HomeMy WebLinkAboutEMC ENGINEERING CONSULTANT SERVICES AGREEMENT BETWEEN AUGUSTA ENGINEERING DEPARTMENT AUGUSTA, GEORGIA AND EMC ENGINEERING SERVICES, INe. This Agreement is made and entered into this 13th day of December, 2004, by and between Augusta, Georgia, hereinafter called the "City" and EMC Engineering Services, Inc, a Corporation authorized to do business in Georgia, hereinafter called the "Consultant." Whereas, the City desires to engage a qualified and experienced consulting firm to furnish professional services for: Provide engineering support to Augusta Georgia Engineering Department in plan review for private and public developments and quality control services for City projects on an on-call basis. EMC Engineering Services will provide technical assistance related to drainage issues to include site visits, analysis and design support for drainage related issues on an on call basis. (See Attachment A) Whereas, the Consultant has represented to the City that it is experienced and qualified to provide the services contained herein and the City has relied upon such representation. Now, therefore, in consideration of the mutual promises and covenant herein contained, it is agreed by and between the City and the Consultant that the Consultant shall provide the professional services as detailed in the Consultant's proposal dated November 3, 2004. (See Scope of Services.) Engineering Department Professional Services Agreement April, 2005 AMOUNT OF CONTRACT It is agreed that the compensation hereinafter specified to perform the services (see Scope of Services) required by this Agreement includes both direct and indirect costs chargeable to the project. Engineering Services: $ 85,000.00 The maximum obligation of the City to the Consultant under the terms of this Agreement shall be: $ 85,000.00 Engineering Department Professional Services Agreement April, 2005 2 I(JV ~. Articles, papers, bulletins, reports, or other materials reporting the plans, progress, analyses, or results and findings of the work conducted under this agreement shall not be presented publicly or published without prior written approval in writing by the City. It is further agreed that if any information concerning the project, its conduct, results, or data gathered or processed should be released by the Consultant without prior approval from the City, the release of same shall constitute grounds for termination of this agreement without indemnity to the Consultant, but should any such information be released by the City or by the Consultant with such prior written approval, the same shall be regarded as public information and no longer subject to the restrictions of this agreement. REVIEW OF CONSTRUCTION PLANS AND QUALITY CONTROL REVIEW OF CPB PROJECTS EMC Engineering Services, Inc. has the experience and diversity necessary to efficiently review parcel plats, construction plans, design calculations, and final subdivision plats. Upon completion of review EMC will provide recommendations for revising or accepting these documents. We will also provide Quality Control reviews for City projects as requested. The following is our proposed method of the review process for the above documents. We will work with the August-Richmond County (ARC) Public Works & Engineering Department to refine this process as needed to meet ARC's needs. Upon receipt of the documents submitted for review, Public Works & Engineering will review plans for completion against the checklist in the Augusta Development documents before forwarding for technical and regulating review. After checklist review has been completed, Public Works & Engineering will contact EMC's project manager to schedule document pick up. We will have a runner pick these plans up within a day of notification. Upon pick up an EMC representative will sign out plans to be reviewed. The documents will be delivered to the EMC local office and checked in by the project manager. Documents will be reviewed for compliance as set forth in the Augusta- Richmond County Development Regulations Guide for Augusta, Georgia and good engineering practice. Submittals will typically be reviewed by EMC within 15 calendar days of receipt. EMC will also perform a cursory review of soil erosion measures, driveway permits, sanitary sewer extensions and water and wastewater distribution systems for general compliance but these documents must be reviewed by the appropriate state governmental agencies. Wetland issues can also be reviewed for general compliance, but the Corps of Engineers will have to approve any impacts to wetlands. Upon completion of the review, a draft letter with comments and/or recommendation for acceptance will be written. This letter will be reviewed, edited, and signed by the designated project manager/coordinator who is a registered professional engineer in the State of Georgia. This letter will be faxed or emailed to ARC's PW Director or appointed representative for review and concurrence, with the original to follow via currier within 7 calendar days. Once ARC's PW Director or appointed representative has reviewed EMC's recommendations for acceptance or non-acceptance, ARC will be responsible for forwarding their final recommendations to the Planning and Zoning Commission for distribution to the developer's engineer. Resubmittal of previously reviewed documents will be reviewed for compliance with ARC's revision recommendations and resubmitted to ARC's PW Director or appointed representative within 7 calendar days. This procedure affirms that the reviews are being completed by EMC, and enables ARC's PW Director or appointed representative to be familiar with each project and its status in the review process. Plan Review Turnaround (calendar days): 1 st Submittal 15 days 2nd submittal 7 days 3rd submittal 3 days EMC's project manager, will be available to attend any meetings deemed necessary by ARC. This could include public hearings, Planning Board meetings, Council meetings, or individual meetings with the Public Works Director or appointed representative. .. It is understood that during the time frame when construction plan review services are being rendered all private development construction documents prepared by EMC will be reviewed by ARC personnel only. We can assure you that each project will be reviewed in a timely and efficient manner, which will minimize the cost to Augusta Richmond County and assure sufficient time for comments to be appropriately addressed. II. ASSISTANCE WITH TRACKING AND ASSESSING DRAINAGE ISSUES · Upon the written request of ARC's PW Director or appointed representative, EMC Engineering Services will provide technical assistance related to drainage issues to include site visits, analysis and design support for drainage related issues on an on call basis. · Upon the written request of ARC's PW Director or appointed representative, EMC Engineering Services will provide technical/engineering support related to civil engineering as needed. III. OTHER OPTIONAL SERVICES Upon the written request of ARC's PW Director or appointed representative, EMC Engineering Services will provide the following services: · Review of private development plans for traffic related issues. · Review of private development plans for compliance with the Tree Ordinance and other related requirements. · Assist with coordination and technical reviews with reference to the Storm Water Management Feasibility Study.
