AS NOMINEE FOR SUNTRUST MORTGAGE, INC., (hereinafter referred to as "BANK"); WITNESSETH: WHEREAS, PETER D. COOPER (hereinafter referred to as "OWNER") on June 2, 2006 gave to BANK a Security Deed to the property described on Exhibit A, to secure a certain indebtedness to BANK and said Security Deed is recorded in the Office of the Clerk of the Superior Court of Richmond County, Georgia, in Realty Reel 1060, page 1324. WHEREAS, OWNER has granted -"an Easement dated J;~AA.&\"'/"~ L 5 , tco,t to AUGUSTA across the property described on Exhibit A, the origina of which is to be recorded in the Office of the Clerk of the Superior Court of Richmond County, Georgia; and WHEREAS, BANK is willing to subordinate the lien of their said Security Deed dated June 2, 2006 to any interest that AUGUSTA may have in the above referenced easement. NOW, THEREFORE, in consideration of the premises and the mutual covenants and promises hereinafter contained and the duties to be undertaken, BANK does hereby agree and declare that the lien of the Security Deed from OWNER to BANK, dated June 2, 2006, and recorded in the Office of the Clerk of the Superior Court of .', .J Book 01161 :1652 Augusta - Richmond County 2008004040 01/28/2008 15:44:56.00 Richmond County, Georgia in Realty Reel 1060, page 1324, is and forever shall be subject, subordinate and inferior in lien right and dignity at all times to the easement from OWNER to AUGUSTA which is to be recorded in the aforesaid Clerk's Office. Reference is hereby made to said plat for a more complete and accurate description as to metes, bounds and location of said property. Said property is conveyed subject to any and all applicable easements, restrictions and covenants recorded in aforesaid clerk's office.
