lYIutual Firefighting Assistance Agreement I
This mutual agreement entered into this ~ ~ day of mctrc~ , 200:L-between Martinez Fire Department, Inc.
and Augusta-Richmond County Fire Department. Whereas, it is deemed to be in the public
interest to execute a Mutual Firefighting Assistance Agreement wherein each of the fire departments assist the
others in a major firefighting effort.
THEREFORE, in coside:ration of the mutual benefit to be derived by both the Martinez Fire Department, Inc.
and the Augusta-Richmond County Fire Department, it is hereby agreed.
1. SERVICE: In the event of a major fire or other incidents that develop within either department's responsibility, personnel
and/or equipment will be dispatched to the scene by the second department respectively.
2. REQUESTING ASSISTANCE: Assistance under this agreement may be requested or authorized by the Department
Chief, Assistam Chief, or their appointed representative.

3. SCOPE OF AUTHORITY: The Fire Chief shall bear the authority for directing all activities within his protection
area.
4. COST: No compen:;ation will occur or become due for any set:Vices rendered under this agreement.
5. RESPONSIBILITY AND LIABILITY:
A. Neither organization will assume responsibility or liability for damages to property as a result of firefighting
activities made at the request of the other organization.
B. If circumstances change during the fighting of a fire to the extent that it is necessary to recall personnel and
equipment from the scene to answer a call elsewhere, that action is not to be considered a breach of this
agreement.
6. DAMAGE TO EQUIPMENT: No liability is assumed by either party of damage to the equipment used by the other
party.
7. DEATH OR PERSONAL INJURY: Each party hereby waives all claims against the other party for compensation
for any loss, damage, personal injury, or death occurring in consequence for the performance of this agreement.
8. TERMINATION: Either party of this agreement may terminate this agreement at any time by giving thirty (30) days
written notice to the other party and no services will be rendered by either party after the effective date of
termination.
