee working solely for the Consultant, any fee, commission, percentage, brokerage fee, gifts, or any consideration, contingent upon or resulting from the award or making of this Agreement. ,For breach or violation of this warranty, the Owner shall have the right to annul this Agreement without liability, or, at its discretion, to deduct from the Agreement price or consideration, or otherwise recover, the full amount of such fee, commission, percentage, brokerage fee, gift, or contingent fee. 8 Augusta-Richmond County Landfill Engineering Consultant Service Agreement March 2001 , , . , .- ' " " . EMPLOYMENT OF COUNTY'S PERSONNEL The Consultant shall not employ any person or persons in the employ of the Owner for any work required by the terms of this Agreement, without the written permission of the Owner except as may otherwise be provided for herein. REVIEW OF WORK Authorized representatives of the Owner may at all reasonable times review and inspect the project activities and data collected under the Agreement and amendments thereto. All reports, drawings, studies, specifications, estimates, maps and computations prepared by or for the Consultant, shall be available to authorized representative of the Owner for inspection and review at all reasonable times in the main offices of the Owner. Acceptance shall not relieve the Consultant of its professional obligation to correct, at its expense, any of its errors in work. The Public Works and Engineering Department may request at any time and the Consultant shall produce progress prints or copies of any work as performed under this Agreement. Refusal by the Consultant to submit progress reports and/or plans shall be cause to withhold payment to the Consultant until the Consultant complies with the Owner's request in this regard. The Owner's review recommendations shall be incorporated into the plans by the Consultant. RESPONSIBILITY FOR CLAIMS AND LIABILITY The Consultant shall be responsible for any and all damages to properties or persons caused by its employees, subcontractors, or agents, and shall hold harmless the Owner, its officers, agents, and employees from all suits, claims, actions, or damages of any nature whatsoever to the extent found to be resulting from the Consultant, its subcontractors, or agents in the negligent performance or non-performance of work under this Agreement. These indemnities shall not be limited by reason of the listing of any insurance coverage. INSURANCE Prior to beginning work, the Consultant shall obtain and furnish certificates to the Owner for the following minimum amounts of insurance: A. Workmen's Compensation Insurance in accordance with the laws of the State of Georgia. B. Public Liability Insurance in an amount of not less than One Hundred Thousand ($ I 00,000.00) Dollars for injuries, including those resulting in death to anyone person, and in an amount of not less than Three Hundred Thousand ($300,000.00) Dollars on account of anyone occurrence. C. Property Damage Insurance in an amount of not less than Fifty Thousand ($50,000.00) Dollars from damages on account of any occurrence, with an aggregate limit of One Hundred Thousand ($100,000.00) Dollars. 9 Augusta-Richmond County Landtill Engineering Consultant Service Agreement March 200 I . Valuable Papers Insurance in an amount sufficient to assure the restoration of any plans, drawings, field notes, or other similar data relating to the work covered by the Project. ' E. Professional Liability Insurance in an amount that correlates to the amount of this agreement and nature of the project. F. The Consultant shall procure and maintain, at his own expense, during the life of the Contract, in accordance with the provisions of the laws of the state in which the work is performed, Workman's Compensation Insurance, including occupational disease, provisions, for all of his employees at the site of the project and in case any work is sublet, the Consultant shall require such Subcontractor similarly to provide Workman's Compensation Insurance, including occupational disease provision for all of the latter:s employees unless such employees are covered by the protection afforded by the Consultant. In case any class of employees engaged in hazardous work under this Contract at the site of the Project is not protected under Workman's Compensation statute, the Consultant shall provide and shall cause each Subcontractor to provide adequate and suitable insurance for the protection of his employees not otherwise protected. G. Each insurance policy shall be renewed 10 days before the expiration date thereof. H. Insurance policies must be carried by a recognized insurance company licensed to do business in the state in which the project is constructed and approved by the Owner's Attorney. I. The Consultant shall not commence work under this Contract until he has obtained all of the insurance required and such insurance has been approved by the Owner, nor shall the Consultant allow any subcontractor to commence work on his subcontract until the insurance required of the subcontractor has been so obtained and approved. In the event any insurance coverage should be canceled or allowed to lapse, the Consultant will not be permitted to work until adequate and satisfactory insurance is in effect. Failure to keep insurance policies in effect WILL NOT be cause for any claims for extension of time under this Contract. COMPENSATION The Owner shall compensate the Consultant for services which have been authorized by the Owner under the terms of this Agreement. The Consultant may submit to the Owner a monthly invoice, in a form acceptable to the Owner and accompanied by all support documentation requested by the Owner, for payment for the services which were completed during the billing period. The Owner shall review for approval said invoices. The Owner shall have the right to reject payment of any invoice or part thereof if not properly supported, or if the costs requested or a part thereof, as determined solely by the Owner,' are unreasonably in excess of the actual stage of completion of each phase. The Owner shall pay each such invoice or portion thereof as approved, provided that the approval or payment of any such invoice shall not be considered to be evidence of performance by the Consultant to the point indicated by such invoice, or of receipt of acceptance by the Owner of the services covered by such invoice. The Owner shall pay any undisputed items contained in such invoices. 10 Augusta-Richmond County landlill Engineering Consultant Service Agreement March 2001 , ~ I ;- " . Each invoice shall be accompanied by a letter progress report describing the total work accomplished for each phase and any problems which have been encountered which may inhibit execution of the work. The Consultant shall also submit an accurate updated schedule, and an itemized description of the percentage of total work completed for each phase during the billing period. ' Compensation for design services for the Augusta Richmond County Public Works and Engineering Department shall be a lump sum for each phase or item of work authorized by the Owner. The Consultant shall invoice based on the percentage of the work completed during the billing period. Upon completion by the Consultant of each phase of,the work and approval thereof by the Owner, the Owner will pay the Consultant a sum equal to one hundred perc6nt (100%) of the compensation set forth herein, less the total of all previous partial payments, paid or in the process of payment. The Consultant will indemriify arid save the Owner or the Owner's agents harmless from all claims growing out of the lawful demands of Subcontractors, laborers, workmen, mechanics, materialmen, and furnishers of machinery and parts thereof, equipment, tools, and all supplies, incurred in the furtherance of the performance of the work. The Consultant shall, at the Owner's request, furnish satisfactory evidence that all obligations of the nature designated above have been paid, discharged, or waived. If the Consultant fails to do so the Owner may, after having notified the Consultant, either pay unpaid bills or withhold from the Consultant's unpaid compensation a sum of money deemed reasonably sufficient to pay any and all such lawful claims until satisfactory evidence is furnished that all liabilities have been fully discharged whereupon payment to the Consultant shall be resumed, in accordance with the terms of the Contract Documents, but in no event shall the provisions of this sentence be construed to impose any obligations upon the Owner to either the Consultant, his SuretY, or any third party. In paying any unpaid bills of the Consultant, any payment so made by the Owner shall be considered as a payment made under the Contract Documents by the Owner to the Consultant and the Owner shall not be liable to the Consultant for any such payments made in good faith. No separate payment will be made for any items specified in the General Conditions. Payments fqr such items shall be included in the unit price and lump sum prices bid by the Consultant for items listed in the Bid Schedule. It is understood and agreed that the approval of the progress payment request and the paying of a partial payment shall not be construed as acceptance of any work, materials, or products and shall not relieve the Consultant in any way from his responsibilities and obligations under these Contract Documents. A partial payment will not be made when, in the judgment of the Owner or the Owner's Engineer, the work is not proceeding in accordance with any of the provisions of these Contract Documents. 11 Augusta-Richmond County Landfill Engineering Consultant Service Agreement March 2001 . .i,1 " ' I i " , ACCEPTANCE OF FINAL PAYMENT AS RELEASE The acceptance by the Consultant of final payment shall be and shall operate as a release to the Owner of all claims and all liability to the Consultant other than claims in stated amounts as may be specifically excepted by the Consultant for all things done or furnished in connection with this work and for every act and neglect of the Owner and other relating to or arising out of this work. Any payment, however, final or otherwise, shall not release the Consultant or his Sureties from any obligations under the Contract Documents or the Performance Bond and Payment Bonds. . ...... i INDEMNIFICATION The Consultant will indemnify and hold harmless the Owner and the Owner's Engineer and their agents and employees from arid against all claims, damages, losses and expenses including attorney's fees arising out of or resulting from the performance of the work, provided that any such claim, damage, loss or expense is attributable to bodily injury, sickness, disease or death, or ' to injury to or destruction of tangible property, including the loss of use resulting therefrom; and is caused in whole or in part by any negligent or willful act or omission of the Consultant and Subcontractor, anyone directly or indirectly employed by any of them or anyone for whose acts any of them may be liable. In any and all claims against the Owner or the Owner's Engineer or any of their agents or employees, by an employee of the Consultant, Subcontractor, anyone directly or indirectly employed by any of them, or anyone for whose acts any of them may be liable, the, indemnification obligation shall not be limited in any way by any limitation on the amount or , type of damages, compensation or benefits payable by or for the Consultant or' any Subcontractor under Workman's Compensation acts, disability benefit acts or other employee benefits acts. The Consultant shall require his insurance carrier to add the Owner and his agents as additional insureds under the Consultant's general liability insurance policy with respect to the services performed by the Consultant for the Owner. CONTRACT DISPUTES This Agreement shall be deemed to have been executed in Augusta Richmond County, Georgia, and all questions of interpretation and construction shall be governed by the Laws of the State of Georgia. All claims, disputes and other matter:s in question between the Owner and the Consultant arising out of or relating to the Agreement, or the breach thereof, shall be decided in the Superior Court of Richmond County, Georgia. The Consultant, by executing this Agreement, specifically consents to venue in Richmond County and waives any right to contest the venue in the Superior Court of Richmond County, Georgia. 12 Augusta-Richmond County Landtill Engineering Consultant Service Agreement March 2001 " : . \ , SEP ARA TE CONTRACTS The Owner reserves the right to let other contracts in connection with this Project. The Consultant shall afford other contractors/consultants reasonable opportunity for the execution of their work and shall properly connect and coordinate his work with theirs. If the proper execution or results of any part of the Consultant's work depends upon the work of any other Consultant, the Consultant shall inspect and promptly report to the Engineer any defects in such work that render it unsuitable for such proper execution and results. .. j The Owner may perform additional work related to the Project by himself or he may let other contracts containing provisions similar to these. The Consultant will afford the other Consultants who are parties to such contracts (or the Owner, if he is performing the additional work himself), reasonable opportunity for the execution of the work and shall properly connect and coordinate his work with theirs. If the performance of additional work by other Consultants or the Owner is, not noted in the Contract Documents prior to the execution of the Contract, written notice thereof shall be given to the Consultant prior to starting any such additional work. If the Consultant believes that the performance of such additional work by the Owner or others involves him in additional expense or entitles him to an extension of the contract time, he may make a claim therefor as provided in Sections "Change in the Work" and "Change in Contract Price". SUBCONTRACTING The Consultant may utilize the services of specialty Subcontractors on those parts of the work, which, under normal contracting practices, are performed by specialty Subcontractors. The Consultant shall not award work to Subcontractor(s), in excess of fifty (50%) percent of the Contract Price, without prior written approval of the 'Owner. The Consultant shall be fully responsible to' the Owner for the acts and omissions of his Subcontractors, and of persons either directly or indirectly employed by them, as he is for the acts and omissions of person directly employed by him. The Consultant shall cause appropriate provisions to be inserted in all subcontracts relative to the work to bind the Subcontractors to the Consultant by the terms of the Contract Documents insofar as applicable to the work of Subcontractors and to give the Consultant the same power as regards terminating any subcontract that the Owner may exercise over the Consultant under any provision of the Contract Documents. Nothing contained in this Contract shall create any contractual relation between any Subcontractor and the Owner. 13 Augusta-Richmond County Landfill Engineering Consultant Service Agreement March 2001 . , " " , " The Consultant shall give his personal attention to the fulfillment of the Contract and shall at all times keep the work under his control. The Consultant may subcontract portions of the work; however, he shall not award any work to any subcontractor without prior written approval of the Owner. The Owner's approval will not, be given until the Consultant submits to the Owner a satisfactory statement concerning the proposed award to a subcontractor. "Work" as used herein, shall include the procurement and/or fabrication and the installation of the equipment described in the Specifications. The Consultant shall be as fully responsible to the Owner for the acts and omissions of l).is subcontractors, and of persons either directly or indirectly employed by them, as he is for acts' or omissions of persons directly employed by him. All subcontractors shall be deemed to be agents ofthe Consultant. The approval of the Owner of any subcontractor shall not, under any circumstances, operate to relieve the Consultant or his sureties of any of his or their obligations under these Contract Documents. It is understood and agreed that all subcontracts and approvals of subcontractors shall be based upon the requisite of performance by the subcontractor in accordance with these Contract Documents; and should any subcontractor fail to perform his work to the satisfaction of the Engineer, the Owner shall have the absolute right to rescind his approval at once and to require the performance of such work by the Consultant or entirely or in part through other approved subcontractors. The Consultant shall submit a list of the names and addresses of proposed subcontractors, together with the type of work to be provided, with his bid. The Consultant will not be allowed to make changes in the list without the Owner's approval. The Consultant shall cause appropriate provisions to be inserted in all subcontracts relative to the work to bind subcontractors to the Consultant by the terms of these Contract Documents insofar as applicable to the work of subcontractors and to give the Consultant the same power as regards terminating any subcontract that the Owner may exercise over the Consultant under any provision ofthese Contract Documents. The Consultant shall inspect all work performed by subcontractors for compliance with these Contract Documents. TAXES, PERMITS AND LICENSES The Consultant shall pay all applicable taxes levied by' federal, state, and local governments and obtain all permits on any part of the work as required by law in connection with the work. It is understood and agreed that the cost of said taxes is included in the contract price(s) for the work. The Consultant shall procure all temporary and permanent permits and licenses necessary and incidental to the due and lawful prosecution of the work and shall pay all charges and fees, and all costs thereof shall be deemed to be included in the contract price(s) for the work. 14 Augusta-Richmond County Landfill Engineering Consultant Service Agreement March 2001 ,J . , SPECIAL RESTRICTIONS No site work shall be allowed after the hours of darkness or on Sunday and Holiday without permission of the Owner. EXISTING STRUCTURES AND UTILITIES The existence and location of structures and underground utilities shall be investigated and verified in the field by the Consultant before starting any site work. The Consultant shall be /' held responsible for any damage to and for maintenance and protection of existing utilities and structures. TIME FOR COMPLETION AND LIOUIDA TED DAMAGES The date of beginning and the time for completion of the work are essential conditions of the Contract Documents and the work embraced shall be commenced on the date specified in the Notice to Proceed. The Consultant will proceed with the work at such rate of progress to insure full completion within the contract time. It is expressly understood and agreed, by and between the Consultant and the Owner, that the contract time for the completion of the work described herein is a reasonable time, taking into consideration the average climatic and economic conditions and other factors prevailing in the locality ofthe work. If the Consultant shall fail to complete the work within the contract time or extension of time granted by the Owner, then the Consultant will pay to the Owner the amount for liquidated damages the sum of $500.00 for each calendar day that the Consultant shall be in default after the time stipulated in the Contract Documents. The Consultant shall not be charged with liquidated damages or any excess cost when the delay in completion of the work is due to the following and the Consultant has promptly given written notice of such delay to the Owner or Engineer. 1. To any preference, priority or allocation order duly issued by the Owner. 2. To unforeseeable causes beyond the control and without the fault of negligence of the Consultant, including but not restricted to, acts of God or of the public enemy, acts of the Owner, acts of another Contractor in the performance of a contract with the Owner, fires, floods, epidemics, quarantine restrictions, strikes, freight embargoes and abnormal and unforeseeable weather; and 3. To any delays of subcontractors occasioned by any of the causes specified in Paragraphs I and 2 of this Article. 15 Augusta-Richmond County Landfill Engineering Consullant Service Agreement March 2001 .' . ", . , " The assessment of liquidated damages for failure to complete the WORK within the CONTRACT TIME shall not constitute a waiver of the OWNER's right to collect any additional damages which the OWNER may sustain by failure of the Consultant to carry out the terms of his CONTRACT. Time extensions, however, will not be granted for rain, wind, flood or other natural phenomena of normal intensity for the locality where WORK is performed. For purpose of determining extent of delay attributable to unusual weather phenomena, a determination shall be made by comparing the weather for at least any continuous one-fourth of the CONTRACT PERIOD involved with the average of the preceding 5 year climatic range during the same time inte~,al based on US Weather Bureau statistics for the locality where the WORK is performed. ' PRE-COMMENSEMENT CONFERENCE A pre-construction conference shall be held at an acceptable time to the Owner and the Consultant prior to the "Notice to Proceed" to coordinate the work and satisfy all requirements of the Contract Documents. CONTRACT TERMINATION Pursant to O.c.G.A. 36-60- 13, this Agreement shall terminate absolutely and without further obligation on the part of the Owner at the close of the calendar year in which this Agreement is executed and at the close of each succeeding calendar year for which the agreement may be renewed by the parties hereto. This Agreement shall nevertheless automatically be renewed unless the Owner provides written notice to the Consultant of its intention to terminate the Agreement at least thirty days prior to the close of the calendar year for which the Agreement is presently effective between the parties and/or has been renewed by the Owner. , This Agreement shall obligate the Owner solely for those sums payable during the initial term of execution or in the event of renewal by the Owner for those sums payable in such individual renewal terms. Notwithstanding the foregoing, language, the Consultant agrees to continuously render the professional services specified by the Agreement to the Owner for such terms or renewal terms as are eIfective pursuant to this Agreement and for which the Owner agrees to pay in accordance with the terms of the Agreement or any future amendments thereto. The Owner may teiminate this contract in part or in whole upon written notice to the Consultant. The Consultant shall be paid for any validated services under this Contract up to the time of termination. 16 Augusta-Richmond County Landfill 'Engineering Consultant Service Agreement March 2001 . A ." .. , . , I' .~ PERSONNEL The Consultant represents that it has secured all personnel necessary to complete this agreement, none of whom shall be employees of, or have any contractual relationship with, the Owner. Primary liaison with the Owner will be through its designee/Project Manager. All of the services required hereunder will be performed by the Consultant under his supervision, and all personnel engaged in the work shall be fully qualified and shall be authorized or permitted under law to perform such services. All professional personnel, including subcontractors, engaged in performing services for the Consultant under this agreement are indicated as Project Team in Consultant Proposal and incorporated herein by reference. No changes or substitutions shall be permitted in the Consultant's key personnel as set forth herein without the prior written approval of the Owner or his designee. The Consultant shall employ in responsible charge of supervision and design of the work only persons duly registered in the appropriate category; and further shall employ only qualified surveyors in responsible charge of any survey work. The Consultant shall endorse all reports, contract plans, and survey data. Such endorsements shall be made by a person duly registered in the appropriate category by the Georgia State Board of Registration for Professional Engineers and Land Surveyors, being in the full employ of the Consultant and responsible for the work prescribed by this agreement. ELECTRONIC DOCUMENTS The Consultant shall submit electronic files of all project related documentation including the design calculation data files and any other supporting data files to Owner. CONFIDENTIALITY The Consultant agrees that its conclusions and any reports are for the confidential information of the Owner and that it will not disclo.se its conclusions in whole or in part to any person whatsoever, other than to submit its written documentation to the Owner, and will only discuss the same with it or its authorized representatives. Upon completion of this agreement term, all documents, . reports, maps, data and stlldies prepared by the Consultant pursuant thereto shall become the property of the Owner and be delivered to the Director of Public Works & Engineering. See attached Augusta, Georgia Request for Proposal (Exhibit A) The Scope of Services shall be subject to limitations outlined in the Consultants Technical Approach to the Owner's RFP and the associated fee (Exhibit B). Any conflicts between the requirements identified in the Augusta Request for Proposal, State of Georgia applicable rules & guidance docuinents and the engineer's proposal should be brought to the attention of the Director of Public Works and Engineering immediately. Resolution shall be decided using the sole discretion of the Director of Public Works and Engineering. The following items have been identified that were not included in the Consultant's Technical Approach and are required by the Owner: Groundwater Quality Assessment - The Scope for this work is attached as (Exhibit B). Conceptual Design Phase The Amount of Contract includes this additional item not included in the original Consultant's Technical Approach or fee. This item will be performed as part of the Site Acceptability Phase ofthe project. A. The Consultant shall prepare 50 scale conceptual design plans on recent topographic survey to be approved by the Environmental Engineer for presentation and approval by the Owner. The concept plan shall be submitted to the Owner for review within 30 days of completion of new topographic survey map. After review by the Owner, the Consultant shall make any and all revisions to the concept. B. Conceptual plan shall include, but not limited to, landfill phases, fill sequence, access roads, stormwater management features, cover borrow area, leachate holding area and equipment/machinery storage/parking area. C. Introduction and Background Augusta-Richmond County currently owns approximately 1,177 acres southwest of Augusta, Georgia, which is the site of the existing Deans Bridge Road MSW Landfill. The landfillcurreritIy accepts 500 to 700 tons per day of municipal solid waste from private collection vehicles. Active and closed sections of the landfill comprise approximately 130 acres of the total property. Some additional acreage contains ancillary facilities 'such as office and maintenance buildings, sediment ponds, roads, leachate holding facilities, etc Augusta-Richmond County is seeking proposals from qualified professional engineering firms with experience in performing landfill site acceptability studies and landfill design services in the State of Georgia. These services shall be performed in accordance with Circular 14 published by the EPD, Georgia Geologic Survey and with Chapter 391-3-4 of the EPD Rules and all applicable guidance documents for Solid Waste Management. The area for the site acceptability study and subsequent design contains approximately 600 acres and is located east of the Phase II-C disposal area and south of Spirit Creek A map of the area is attached. The land is largely forested with a portion of the property disturbed for soil borrow areas for landfill operational cover. II. Project Requirements A. Project Scope of Services Augusta-Richmond County requ.ires the services.of a professional engineering consultant to provide professional engineering services for this landfill project. The selected consultant will provide engineering services required for the design and permitting of the expansion to the Deans Bridge Road MSW Landfill. The selected consultant will provide minimum of three ,hard copies and one electronic copy of all submittals including supporting data & calculations to Augusta-Richmond County for owner use. This is in addition to EPD submittals. Professional services required for this project include: Topographic Mapping o Topographic mapping suitable for the technical evaluation and design' of the expansion area shall be prepared. Mapping shall include 2-foot contour intervals, location of drainage features; roads, utility easementS and easily identifiable utilities and shall be tied to the existing boundary survey. Mapping prepared using aerial photogrametric methods shall be field verified utilizing ground run survey. This is in addition to EPD submittals. B. Utilities There is no water or electricity on the undeveloped portions of the landfill property, however, water (in limited quantities) and power is available at the landfill offices and arrangements should be made to obtain the necessary utilities. C. Schedule The anticipated start date for the project is November 15, 2000. A detailed project schedule is required in the proposal to exhibit project understanding and conformance with this operational deadline. D. Standards 1. Topographic surveying and mapping shall be in accordance with National Mapping Standards with topographic information prepared with' 2-foot contour intervals. No areas shall have assumed elevations and any mapping prepared by aerial photogrametric methods shall be verified by ground-run surveying. 2. Wetland delineations and permitting activities shall be accomplished through a coordinated effort with the U.S. Army Corps of Engineers. 7. Design and permitting, activities shall be conducted under the direct supervision of a registered professional in the state of Georgia in the applicable discipline (i.e., engineering, surveying, geology). 8. Work shall be in accordance with applicable federal, state and local requirements. III. Professional Engineering Qualifications . Qualifying professional engineering firms, must demonstrate experience in conducting site acceptability studies and municipal solid waste landfill designs in the State of Georgia. References shall be provided to verify project experience. . Firm insurance certificates showing minimum professional liability coverage of $2,000,000. IV. Proposal Format The proposal shall be organized into the following sections providing sufficient detail to address the RFP requirements. A. Firm Overview Provide firm's capabilities and overview. Shall include fum's history including years of service, office locations, executive officers, and services offered by the firm. B. Project Team Provide firm's propo:;ed project team, individual responsibility, team organization, work experience (resumes) and firm's general business background. Subcontractors proposed for performing project tasks must be identified in the proposal for review. Topographic Survey · TE, under subcontract to]] &G, will provide an aerial survey of approximately 600 acres to be used for expansion of the County's Deans Bridge Road MSW Land till, including photo control as needed. Addi- tionally, TE \vill provide horizontal and vertical co- ordinates for boreholes located within the project area. · Survey data ,vill be provided on Georgia State Plane Coordinates based on NAD 83 horizontal and NAVD 88 vertical datum. · Boundary information \vill be compiled from an existing plat and integrated into the aerial topographic map. i\ sufficient number of property corners will be tied into the survey control to ensure the proper insertion of the compiled boundary information. · A topographic map with two foot contour intervals will be produced using a new "fly over". Easily iden- tifiable drainage features, roads, and utilities will be shown subject to their aerial visibility. Utility ease- ments will be compiled from available boundary plats and county records. 1\ large part of the project is fores ted, which ,,,ill result in significant obscured ar- eas where the accuracy of the aerial topographic map \villnot meet the same accur:lcy as a ground run to- pogr:lphic survey. In densely \vooded areas, the er- ror could be as much as twice the contour interval. It will not be feasible to field run all of the obscured are:1S and revise the :1erial topogrJphic map accord- ingly. While every effort will be made to ensure the quality of this product, it should be understood that unavoidable Limitations arc inherenr in aerial map- ping of highly vegetated and forested areas. The aerial map \vill be sufficient for site suitability and preparation 0 f the 0&0 plan. · .'\ field run topo will be prepared for :l cons tructiblc level of accur:lcy on the initial cell that is assumed to be approximately 15 to 20 acres in size. Site Acceptability Study Geological Evaluation/Hydrogeological Study i\ site-specitic investigation of subsurface conditions constitutes a significant portion of the site acceptability study. The investigation \vill be performed to eV:lluate geologic conditions, perform geotechnical sampling to suPPOrt the facility design, and characterize the site hydrogeology. Qore, under subcontract to JJ&G, will provide soil boring and laboratory services. The inves- tigation will be planned and implemented in :lccordance with CPO Guidance Criteria for Performing Site Ac- ceptability Studies for Solid Waste Landfills in Georgia (Georgia Geological Survey - Circular 14; 1997). A well-planned and implemented investigation will be especially important for the proposed expansion, be- cause the site is located near signific:lnt recharge areas for the Cretaceous-Tertiary aquifer systems of Georgia. ..-.------.-------..-..---------.------------...------~---_.__._--'.. The County proposed expansion site is underlain by sands, silts, and clays of the Huber and Gaillard Forma- tions of Tertiary and Cretaceous age (Georgia Geologi- cal Survey, 1996). The surficial or uppermost aquifer was renamed from the Huber Formation to the Snapp Formation. The renaming was based on the presence of a distinctive kaolin and sand formation, which un- derlies the Savannah River Site in South Carolina. The Snapp Formation (uppermost aquifer) is underlain by the Gaillard Formation. The Gaillard Formation contains two permeable zones and t\'lO confining zones that are laterally extensive in Southern Richmond County. The site inves tigation will be limited to the uppermost aquifer, the Snapp Formation, and characterization of the Gaillard Formation \'lill not be required. JJ&G's approach to the site acceptability investigation includes the follQ\,,-ing activities: · I\dvancing :lnd soils sampling in 24 borings distrib- uted across the site. The information and data ob- tained from this activity will be used ro obtain EPO- required geological and geotechnical engineering in- formation about the site. Figure 1 shO\'ls the ap- proximate location of the proposed borings. Final locations will be determined based on site access and conditions. · The borings \,,-ill be completed to a depth of about 50 feet in order to investigate the unsaturated zone soils, to characterize the upper 20 feet of the satu- rated zone uppermost aquifer, and to measure the depth of ground\vater, · Standard penetration tests will be conducted during drilling of the 24 borings. Samples will be collected at 5-foot intervals. One undisturbed sample will be attempted in each boring. The borings will be ad- vanced through the soil to at least 20 feet below the water level observed during drilling or to auger re- fusal. If auger refusal is encountered before ground- \vater, at least 10 feet of N\V or NX coring will be incorporated to determine the underlying type of rock (if auger refusal is encountered \'lithin 20 feet of the groundwater table, coring \'lill be extended until 95-percent core recovery). Based on JJ&G's understanding of the site geology, bedrock is not expected ro be encountered in the borings, and there- 4-2 fore c<?ring is not included in the scope of services or in the estimated costs. · A temporary piezometer, consisting of 2-inch diam- eter PVC casing and screen, ftlter sand, and bento- nite seals, will be installed in each borehole. After the groundwater level in each piezometer has stabilized, an in-situ hydraulic conductivity test \vill be conducted in 12 of the piezometers. The completed piezom- eters will be surveyed to establish horizontal control and ekvation. · The soils and rocks encountered during drilling will be visually described in the field and noted on bore- hole logs. Representative soil samples \"ill be selected from the borings and submitted for index testing in the laboratory. · Laboratory tests \,,-ill be conducted on selected soil samples to evaluate soil gradation. i\ permeability test will be conducted on 2-1- undisturbed soil (Shelby tube) samples. An average of one undisturbed sample per boring will be tested, although not necessarily one sample from each boring. Up to 24 cation ex- change tests also will be performed. · It is assumed that this field program can be com- pleted within 30 \'lorking days and that the drill sites can be accessed by an ATV drill rig. It also is as- sumed that any clearing required \vill be provided in advance by the County, · The study will be conducted under the technical di- rection of a professional engineer/geologist regis- tered to practice in Georgia. The engineer/geologist also will sign and seal the report. The report will include calculations presenting linear groundwater ve- locities, travel time ro potential receprors, and the pollution susceptibility rating for the developed site, all as required by the EPO Guidance in Circular 14. Three copies of the report will be provided to the Coun ty. Ecological Studies JJ&G's review of the proposed expansion site indicates that the majority of the expansion is located within up- land areas. There are several drainage areas on site, how- , ... . ;: . . ever, and it is likely that there also are some \vetlands associated with these doinages. Wetlahds and stream areas arc regulated under Section 404 of the Clean Wa- ter Act. Recent revisions to the Natiol1\..ide Permit Pro- gram of Section 404 have lowered the upper threshold limit for nationwide permits to 0.5 acres of wetland and 300 linear feet (If) of jurisdictional waters. JJ&G considers it likely that these thresholds will be exceeded and that an Individual Permit under Section 404 will be required if maximum landfill volumes arc to be ob- tained. JJ&G will make every effort to avoid the re- quirement for an Individual Permit, and will discuss the options during development of the conceptual site plan. Our proposal includes all of the studies that arc neces- sary to prepare and obtain an Individual Permit from the ACOL~. If our on-site studies should indicate that the impacts arc within the thresholds allowable under the Nationwide Permit Program, thm our effort asso- ciated with this task would be subst~ntially reduced. In order to obtain an Individual Permit,JJ&G proposes to conduct a protected species survey, a survey of wet- lands :lnd stre:lm jurisdictional areas, obtain ACO E con- currence on the jurisdictional determination, conduct a cultural and archeological resources survey, and prepare and submit an Individual Permit i\pplicuion to the I\COE. The work to obtain an Individual Permit will begin with office studies to narrow the scope of the field survey, continue with field surveys, and conclude with prepar:ltion 0 f the written documen tation and preparation of the permit applic:ltion. These steps arc described in more detail in the follo\\'-'ing p:lragr:lphs. Ecological Office Studies Desktop studies of resources to identify potential juris- dictional wetland and stfe:lm areas and protected spe- cies hab,itat within the project area will be completed prior to field studies. These studies \..ill include revlew ot- topographic maps, :lppropriate literature, and avail- able aeri:ll photography. A protected species table that includes species, conservation status, and preferred habi- tat will be prepared prior to the field studies. The pro- tected species list will include any federal- or state-listed species known to occur in the project area. Protected Species Survey Information gathered during the office studies will be used to assist in conducting the field surveys. Survey methodologies will vary depending on which protected species are known to occur within the project area. Potential protected species habitat will be mapped while in the field. Wetlands Jurisdictional Studies )) &G will perform studies to deline:lte and to classify jurisdictional \veciands and waters of the United States, as required in the three-parameter methodology out- lined in the 1987 Federal Manual. This methodology is required by the ACO I": to identify jurisdictional areas and to satisfy Section 404 permit requirements. The following tasks ",ill be performed: · Identify all wetland boundaries using wetland flag- ging. The boundaries of each wetland will be drawn on the field map. · Identify all jurisdictional waters :lnd take width mea- surements of :werage high water for every water. Indicate jurisdictional water locations and extent on the field map. For purposes of the field verification visi t \vith the i\CO E, the "head" of each jurisdic- tional water will be m:lrked with flagging tape. · TE \..ill survey the location ot all jurisdictional bound- aries. To assist the survey crew with 'locating the wetland boundaries, a ))&G representative' will per- form a one-day site reconn:liss:lnce with the survey party chief. · Complete field data forms for each separate juris- dictional system and upland habit:lts adjacent to each wetland data point. Vegetation, soils, and hydrology will be documented on the data forms. Technical Memorandum ([tv!) will be prepared fol- lowing the field studies. Information provided in the Ti\I will include a discussion of jurisdictional areas, study results for protected species, anticipated Section 404 permit requirements, and state and county stream buffer reqUlrements. ACOE Jurisdictional Determination Following completion of the delineation effort, a juris- dictional determination request will be submitted to the North Area Section f\COE office. The purpose of this request is to gain the 1\COI:':'s concurrence \"ith jurisdic- tional boundaries, as idcntified by]]&G. The jurisdic- tional rcquest will include a field run survey of jurisdic- tional areas. Because of the nature of this project, it is likely that the i\COE will conduct a field visit. This scope includes a one-day field visit \"ith the i\CO E rep- resentative for this area. ACOE Individual Permit ,\s stated previously, a review of the proposed cxpan- sion site indicates that the majority of the development is located within upland areas; however, several drain- age systems (waters of the United Statcs) appear to bc on the site. I t is unknown at this time if jurisdictional wctlands occur on the property. Because of the rc- cently reviscd Nationwide Permit program (which sub- stantially reduced impact thresholds for wctlands and watcrs), it is assumed that proposed sitc impacts to ju- risdictional arcas would cxceed thc Nationwidc Pcrmit program limits (0,5 acrc of wctlands and 300 linear feet of jurisdiccional waters). Thercforc, this task includes obtaining an lndi\'idual Permit from the ACOE. In association with the Individual Permit, a 401 Watcr Quality Certification would be obtained from EPD. An Individual Permit application will be prepared for submittal to the i\CO E. The permit application will include the standard permit form and a supplemcntary letter rcport. The rcport will include dctailed informacion pertaining to project need and purposc, altemacives analy- sis, proposed impacts, and other rcquired information. Impacts to jurisdictional areas ""ill require compensa- tory mitigation. The permit application must include a conccptual mitigation plan, which will be preparcd by 4-4 ]]&G. As a general rule, mitigation is conducted at a 3:1 ratio (mitigated area to impacted area). The extent of required mitigation will not be kno\vn until proposed impacts are known. It is likely that proposed mitigation will be a combination on-site and off-site effort. On- site mitigation opportunities will be identified following detailed review of the site layout and coordination with the County. Off-site mitigation could be required to supplement the on-site efforts. If necessary,]] &G will conduct an of- fice and field review to identify potential off-site mitiga- tion areas. This scope includcs an office scarch of avail- able off-site areas and four days of field rcvicw: In addition to the field revicw, other potential mitigation avcnues, such as use of a mitigation bank and in-lieu fees ",ill be reviewed. i\ memo describing the selected mitigation sitcs will be prepared for client revie\,,: Next, a conceptual mitiga- tion plan will be prepared for inclusion in the permit application. Once the application is complete and submitted to the 1\CO L~, they will issue a public notice that \vill go to all adjacent property owners, resource agencies, and the 1\COE's general mailing list for individual Permits. The public notice period is 30 days. Relevant comments received by the i\COE must be addressed for the per- mit process to continue. We \vill prepare these responses for the County's review prior to submitting to the 1\CO E. It is likely that a site visit ",ill be rcquested by resourcc agcncies. Our proposal includes two site visits and three additional agency meetings. [f the /\COE receives sufficient comments from the general public opposing the project, a public meeting could be required. Because thc ACOE has had only one public mceting for an Individual Permit in the last six years, we do not anticipate this will be an issue for this project. EPD Stream Buffer Variance The EPD requires a minimum 25-foot buffer on all state waters. Impacts within the 25-foot buffer require obtaining a strcam buffcr variance from EPo. Prior to submitting a variance application to EPD, coordination must bc conducted with the local issuing authority. J ",~ It , f ..' J' . The issuing authority must provide a letter stating that they are aware of the proposed buffer encroachment and the authority must approve the erosion and sedi- ment control plans for the project. Once these two items have been obtained, a variance application can be submitted to EPD. Should the proposed encroach- ment occur along a blue-line drainage, as shown on the applicable United States Geologic::tl Service topographic map, a 30-day public review period will be required. We \vill prepare and coordinate the '.:ariance applica- tion. In addition, \ve \vill assist in the development of the erosion and sediment control plans. This assistance will primarily include review of the type and location of silt fence to be installed and required notes, It should be noted that the I~PD currently is proposing revisions to the buffer variance process. If these revi- sions are incorporated as proposed, the effort required to obtain a variance \vill be significantly increased. This scope assumes that the variance will be obtained through the existing variance process, Cultural Resources/Archeological Investigations l3ecause a Section 404 Individual Permit is anticipated tor this project, a formal survey of cultural and archeo~ logical resources \\-ill be required. A Phase I archeologi- cal survey will be conducted by SAS under subcontract to JJ&G. The goal of the survey is to locate all archeo- logical sites that might be on the tract and to evaluate the, significance of each. The archeological survey will en- sure that the County is in compliance'\vith federal regu- lations concerning the identification and protection of significan t cultural resources. The survey \\--ill include a review of pertinent background information (archeological reports, old maps, old aerial photographs, etc.), fieldwork by four archeologists, analysis of the artifacts, and preparation of draft and final reports. During fieldwork, numerous small diam- eter (30 centimeter) shovel tests will be excavated to locate archeological sites and define their limits. Site Acceptability Report i\ Site Acceptability Report will be compiled by JJ&G to present the results of the previously described work to EPo. -10 compile this report, JJ&G will: · Obtain letter verifying that the site complies with lo- cal zoning and land use ordinances and the solid waste management plan, if any, as required by o.C.G.A. 12- 8-24(g). · Complete a solid waste permit application. · Prepare a conceptual design of the expanded landfill. · Assemble these documents and the results of the geological, geotechnical, hydrogeological, archeologi- cal, and wetbnds evaluations into a single Site Ac- ceptability Report. · Present report to the County. · Present report to EPD for review and approvaL Design and Operational Plan Utilizing the design parameters identitled in the Site Ac- ceptability Report and the Conceptual Design, JJ&G will prepare a 0&0 Plan for the site. This plan, at a minimum, \\--ill include: · Landfill liner and leachate collection system design, including alternate leachate collection evaluation and design; leachate recirculation evaluation and design; leachate storage design compatible with future treat- ment necessity; and leachate disposal system design (from storage) \vith options to haul off site, and dis- charge directly to a designated trunk line located near existing disposal section. (Note: An alternative liner design can not be used at this site because it is lo- cated in a significan t groundwater recharge area,) · Erosion control and stormwater management design. · Erosion, Sedimentation, and Pollution Control Plan as required under National Pollutant Discharge Elimi- nation System (NPDES) Permit for Stormwater Dis- charges Associated with Construction Activity. Public Participation Assistance The proposed expansion will be termed a modification to the facility's existing permit, but all elements of pub- lic participation for a new permit \vill be required by EPD. JJ&G \vill provide the following services for this task: 4-6 · Participate in a Needs Meeting and Site Selection Public Meeting as required by o.c.G.A. 12-8-26 and assist \vith preparing and distributing a notice for these meetings. These meetings can be held jointly for this project. · Prepare Public Notice of Submission of Applica- tion for permit as required by o.C.G.A. 12-8-32(a). · Participate in a Site Suitability/Facilities Issues Nego- tiation Process Notice Meeting as required by o.c.G.i\. 12-8-32 and assist with preparing and dis- tributing a notice for this meeting. · Participate in the Final Public Hearing in accordance with Section 12-8-24(d) of Georgia Solid Waste Management Rules and assist \vith preparing and dis- tributing a notice of this hearing. · JJ&G has assumed that there will not be f:1cility is- sues negotiation meetings. If meetings arc required, JJ&G will participaEC, if desired, on an hourly basis. Construction Plans Preparation of Construction Drawings, Contract Documents, and Specifications · Prepare construction drawings, contract documents, and specifications for the construction of the first cell of the Iandftll expansion, as shO\vn on the new 0&0 Plan. · It is assumed that the initial cell construction \vill con- sist of approximately 20 acres. · It is assumed that the construction plan \\lill consist of 8 drawings for the area.
