S AGREEMENT, made and entered into this ;JA~ day of
, 1996, by and between Augusta-Richmond County,
he ina er referred to as "County", and the STATE OF GEORGIA,
acting by and through its DEPARTMENT OF CORRECTIONS, hereinafter
referred to as "GDC", an agency of the state of Georgia and body
politic, created and existing by virtue of the Constitutions and
Laws of the state of Georgia.
WITNESSETH THAT:
WHEREAS, the state Court of Richmond County has the
jurisdiction to adjudicate all criminal cases below grade of felony
committed within the territorial jurisdiction of the County; and
WHEREAS, pursuant to O.C.G.A. Section 17-10-3(g), GDC would no
longer supervise and process persons serving sentences under
probation from the State Court of Richmond County except for
misdemeanor offenses set forth in Title 16 (Criminal Code of
Georgia), Code Sections 40-6-391 (DUI), 40-6-393 (Vehicular
Homicide), 40-6-393.1 (Vehicular Feticide), 40-6-394 (serious
injury by vehicle), or 40-6-395 (c) (Impersonating a Police
Officer), and for high and aggravated misdemeanors; and
WHEREAS, it is necessary that two (2) accounting positions be
provided by the GDC to collect and process persons serving probated
sentences under O.C.G.A. 17-10-3 (g) from the State Court of
Richmond County;
WHEREAS, a formal agreement between the County and GDC is
necessary to provide for the manner, the amount, and the time of
reimbursement by the County to GDC for the expenses incurred in
providing said accounting positions.
TERMS, CONDITIONS AND PROVISIONS OF THIS AGREEMENT
NOW, THEREFORE, for and in consideration of the natural
benefits flowing from each party hereto to the other, it is hereby
agreed as follows:
1. This agreement shall be for a period commencing on the
1st day of July, 1996, and ending at 12 o'clock midnight on the
30th day of June, 1997, subject to renewal by the County at an
amount agreed to in advance by the parties.
2. The County shall provide GDC funding for two (2)
accounting positions in an amount not to exceed forty-nine
thousand, fifty dollars and eight cent ($49,050.08) total for the
period of July 1, 1996 to June 30, 1997.
3. GDC shall pay said accounting positions and the County
shall reimburse GDC for the cost of such salaries, including
pension, social security, and other benefits enumerated by GDC as
agreed to above by the County.
4. The County is obligated to pay GDC for the cost of all
other established rights and privileges granted state employees,
including, but not limited to, vacation and sick leave pay,
seniority and meritorious increments, civil service and pension
benefits, together with sums representing contributions by the
state to the General Employees Pension Fund or state Employees
Retirement System, and participation in the Group Insurance Plans
of the State of Georgia, costs for which will be enumerated in the
billing document submitted according to 5, below. Notwithstanding
the above, accounting positions shall remain and be at all times
and for all purposes State employees.
5. For the use and services provided by the two (2)
accounting positions, the County agrees to pay GDC quarterly
payments beginning on the first day of October 1 , 19 96 ,
following the receipt by the Augusta-Richmond County Administrators
Office, Room 605 City-county Building, 530 Greene Street, Augusta,
Georgia 30911, reflecting the actual quarterly salary and other
costs incurred by the GDC. All payments accruing under this
agreement shall be due and payable in full thirty (30) days
following the end of the quarter in which the same accrued.

Office shall be under the supervision of the Chief
Officer of the Augusta Judicial Circuit, or his/her

other fees in accordance with the rules, regulations, policies and
procedures of GDC and the rules, regulations, policies and
procedures of the State Court of Richmond County. Probation
supervision fees ordered by the Richmond County state Court on
cases under the jurisdiction of O.C.G.A. 17-10-3(g) would be
disbursed to the Augusta-Richmond County Commission-Councilor
other agency designated by said Court. A list of all delinquent
accounts shall be submitted to the Court on a regular basis for
appropriate action to be taken.
8. All of the costs of the operation of the probation system
as contemplated by Ga. L. 1956, pp. 27 and 161, as amended
(O.C.G.A. sections 42-8-20 et. seq. and 42-2-11), shall continue in
full force and effect hereafter until terminated by either party
hereto upon sixty (60) days written notice to the other party of
intention to terminate same. GDC, in this event, will continue
supervision of probationers until the end of the period of
probation and/or until the conditions of probation are satisfied,

but no new probation responsibilities will assign after the date of
the written notice to the other party of intention to terminate
same. However, termination of this contract will not in any way
abrogate the responsibility GDC has for the supervision of
probationers in the state Court of Richmond county under provisions
of Ga. L. 1972, page 125, as amended.
9. The County retains the right, privilege, and options of
renewing and extending this agreement at the expiration of the
aforementioned term. Said renewal or extension shall be upon the
same conditions, provisions, and terms as herein set forth, except
that the monthly and annual cost shall be updated by GDC and
current positions costs submitted by GDC for review by the County.
10. Upon any termination of the agreement or termination of
any renewal or extension thereof, County's obligations to reimburse
GDC for accounting positions assigned to the State Court of
Richmond County shall cease.
