AGREEMENT FOR LOCAL GOVERNMENT EFFICIENCY GRANT FUNDS
THIS AGREEMENT, made and entered into this 3rd day of October, 1995, by and
between the Georgia Department of Community Affairs, hereafter referred to as the
"Depamnent," and City of Augusta, an eligible local government unit under the Local
Government Efficiency Grant Program, hereafter referred to as the "Recipient."
WHEREAS, the State of Georgia is interested in promoting efficient delivery of services
by Georgia's municipalities, counties and authorities; and
WHEREAS, the Georgia General Assembly, in promoting the efficient delivery of local
government services, enacted the Local Government Efficiency Act; and
WHEREAS, said Act provides for a grant program to be administered by the Department
as contained in D.e.G.A. Sec. 36-86-4, and such responsibility is consistent with the powers and
duties of the Department as specified in D.e.G.A. Sec. 50-8-8; and
WHEREAS, certain funds were appropriated by the General Assembly for the purposes
set forth herein; and
WHEREAS, Recipient warrants that it has the authority to expend monies for the
purposes set forth herein:
NOW THEREFORE, for and in consideration of the covenants and agreements
contained herein, the panies hereto agree as follows:
1. SCOPE OF PROJECT. The Department agrees to grant, and the Recipient
accepts, the sum of $247,000 to be used by the Recipient for the purposes specified in
Attachment A, which is incorporated by reference and made a part of this Agreement. Any
changes to the scope of the project, including amount of funds expended, must receive prior
approval from the Department in writing. The Recipient agrees that said grant funds will not be
used for expenses already incurred or paid by the Recipient. In addition, the Recipient certifies
that local match shall equal at least 25 percent of the grant amount.
2. ACCOUNT ABILITY. The Recipient agrees to expend the funds specified
herein for the purposes stated, and to account for the funds in accordance with generally accepted
accounting principles. Any funds not expended for purposes provided for in this Agreement
shall be returned to the Department.

3. PAYMENT SCHEDULE. Subject to the availability of funds for such purpose,
the Department agrees to pay the Recipient in accordance with the following payment schedule:

Within ten (10) days from the Department's receipt of the executed
contract.

Upon certification by the Recipient and Department that the project has
been completed in accordance with the provisions of this Agreement.
Final disbursement shall not be made until Recipient complies with all
grant close-out requirements contained in Attachment B, which is
incorporated by reference and made a part of this Agreement.

4. HOLD HARMLESS OBLIGATIONS. The Recipient hereby agrees to the
following hold harmless provisions:
a. The Recipient shall hold the Department, its agents and employees,
harmless from and shall defend it against any and all claims resulting from or arising out of the
grant, including, without limitation, damage claims for injury to persons or property.
b. The Recipient has submitted an application for the funds herein, and
expressly acknowledges that the Department, its agents and employees, in passing through such
funds, has neither assumed nor undertaken any legal duties to the Recipient or others. The
Recipient agrees to make no claims or demands against the Department, its agents or employees,
for any damages that may result from or arise out of the disbursement of the funds hereunder,
even if such claims or demands are made against the Recipient.
s. CONFLICTS OF INTEREST. The Recipient hereby attests that all of the
officials of the Recipient have certified that they have not violated any applicable conflict of
interest law under either state law (O.C.O.A. Sections 45-10-20 through 45-10-26 and 36-67A-l
through 36-67 A-4) or under any local ordinance, charter, rule or regulation and that they shall
comply with the same throughout the terms of this Agreement.
6. LAWS AND ORDINANCES. The Recipient will comply with all
applicable state laws and local ordinances, including these that govern the procurement of goods
and services.

7. MONITORING AND AUDITS. Upon request, the Recipient agrees to
provide the Department with any information the Department deems necessary to monitor the
performance of this agreement, and further agrees that these funds shall be included in the next
regularly scheduled audit or financial statement and all subsequent ones until such audits or
statements account for all grant funds. The Recipient understands that any unresolved findings,
whether based on an audit report, financial statement, or the final report, shall preclude the
Recipient from applying for and receiving any further grants from the Local Government
Efficiency Grant Program.
8. OPEN MEETINGS. The Recipient certifies that in approving this Agreement, it
has complied with the requirements of Chapter 14 of Title 50 of the Official Code of Georgia
Annotated regarding open meetings.
IN WITNESS WHEREOF, the parties have executed this Agreement as of the date first
stated above.

PROJECT DESCRIPTION:
The Recipient shall use said grant funds as outlined in its Local Government Efficiency Grant
application to implement the consolidation of government units with the following party:
Richmond County. The results of such consolidation implementation shall be reported to the
Department in accordance with Rule 110-5-1-12 of the Rules of the Department of Community
Affairs.
SPECIAL STIPULATIONS:
The Transition Task Force shall actively involve the Department in the transition process and
provide the Department with periodic updates of their activities.

On 6/20/95, Augusta and Richmond County voted on and passed a consolidation bill establish-
ing a new charter for the City and County. Pursuant to that legislation, a transition
task force has been appointed and is working toward implementation of a consolidated
government.

RESOLUTION
WHEREAS, the voters of the City of Augusta and Richmond
County have approved a referendum to consolidate their governments
on January 1, 1996;
WHEREAS, the two governments will need additional
resources to accomplish this task;
NOW, THEREFORE BE IT RESOLVED that the Board of
Commissioners of Richmond County endorses an application to the
State Department of Community Affairs for a local government
efficiency grant in the amount of $247,500; and
BE IT FURTHER RESOLVED that the Board of Commisioners of
Richmond County pledges $1,000 cash and $49,981.93 in-kind labor
toward the cost of the implementation of a consolidated government

In reviewing the Consolidation Implementation Grant Regulations, and specifically sec-
tion 110-5-4-.03, I would make the following comments:
a. (The need for the consolidation) Please note that the Supplemental Submission goes
into great detail explaining the reasoning behind the proposed consolidation. These
reasons include:

Providing the total community with a better opportunity to become a signifi-
cant economic entity in the southeast;
2.
Facilitating economic recruitment;
3.
Changing the perception of Augusta from that of a small community to a com-
munity of approximately 200,000, thereby providing state-wide clout as the
second largest city in the State of Georgia;
Improving the overall delivery of services to the citizens of Augusta and Rich-
mond County;
Reducing personnel costs by eliminating duplicative jobs;
Providing traditional municipal services to the urban area outside of the cur-
rent city limits;
Expanding the existing city water and sewerage system to benefit all residents
of Richmond County and eliminate double water rates for county users;
Allowing for Augusta's expansion so as to prevent it from falling further behnid
growing suburbs and reversing the decline in the city's financial position;
Providing a broader tax base to support the city's infrastructure;
Facilitating minority economic development and creating an opportunity
whereby black businesses can have increased participation in the provision of
goods and services for a new government;

Eliminating city(county disputes and bickering;
Providing an opportunity for new faces and new leadership in the local govern-
ment; .
Positioning Augusta(Richmond County to compete for federal grant funds; and
Retaining its status as the core city with the potential incorporation of Colum-
bia County.
b. (Potential cost savings, etc.) Please note that in the supplemental information sub-
mitted, it is pointed out that with consolidation there would be an elimination of
duplicative jobs, thereby allowing for an expansion of services. Further, with the

expanded tax base, and availability of the city's water and sewer system, water and
sewerage would be more readily available to residents of the unincorporated area;
traditional urban services, such as transit, would become more available to the subur-
ban residents; and, the economic benefits from a growing community will increas
ethe quality of life for all residents of Richmond County.
c. Although the 1990 Census showed Richmond County with a population of 189,719,
it is generally recognized that Richmond County currently has a population of ap-
proximately 200,000. Of this, the City of Augusta currently has a population of
44,639, according to the 1990 Census, and this population has probably decreased
since that date. All of these individuals will be impacted by the planned consolidation.
d. Certainly I believe that the implementation costs as set forth in the proposed budget,
incouding the in-kind services, appear reasonable, and in fact, the in-kind service esti-
mates are probably extremely conservative of the amount of the actual time that will
be devoted to th is project.
