AGREEMENT
RICHMOND COUNTY
THIS A~REEMENT, made and entered into as of the , day of
~A~ 20~, by and between AUGUSTA, GEORGIA, a political subdivision of the
State of Georgia, acting through the Augusta Commission and hereinafter
referred to as "AUGUSTAn and GROVETCIfN, a political subdivision of the State of
Georgia, nGROVETOWN".
WITNESSETH:
WHEREAS, GROVETOWN desires to utilize a sanitary sewer trunk line, known
as the Butler Creek Interceptor Extension, a sanitary sewer trunk line, owned
by AUGUSTA, and AUGUSTA desires to allCM GROVE'l'Clfi to utilize the sanitary sewer trunk
line, all under certain specified tenns and conditions; and
WHEREAS, GEUVEl'Cm agreed to contribute a sun of $100,000 (one htmdred thousand
dollars and no cents) as their portion of the construction of said sewer line, whidl is
payable at the signing of this agreE!IEIlt; and
WHEREAS, allowing GROVETOWN to use AUGUSTA'S sanitary sewer trunk line in said
area would alleviate the need of GROVETOWN to construct a sewerage lift station: and
WHEREAS, GROVETOWN' desires to obtain sewerage treatment services from AUGUSTA and
AUGUSTA is willing and able to furnish such services: and
WHEREAS, the parties desire to set forth the terms and conditions under which
such purchases shall be made and such services shall be provided.
NOW, THEREFORE, in consideration of the premises and the mutual agreements
hereinafter set forth, it is agreed that:

1. Term; Termination.
The duration of this Agreement shall be' for five (5) years and three
(3) months, commencing October 1, 2007 and terminating midnight, December
31, 2012. This Agreement may be renewed for an additional term of five (5)
years upon the mutual agreement of the parties. Either party may
terminate this Agreement upon providing at least six (6) months
written notice to the other party. Either party may terminate this
Agreement upon the default of the other party, which default is not cured
within 30 days after written notice thereof is provided in accordance with
this agreement.
2. Sewerage Trea1:nEnt Services.
a. Basic Rate. AUGUSTA agrees to provide sewerage treatnent
services to Grovetown. Said services shall be provided at a rate of $1.80
per 1,000 gallons of sewerage treated, beginning October 1, 2007 and
extending through ~r 31, 2007. Beginning January 1, 2008, the rate
per 1000 gallons of sewerage treated shall increase as stated in paragraph
2.b. AUGUSTA and GROVElmN agree that said rate is resed on the IlEtered
flow in the Butler Creek Interceptor Extension, IIEasUred in a IlEtering
manhole in said sewer line, near the COliM3IA CUJNI'Y/AImSTA boundary line,
with the exception of a period of tillE beginning with GRCJVEI'CWN'S cx>nnection
to said sewer line, October 1, 2007, and ending with the installation, and
start of cwration, of the flow IlEter. Olarges for this period of tillE will
be billed ~ follows:
~en' the flow IlEter is installed, and deEm:rl to be operational, the
<flow will be averaged for the first thirty (30) days of IlEtering and
. Groveta-m will be back-billed for the period of tillE, beginning on October
1, 2007 and endin<Jt the day the flow IlEter CXIIIIEnces operation, resed on this
average.

b. Increases. The Basic Rate for the provision of sewerage
treatIIEnt services to GROVETCMN by AUGUSTA as set forth in Subsection
2. a., above, shall be increased 3% per year to correspond with increases
in price to residential and COIIIrercial custOIIErs in AUGUSTA.
c. Payment. AUGUSTA shall read the meter no less than once a month
and shall forward a monthly invoice to GROVETOWN for sewage treatment
services. Payments for sewage treatment services shall be made monthly and
shall be due payable no more than thirty (30) days from the date of invoice.

IN WITNESS WHEREOF, AUGUSTA and GROVETOWN have caused the
execution of this Agreement by and through their respective duly
elected officers, with their respective seals being affixed hereto,
as of the day and year first above written.
