GEORGIA EMERGENCY MANAGEMENT AGENCY AND Augusta-Richmond County FOR THE USE OF DIGITAL RADIOS This Agreement is entered into between the Georgia Emergency Management Agency (GEMA), an agency of the State of Georgia, and Augusta-Richmond County, a political subdivision of the State of Georgia (Political Subdivision). . WIT N E SSE T H: WHEREAS, GEMA is the owner of certain Southern Linc digital radio equipment programmed in coordination with GEMA and Southern Linc Company. WHEREAS, GEMA acting under authority conferred to the Governor pursuant to O.C.G.A. 38-3-25 (a) 92), is authorized to lease or loan personal property, including digital' radio equipment, to any political subdivision of this State on such terms and conditions as are deemed necessary to promote the public welfare and promote the interest of the State; and WHEREAS, GEMA and Political Subdivision believe that the use of digital radio equipment will enhance communication capabilities between them, and thereby promote the public welfare and safety through improved emergency responses; WHEREAS, Augusta-Richmond County is' identified as a Hurricane Risk/Host County or is a Waste Isolation Pilot Plant (WIPP) County; NOW, THEREFORE, IT IS AGREED by and between GEMA and Political Subdivision that upon execution of this Agreement, GEMA shall loan or transfer a digital radio to Political Subdivision, subject to the following terms and conditions: 1, GEMA will deliver certain digital radio equipment to Political Subdivision upon execution of this agreement. ~ ; T .,. 2. Only employees and volunteers of Political Subdivision who are assigned emergency response or emergency management responsibilities shall be allowed to use the digital radio equipment. 3, Upon execution of this Agreement Political Subdivision agrees to maintain the digital radio equipment in proper working order and agrees to pay the monthly digital radio service charge after the first six months. GEMA will agree to purchase radio airtime for the first six months of service. No telephone airtime will be provided by GEMA. 4. This Agreement may be terminated if: a) Political Subdivision fails or refuses to pay service fees, as assessed by Southern Linc, or to maintain the digital radio equipment in proper working order; b) Southern Linc should discontinue digital radio services for Political Subdivision due to non-payment of service fees; and c) Either party of this Agreement gives 24 hours notice of termination to the other. In the event of termination pursuant to this paragraph or otherwise, Political Subdivision shall return all digital radio equipment received under this Agreement to GEMA in proper working order or remit to GEMA the fair market value of any digital radio equipment that is not returned in proper working order as of the time of termination. In the event of loss of a digital radio prior to termination, Political Subdivision shall reimburse GEMA for the value of the digital radio as of the date of loss, provided nothing herein shall be construed to prevent GEMA from waiving such right of reimbursement if an incident report is submitted and GEMA concludes that the loss was unavoidable. .
