Tyler Augusta Utilities Department 360 Bay Street, Suite 180 Augusta, Georgia 30901 (706) 312-4143 GOVERNMENTAL ENCROACHMENT AGREEMENT Southern Natural Gas (hereinafter referred to as "Southern") hereby consents for Augusta, Georgia, a political subdivision under the laws of Georgia (hereinafter referred to as "Augusta") to use an area within Southern's subject gas pipeline right(s)-of-way for the installation and maintenance of a sanitary sewer line. Said right(s)-of-way being described as follows: 04-0024 Encroachment: Augusta Utilities 24-lnch Sanitary Sewer Crossings; South Main Line @ MP 476.02, Richmond County, Georgia RIW 2M5A #249 and 2M5A-L3 #249, as shown on the attached sketch. Subject to the following terms and conditions: 1. Augusta will notify Southern's Savannah Area Representative (912/748-2949) at least 72 hours prior to commencing construction in the vicinity of Southern's facilities. In that Southern must perform and work on its gas pipeline or other facilities near Augusta's sanitary sewer line, Southern will notify the Augusta Utilities Department (800/482-7411) at least 72 hours prior to commencing such activities. 2. Augusta will not permanently remove any cover from Southern's gO-foot wide right of way. 3. The sewer main is to cross Southern's easement as near to ninety (90) degrees as practical. In the event that Southern's gas pipeline is moved or replaced, said line will be moved or replaced in such a manor so that it crosses Augusta's sewer main as near to ninety (90) degrees as practical. 4. If boring is necessary, Southern's gas pipelines must be exposed by hand and with a representative of its local district office present before commencing boring operations. If boring or digging is necessary, Augusta's sanitary sewer line must be exposed by hand and with a representative of its local district office present before commencing boring operations. .~ 1 5. Both parties agree that whether the sewer main will cross over or under Southern's gas pipelines a 24-inch separation must be maintained between the sewer main and the nearest of Southern's gas pipelines. 6. Neither party shall install or move their respective gas pipeline or sewer line so that the joints for the sewer main will come within a five (5) foot radius of the gas pipelines. 7. Each of the parties agree to protect, hold harmless and fully indemnify the other, its directors, officers, agents, representatives, contractors, subcontractors and employees, against any and all claims, losses, costs, expenses (including reasonable attorney's fees), liabilities or liens for or based on environmental, property damage, personal injury, death, or failure to make payments as they come due, or failure to comply with applicable government regulations or permits, whether with respect to the parties hereto or third parties, arising out of or in connection with the construction, installation, operation, maintenance, repair or removal of their respective gas pipe line or sewer main.
