SUBORDINATION AGREEMENT
COUNTY OF RICHMOND
THIS AGREEMENT, made and entered into this If day of
~tW(..la~ ' 2ooL, by and between AUGUSTA, GEORGIA, a political subdivision of
the Stat of Georgia (hereinafter referred to as "AUGUSTA"), and "MERS"
MORTGAGE ELECTRONIC REGISTRATION SYSTEMS, INC., A DELAWARE
CORPORATION, (hereinafter referred to as "BANK");
WITNESSETH:
WHEREAS, RA YMON SPANN and LINDA WASHINGTON SPANN
(hereinafter referred to as "OWNER") on July 7,2005 gave to AMERICA'S CHOICE
MORTGAGE, INC. a Security Deed to the property described on Exhibit A, to secure a
certain indebtedness to BANK and said Security Deed is recorded in the Office of the
Clerk of Superior Court of Richmond County, Georgia, in Realty Reel 1001, page 970.
Said Security Deed was subsequently assigned to UNION FEDERAL BANK OF
INDIANAPOLIS by Assignment of Security Deed dated July 7,2005 and recorded in
said Clerk's Office in Realty Reel 1 026, Page 2079. Said Security Deed was
subsequently assigned to BANK by assignment of Mortgage/Deed dated April 14, 2006
and recorded in said Clerk's Office in Realty Reel 1052, Page 2421.
WHEREAS, OWNER has granted an Easement dated f, UlO to
AUGUSTA across the property described in Exhibit A, the original ofw ich is to be
recorded in the Office of the Clerk of Superior Court of Richmond County, Georgia; and
WHEREAS, BANK is willing to subordinate the lien of its said Security Deed
dated July 5, 2005 and recorded in the Office of the Clerk of the Superior County of
Richmond County, Georgia, in Realty Book 1001, Page 970 and subsequently assigned to
UNION FEDERAL BANK OF INDIANAPOLIS by Assignment of Security Deed dated
July 7,2005 and recorded in said Clerk's Office in Realty Reel 1026" Page 2079 and
subsequently assigned to BANK by assignment of Mortgage/Deed dated April 14, 2006
and recorded in said Clerk's Office in Realty Reel 1052, Page 2421 to any interest
AUGUSTA may have in the above reference easement.

NOW, THEREFORE, in consideration of the premises and the mutual convenants
and promises hereinafter contained and the duties to the undertaken, BANK does hereby
agree and declare that the lien of the Security Deed from OWNER to BANK, dated July
7,2005, recorded in the Office of the Clerk of the Superior County of Richmond County,
Georgia, in Realty Book 1001, Page 970 and subsequently assigned to UNION
FEDERAL BANK OF INDIANAPOLIS by Assignment of Security Deed dated July 7,
2005 and recorded in said Clerk's Office in Realty Reel 1026, Page 2079 and
subsequently assigned to BANK by assignment of Mortgage/Deed dated April 14, 2006
and recorded in said Clerk's Office in Realty Reel 1052, Page 2421, is and forever shall
be subject, subordinate and inferior in lien right and dignity at all times to the easement
from OWNER to AUGUSTA which is to be recorded in the aforesaid Clerk's Office,
WHERFORE, BANK has caused this instrument to be executed by its duly
authorized officers and seal affixed, all on the date above first written.

All that lot or parcel of land with improvements thereon situate, lying and being in the
State of Georgia, County of Richmond, being known and designated as lot 125, Block A,
Phase II, Sand Ridge Estates Subdivision as shown on a plat thereof recorded in the
office of the Clerk of the Superior Court of Richmond County, Georgia, on Realty Reel
471, pages 1992-1997; reference is hereby made to said plat for a more complete and
accurate description as to the exact metes, bounds, dimensions and location of said
property.
