RELEASE. HOLD HARMLESS. & INDEMNIFICATION AGREEMENT
This Hold Harmless and Indemnification Agreement (hereinafter " Agreement") IS
entered into by and between Ms. Clara Calloway (hereinafter "Releasor')and Augusta Richmond
County Consolidated Government (hereinafter "Releasee"), on this ~ay of ~, ~008
in Augusta, Georgia.
Ms. Clara Calloway, will indemnify, release, and hold harmless, Augusta, Georgia, the
Augusta-Richmond County Commission, and their agents and employees for any claims, actions,
judgments, injuries, damages, harm or losses, including all costs of defense and attorney's fees
incurred in defending the same, arising out of, related to, or as a consequence of the use of my
residence and surrounding property at 4119 Windsor Spring Road, Augusta, Georgia 30906 for
"
the Unveiling Ceremony for Anthony DeJuan Parkway on May 5, 2008.
This Agreement specifically applies to injuries, damages, losses or harm suffered
Releasor's spouse, heirs, legal representatives, and assigns or any third party and to claims of
personal and bodily injury or property damage.
Releasor has read and understands the risks involved in volunteering the use of her
residence and surrounding property at 4119 Windsor Spring Road, Augusta, Georgia, 30906 in
the ceremony. Risks of the activity include but are not limited to ACCIDENT OR INJURy.
Releasor voluntarily chooses to volunteer the use of said residence at 4119 Windsor Spring Road
Augusta, Georgia, 30906 in the Unveiling Ceremony. Also, Releasor voluntarily assumes full
responsibility for any risks ofloss, property damage or personal injury, including death, that may
be sustained by her, her spouse, heirs, legal representatives, assigns or third parties as a result of
my residence in the ceremony, whether caused by the negligence of the Releasees or otherwise.
It is her intent that this AGREEMENT shall bind the members of her family and spouse, if she is
alive, and her heirs, assigns and personal representative, if she am deceased. This agreement
shall be deemed as a RELEASE and CONSENT not to sue regarding any claims these parties
may have against Releasees relating to her participation in this activity, whether these claims
arise out of the negligence of the Releasees or otherwise.
Certification
THIS AGREEMENT SHALL BE CONSTRUED IN ACCORDANCE WITH THE LAWS OF
THE STATE OF GEORGIA AND IN SIGNING THIS AGREEMENT, I ACKNOWLEDGE
THAT I HAVE READ AND UNDERSTAND IT. THEREFORE, I SIGN THIS AGREEMENT
VOLUNTARILY.
