AGREEMENT
THIS AGREEMENT made as of the t..j VII day of S-eplemiQ! rOO 1 by and
between: New Zion Hill Missionary Baptist Church, with its place of business at 3237-112
Deans Bridge Road, Augusta, Georgia, 30906 (hereinafter referred to as lithe Church") and
Augusta, Georgia, a political subdivision of the State of Georgia, with its place of business at
530 Greene Street, Augusta, Georgia, U.S.A., 30911 (hereinafter referred to as "Augusta ").
WHEREAS, the Church and Augusta is desirous of pro-rated, cost sharing
Agreement relating to a fire hydrant/water lin~ project along Deans Bridge Road, Augusta,
Georgia to serve the New Zion Hill Missionary Baptist Church hereafter referred to as "the
Agreement" .
Now, therefore, in consideration of the covenants, conditions, and agreements
herein contained, the parties agree. as follows:
The Church hereby agrees to pay to Augusta the sum of Five thousand dollars
($5,000.00) in the following manner:
The Church shall make an initial payment to Augusta in the amount of One
thousand dollars ($1,000.00) representing twenty percent (20%) of the total amount by
October 20,2002. Thereafter, the Church shall pay the remaining balance of Four thousand
dollars ($4,000.00) in equal installments over a sixty- (60) month period.
The Church will make payments in the amount of Sixty-six doIlars and sixty-
six cents ($66.66) every month for 59 months and one final payment the month thereafter in
the amount of Sixty-seven dollars and six cents ($67.06) until said amount is paid in full. The
payment shall be due on the 10th day of each month. The Church will begin making said

payments on November 10,2002 at Augusta Utilities, 360 Bay Street, Suite 180, Augusta,
Georgia 30901.
Augusta will provide fire hydrant/water line along Deans Bridge Road to serve
the Church.
The Agreement is freely entered into without coercion from either party and
with the mutual consent of all parties.
This Agreement shall be governed by and construed in accordance with the
laws of the State of Georgia. All claims; disputes and o~her matters in question between the
Church and Augusta arising out of; or relating to this Agreement, or the breach thereof, shall
be decided in the Superior Court of Richmond County, Georgia. The New Zion Hill.
Missionary Baptist Church, by executing this Agreel11ent, specifically consents to venue and
jurisdiction in Richni.ond County, Georgia and waives any right to contest jurisdiction and
venue in said Court.
All notices hereunder shall be in writing and shall be duly given if delivered
personally or sent by registered or ceIiified mail, return receipt requested, postage prepaid, to
the respective addresses ofthe parties appearing on page one of this Agreement. Any notice
, given shall be deemed to have been received on the date, which it is delivered if delivered
personally, or if mailed, on the fifth (5th) business day next following the mailing thereof.
Either party may change its address for no!ices,by giving notice of such change.

This Agreement represents the complete ,md exclusive agreement between the
parties with respect to the subject matter hereof and supersedes all prior agreements,
negotiations, discussions, or understanding between them with any way relating thereto.
IN WITNESS WHEREOF, this Agreement has been read, understood, and
signed by duly authorized officials of New Zion Hill Missionary Baptist Church and Augusta,
Georgia.
