SUBORDINATION AGREEMENT
THIS AGREEMENT, made and entered into this 8th day of
August ,2007, by and between AUGUSTA, GEORGIA, a political subdivision
of the State of Georgia (hereinafter referred to as "AUGUSTA"), and FIRST UNION
MORTGAGE CORPORATION and subsequently assigned to MORTGAGE
ELECTRONIC REGISTRATION SYSTEMS, INC. as nominee for MIDFIRST BANK,
(hereinafter referred to as "BANK");
WITNESSETH:
WHEREAS, JAMES R. GARRISON, JR., (hereinafter referred to as "OWNER")
on August 31, 1987 gave to First Union Mortgage Corporation a Security Deed to the
property described on Exhibit A, to secure a certain indebtedness to BANK and said
Security Deed is recorded in the Office of the Clerk of the Superior Court of Richmond
County, Georgia, in Realty Reel 270, page 752 and Assignment dated April 12, 2001 and
recorded in said Clerk's Office in Book 787, page 1064.
WHEREAS, OWNER has granted an Easement, as shown on Easement Plat for
Augusta Commission Horsepen Phase 2 Sewer Collection System Horsepen Branch
Basin - Project No. 50202 and attached hereto as "Exhibit B", dated
to AUGUSTA across the property described on Exhibit A,
the original said easement is to be recorded in the Office of the Clerk of the Superior
Court of Richmond County, Georgia; and
WHEREAS, BANK is willing to subordinate the lien of its said Security Deed
dated August 31, 1987 and Assignment dated April 12, 2001 to any interest that
AUGUSTA may have in the above referenced easement.

does hereby agree and declare that the lien of the Security Deed from OWNER to BANK,
dated August 31, 1987, and recorded in the Office of the Clerk of the Superior Court of
Richmond County, Georgia in Realty Reel 270, page 752, and Assignment dated April
12,2001 and recorded in said Clerk's Office in Deed Book 787, page 1064, is and forever
shall be subject, subordinate and inferior in lien right and dignity at all times to the
easement from OWNER to AUGUSTA which is to be recorded in the aforesaid Clerk's
Office.
WHEREFORE, BANK has caused this instrument to be executed by its duly
authorized officers and seal affixed, all on the date above first written.

by George L. Godman & ASllociatell, dated February 7, 2005, revised June 18, 2005,
which reference is made for a m.ore accurate and complete description of the metell,
bounds and courses, and being for the purpose of laying, relaying, installing,. extending,
expanding, adding, operating, repairing and maintaining pipelines transporting and
carrying utility services.
