HomeMy WebLinkAboutAMENDMENT ONE TO REVOCABLE LICENSE AGREEMENT BY AND BETWEEN THE STATE PROPERTIES COMMISSION AND AUGUSTA GEORGIA STATE OF GEORGIA No. .R of Two Executed Originals RECORDED AMENDMENT ONE TO STATE PROPERTIES COMMISSION REVOCABLE LICENSE AGREEMENT BY AND BETWEEN OCT 13 2010 THE STATE PROPERTIES COMMISSION 4p ` AND REAL PROPERTY RECORDS AUGUSTA, GEORGIA THIS AMENDMENT ( "Amendment ") is made this c3 411 of Oc4eLj er , 2010, by and between the STATE PROPERTIES COMMISION ( "SPC ") and AUGUSTA, GEORGIA ( "City "). WHEREAS, the SPC and the City entered into that certain Revocable License Agreement on July 26, 2010 with respect to the City's use of certain state -owned property located in Augusta, Georgia (hereinafter referred to as the "Agreement "); WHEREAS, the parties wish to amend the Agreement to reflect certain changes. NOW THEREFORE, the SPC and the City, in consideration of these premises and the mutual covenants and agreements contained therein, and for other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the parties hereby agree and covenant as follows: 1. Use of Licensed Premises. The language contained in paragraph 4 of the Agreement shall be deleted in its entirety and the following language shall be inserted in lieu thereof: "At its sole cost, expense, risk and responsibility, Licensee shall use the Licensed Premises only for the purpose of, and for no other purpose whatsoever, using the paved parking lot located on the Licensed Premises to accommodate overflow parking due to construction on the adjacent lot. Licensee shall use the paved parking lot for such overflow parking only between the hours of 6:00 am to 10:00 pm. Additionally, Licensee shall secure the perimeter of the Licensed Premises including securing all entry gates between 10:OOpm and 6:OOam and shall be responsible for the regular cutting or mowing of the grass on the Licensed Premises (securing of the perimeter and cutting of the grass shall hereinafter collectively be referred to as the "Services ")." 2. Definitions. All capitalized terms used in the Amendment and not expressly defined herein shall have the respective meanings given to such terms in the Agreement. 3. Successors and Assigns. This Amendment shall be binding upon and inure to the benefit of the successors and permitted assigns of the parties hereto. 4. Entire Agreement. Except as expressly modified by the Amendment One, the Agreement -_ shall be and remain in full force and effect in accordance with its terms and shall constitute the legal, valid, binding and enforceable obligations of the parties. This Amendment One and ' ,O the Agreement, collectively, are the complete agreement of the parties and supersede any a� prior agreements or representations, whether oral or written, with respect thereto.
