AMENDMENT TO ARTICLES OF AGREEMENT
THIS AMENDMENT to an Agreement for Project Grant No. NRT -05(4) dated the 19th
day of June, in the year TWO THOUSAND EIGHT (2008), and amended on the 13 day of
January, 2010, made and entered into this fliAlay of fjc. tok :V" , 2010, by and between
the Department of Natural Resources (hereinafter DEPARTMENT), whose address is 2 Martin
Luther King, Jr. Drive, S. E., Suite 1352, Atlanta, Georgia 30334, acting for and on behalf of the
State of Georgia, and Augusta- Richmond County (hereinafter referred to as the GRANTEE),
whose address is 530 Greene St., Augusta, GA 30901.
WITNESSETH:
WHEREAS the purpose of the original agreement between the parties was for
construction of approximately 2.6 miles of trail in the Lombard Mill Pond area, and installation
of trailhead amenities; and
WHEREAS the DEPARTMENT allocated grant funds in the amount of ONE
HUNDRED THOUSAND DOLLARS ($100,000.00) from the Georgia Recreational Trails Fund
to assist the GRANTEE with the above project; and
WHEREAS, due to unforeseen costs of construction of the project, the GRANTEE has
requested to modify the scope of the project and revise the cost estimate; and
WHEREAS the GRANTEE has proposed to modify the scope so that it would include a
handicapped accessible parking area, a wheelchair- accessible path from the road to the overlook
area, a wheelchair accessible observation deck, approximately 100 feet of concrete trail
extending northward from the observation deck, and an aggregate- surface trail approximately
770 feet long traveling southwest with wooden drainage crossings; and
WHEREAS the DEPARTMENT has reviewed the request for modification and finds that
it would be beneficial to the successful completion of the project;
NOW, THEREFORE, in consideration of the request from the GRANTEE and the
premises, conditions and covenants set forth in the original AGREEMENT, the parties agree to
amend said AGREEMENT as follows:

1) The Project scope is now modified in accordance with the GRANTEE's proposal,
and the scope shall be described as construction of a handicapped accessible parking area, a
wheelchair - accessible path from the road to the overlook area, a wheelchair accessible
observation deck, approximately 100 feet of concrete trail extending northward from the
observation deck, and an aggregate- surface trail approximately 770 feet long traveling southwest
with wooden drainage crossings; and
2) The cost estimate is now revised in accordance with the GRANTEE's proposal to
modify the scope of the project, and is attached to this Amendment as an Exhibit; and
3) The GRANTEE and DEPARTMENT mutually agree that all other terms and
conditions of the agreement shall be and remain in full force and effect.
IN WITNESS WHEREOF, the parties hereto have executed this AMENDMENT, to be
given effect as of the day and year first above written.
