AGREEMENT

THIS AGREEMENT is made and entered into this ;;.. <r

2002, by and between MAaf Academy. This agreement will remain in effect thru December
31, 2002; thereafter, this agreement shall be on a year to year basis beginning January 1st of
each year and terminating on the 31st day of December of each year, and will automatically
renew on a year-to-year basis. Either party hereto, however, may terminate this Agreement
by giving to the other party a notice in writing of not less than 30 (thirty) days, said notice to
be forwarded by certified mail, return receipt requested, to the parties at the following
respective addresses.
WHEREAS, the MAaf Academy has identified a 'desire to staff and provide
programs for Fleming Tennis Center; and
WHEREAS, MAa-I Academy has determined that it would be to benefit of the
taxpayers of for the MAaf Academy and Augusta Recreation and Parks Department to
jointly operate the Fleming Tennis Center;
NOW, THEREFORE, for and in consideration of the mutual promises and the
covenants contained herein, and other good and valuable consideration, the receipt and
sufficiency of which is hereby acknowledge, the parties agree as follows:
A Responsibilities of MAaf Academy
The MAaf Academy shall provide adequate staffing of Fleming Tennis
Center, which shall include the following features:
1. Hours of Operation - 2:00 P.M. - 5:00 P.M., Monday - Friday,
weekends as needed for scheduled tournaments and events.
2. MAaf Academy will be allowed to use three teaching courts during
the season lights are necessary. The remaining lighted courts
authorized for use will be open to public.

MAGI Academy shall provide staff f~r all h~urs of operation at
facility and follow the guidelines provided by the Augusta Recreation
and Parks Department, and shall have all volunteer staff execute and
keep on a file a Volunteer Release Form and complete the Criminal
Background Check Fonns. (see attachments)
4. MAGI Academy shall issue keys for Fleming Tennis Center to
members and officers of MAGI Academy and supply a list of people
issued to Augusta Recreation and Parks Department.
5. MAGI Academy shall maintain an inventory of all supplies furnished
by the Augusta Recreation and Parks Department of Fleming Tennis
Center and shall perform general maintenance of the interiorl exterior
of Fleming Tennis Center pro shop and restrooms, which includes
mopping, sweeping, and picking up their litter from grounds. (See
Staffing Requirements Attachment).
6. All revenues received by MAGI Academy's lessons will be on 80/20
basis and MAGI Academy must keep up with money generated by

receipts and records of participants receiving lessons. The Recreation
and Parks Department will be issued a check for 20% of revenues of
lessons at the end of each month.
7. MAGI Academy shall formulate programs, aCtiVitieS, and
tournaments for the Fleming Tennis Center as well as maintain ae
current safety inspection of all existing court equipment. In the event
that any equipment is deemed unsafe, that equipment must be
properly labeled unsafe and Recreation personnel must be contacted
immediately.

MAa-I Academy must follow all safetY guidelines set forth by the
Augusta Recreation and Parks Department which include notifying
the Augusta Recreation and Parks Department immediately in the
following cases: break-ins, property damage, or emergencies.
MAa-I Academy shall be covered under the Volunteer Protection
Act of 1997,42 U.S.C 14501, et seq. (See Attachment)
Responsibilities of Augusta Recreation and Parks Department
The Augusta Recreation and Parks Department shall be responsible
for assisting MAa-I Academy in the operation of Fleming Tennis
Center as follows:
Supply all utilities (excluding lights for the back three courts).
Perform all repairs and nonnal maintenance for the upkeep of the
facility (painting, pesticide treatment, mowing grass, etc.).
Provide for trash collection from existing canister on grounds weekly.
Supply nets, wind screens, seating and janitorial supplies as budgeted
and approved by Augusta Commission.
Supply all capital purchases, as needed depending on funding.
Provide for a>R!First Aid Training for volunteer staff.
Assume responsibility for repairs of building in the event of break-ins
and other emergency situations that mayarise.
8. Assume responsibility for liability as provided ill the Volunteer
Protection Act to MAa-I Academy.
The Augusta Recreation and Parks Department shall also provide the following

TIlls Agreement contains the entire agreement of the parties, and no representations,
inducements, promises or agreements, oral or otherwise, between the parties not embodied
herein shall be of any force or effect.

ATTACHMENT
ST AFFING REQUIREMENTS:
MAa-I Academy must supply staff members that meet the following qualifications:
. Certified aR and First Aid:
· Desire and knowledge of practices and principals needed to develop activities for
children and adults:
· Oerical skills that involve maintaining records pertaining to program registrations, supply
inventories, rental contracts, user fees and other facility charges and information;
. Supervise programs for children.
· Have executed a Volunteer Release Form, in the form attached hereto.
· Must clear the requirements set forth in the criminal background check policy for
volunteers.
GENERAL SUMMARY
It is the responsibility of MAa-I Academy to coordinate and monitor activities held
at Fleming Tennis Center within departmental and aty guidelines. Also, it is essential for
MAa-I Academy to work with instructors, program participants, community leaders, civic
organizations and the general public to ensure programs and services.

I understand that I have a right to; (1) obtain a copy of any background check report, and (2) challenge the
accuracy and completeness of any information contained in any such report. I also understand that I may be

Criminal Background Checklist
Youth Services Volunteer
I. All volunteer applicants must consent to a Criminal Background Check before being assigned to a
program.
n. Only the authorized staff person may take the completed forms to the Sheriff's Department for the
report to be administered and pick them up.
m. The Criminal Background Report will be reviewed and the following procedures will be
implemented:
A) Review of the Criminal Background Report for the following convictions with applicable
course of action: .

B) Should any of the convictions appear on the report, the follo'Ni.lg procedures
will apply:
1. The individual will be suspended and have no contact with the program until the issue
is resolved.
2. The appropriate staff will call the individual to set up a meeting to discuss the
issue, to be held within two (2) days of notification.
3. Should an'/ c.f the convictions listed in Section III-A show up on the Criminal
Background Che<:k and be confinned as accurate, a certified letter will be sent
to the applic.mt for official notification of the ruling lS it applies to the checklist.
