Dorsey-Sanders and Robert L. Sanders ~einafter called the "Applicant") in favor of Augusta, Georgia, a political iivision of the State of Georgia, acting by and through the Augusta-Richmond lty Commission (hereinafter "Augusta") i WITNESSETH: For and in consideration of Augusta's grant of permission for the )wing applicant to construct a permanent building within the easement of, across the pipeline of, its sanitary sewer pipeline (hereinafter called the :roachment"), which said sanitary sewer pipeline does cross applicant's )erty and is situated within a 40-foot Drainage and Utility easement which 3 along back of the applicant's property, located in Walton Acres iivision, Phase III, as shown in Exhibit "A" and in a plat of the iivision by W. R. Toole Engineers, Inc., dated March 28, 1997, and recorded :he Office of the Clerk of the Superior Court of Richmond County, Georgia, )eed Book 559, Pages 868-909, to which reference is hereby made for a more )lete and accurate description of said property, its exact location, :nsions, metes and bounds. The Applicant shall and does agree to indemnify and save harmless Ista, its agents, officers, servants and employees from any and all 3uits, actions or claims of any character brought because of any injuries or 1ge received or sustained by any person, persons or property arising out of construction and/or maintenance of the encroachment located as described :in. The Applicant shall and hereby agrees to maintain the encroachment Jood repair at the Applicant's sole expense and shall and does hereby :ase Augusta from any claims arising out of the Applicant's failure to 1tain the encroachment. Augusta reserves all rights, within the easement area, to 3truct, lay, relay, install, extend, operate, repair and maintain pipelines 1sporting and carrying utility services, and for any purpose deemed :ssary by Augusta. Applicant does understand and agrees that this may mean 1ge to, or the destruction of, the encroachment and hereby releases Augusta n any and all claims for damages to the encroachment as a result of such <: by Augusta. Augusta L notify Applicant prior to entering the encroachment, unless it is a case nergency. Applicant does agree that no trees shall be planted over the Line, or within 10 feet of both sides of the centerline of the entirety of 3anitary sewer pipe that runs across applicant's property. Applicant does = that no vegetation that may interfere with the laying, relaying, llling, extending, operating, repairing and maintaining of pipelines 3porting and carrying utility services, shall be planted over the pipeline, ithin 10 feet of both sides of the centerline of said pipeline. Applicant agrees that no other permanent structure shall be erected over the Line, or within 10 feet of both sides of the centerline of said pipeline. This Agreement in no way releases any interest and rights that 3ta has in, and too, the 40-foot Drainage and Utility Easement as shown in ~xhibit and plat. This Agreement shall be deemed a covenant running with the land and L be binding upon the Applicant's successors and assigns.
