This agreement is made and entered into this
The Augusta Recreation and Parks Department has identified a need to contract
Food and Beverage Concessions to an outside vendor at the following locations:
Fleming Park, Eisenhower Park, May Park.
L ~ltitontract will be in effect for the 1999 Baseball/Softball Season( starting
. , 1999), and Youth FootballlBaseball Season(ending Nov. 30, 1999) as
offered by the recreation department.
The agreeing parties acknowledge and understand the following conditions:
PRODUCTS
All items for re-sale are the responsibility of the vendor. The Augusta
Recreation Department assumes no liability associated with theft of products for
food and beverage re-sale.
After the initial product list has been established, any additional products or
changes in prices must be approved by the recreation department.
All Coca-Cola products using fountain mix should be coordinated through the
local Coca-Cola distributor, with the point of contact Mr. Donnie Wren (736-
2211 ).
The Concessionaire will assure that all products offered are fresh and are
within the product freshness date. The Recreation Department reserves the right
to have the concession stands inspected for product quality by the Richmond
County Health Department.
No Alcoholic beverages may be sold.
PROCEDURES
Opening Each stand is to be open thirty (30) minutes prior to the first
scheduled game. All schedules will be supplied by the Recreation Department
athletic staff and delivered to the Concessionaire.
Closing Each concession stand will remain open at least until the mid point of
the last scheduled game. The exact closing time for each stand will be left to the
discretion of the Concessionaire.
The Augusta Recreation Department will notify the Concessionaire of any
cancellation of games.
Cleaning The Concessionaire will assure that the stands are neat, clean and
presentable at all times. The Concessionaire will be responsible for all cleaning
supplies associated with the upkeep of each stand.
EMPLOYEES
The Augusta Recreation Department requires that all concession employees be
professional, polite, courteous, and dressed appropriately at all times.
The Augusta Recreation Department requires a minimum of two (2) employees
at the Fleming Complex at all times, with the remaining two stands to be staffed at
the Concessionaire's discretion.
The Augusta Recreation Department reserves the right to require additional
stand employees if any stand is not staffed with a number of employees sufficient
to handle the amount of customers.
MAINTENANCE
Building The Augusta Recreation Department will be responsible for repairs to
the concession building. Any damages or problems with the building will be
reported to the recreation department.
Equipment/Machines The Augusta Recreation Department will assure that all
machines and equipment are operable when the Concessionaire assumes control.
Any problems with equipment after control is assumed will be handled by the
Concessionaire with assistance from the recreation department. The
Concessionaire will be given a complete equipment inventory list and will be
checked by the Concessionaire before assuming control. After the Concessionaire
assumes control, a thirty (30) day period will be instituted to cover any equipment
or machinery failures in which the recreation department will cover any repairs.
After the thirty (30) days, the Concessionaire will be responsible.
Power The Augusta Recreation and Parks Department will be responsible for
providing utilities at the three (3) sites.
Pest Control The Augusta Recreation Department will provide pest control
services at the three (3) concession stand sites.
Keys The Augusta Recreation Department will supply two (2) sets of keys per
site. The Concessionaire will be responsible for returning both sets for each site at
the conclusion of this Agreement.
EVALUATION AND TERMINATION OF AGREEMENT
An evaluation will be conducted by the Augusta Recreation Department at the
season's mid-point and at the conclusion of each season.
Either party reserves the right to terminate this Agreement for any reason with
a minimum of thirty (30) days notice.
PAYMENTS FOR CONCESSION RIGHTS
The Concessionaire shall submit to the Augusta Recreation Department six per
cent _6_% of the gross income received for all sales under this Agreement. This
amount is due at the end of each month during the term of this Agreement.
A complete financial report shall be prepared every two weeks and submitted
to the Augusta Recreation Department. Each such report shall include an itemized
financial statement for each stand reflecting all revenues generated.
INDEMNITY
The Concessionaire agrees to hold Augusta, Georgia, the Augusta Recreation
Department, their successors and assigns harmless against liability arising out of
their performance or failure to perform any services required pursuant to this
Agreement including reasonable attorneys' fees and expenses of litigation
incurred by Augusta, Georgia in defense of any claim arising out of the
Concessionaire's performance or failure to perform any services required pursuant
to this Agreement.
