HomeMy WebLinkAboutBURKE COUNTY MUTUAL AID ASISTANCE AGREEMENT EMA ~ J BURKE COUNTY, GEORGIA MUTUAL AID ASSISTANCE AGREEMENT This mutual agreement entered into this :'-;2nd day of .s.etrt2008, by and between Burke County, on behalf of the Burke County Emergency Management Agency, and Augusta, Georgia, on behalf of the Augusta-Richmond County Fire Department. WHEREAS, it is deemed to be in the public interest to execute a Mutual Agreement wherein each of the departments ( agencies) assist the other in times of a local declared or undeclared disasters under circumstances where additional personnel, equipment, or specialized equipment and personnel may be needed in order to protect life and I or property. THEREFORE, in consideration of the mutual benefit to be derived by both the Burke County Emergency Management Agency and the Augusta-Richmond County Fire Department it is hereby agreed: 1. SERVICE: In the event of a local declared or undeclared disaster or emergency event or under circumstances, which indicate a local declared or undeclared disaster might develop within areas of either of the department's responsibility, mutual assistance in combating the disaster or emergency event will be rendered by the force not directly involved by the dispatching of equipment and personnel to the scene ofthe Burke County Emergency Management Agency or the Augusta-Richmond County Fire Department as the case may be. It is understood by both departments ( agencies) the consideration of being able to fulfill a request for assistance is heavily dependent upon local circumstances I conditions at the time of request. Being unable to fulfill a request for assistance due to local conditions Icircumstances at the time of request is not a violation of this agreement. 2. REQUESTING ASSISTANCE: Assistance under this Agreement may be requested or authorized by the following officials: (a) For the Burke County Emergency Management Agency, the Chief (Director), the Assistant Chief, a Battalion Chief or their chosen representative (b) For the Augusta-Richmond County Fire Department, the Chief or Deputy Chiefs or their chosen representative 3. SCOPE OF AUTHORITY: The Chief of the Burke County Emergency Management Agency shall bear the authority for directing all activities within its protection area, while the Chiefs of the Augusta-Richmond County Fire Department shall bear the authority for directing all activities within its protection area under this agreement. 1 !" -~ 4. COST AND REMUNERATION: No compensation will occur or become due for any service rendered under this agreement. Should an event reach the level of being declared a "state of emergency" by the governor or the governor's authorized representative and the Georgia Emergency Management Agency Statewide Mutual Aid and Assistance Agreement is activated, the Statewide Mutual Aid and Assistance Agreement automatically supercedes this agreement and becomes the effective and controlling mutual aid document. 5. RESPONSIBILITY AND LIABILITY: Neither organization will assume responsibility for damages to property as a result of activities made at the request of the other organizations. If circumstances change during providing assistance to the extent that it becomes necessary to recall personnel and I or equipment from the scene to answer a call elsewhere or provide adequate coverage in their primary, responsible area of protection due to local circumstances or conditions, it is not to be considered a breach of this Agreement. 6. DAMAGE TO EQUIPMENT: No liability is assumed by either party of damages to the equipment used by the other party. Should an event reach the level of being declared a "state of emergency" by the governor or the governor's authorized representative and the Georgia Emergency Management Agency Statewide Mutual Aid and Assistance Agreement is activated, the Statewide Mutual Aid and Assistance Agreement automatically supercedes this agreement and becomes the effective and controlling mutual aid document. 7. DEATH OR PERSONAL INJURY: Each party hereby waives all claims against the other party for compensation for any loss, damage, personal injury or death occurring in consequence for performance of this Agreement. 8. TERMINATION: Either party of this Agreement may terminate this Agreement at any time by giving thirty (30) days written notice to the other party, and no services will be rendered by either party after the effective date of termination.
