AGREEMENT
THIS AGREEMENT is made and entered into this J.th day of March
2000, by and between The Academy of Youth Athletics, Inc. (AYA) and AUGUSTA,
GEORGIA ("Augusta"). This agreement will remain in effect for one (1) year. .
WHEREAS, The Academy of Youth Athletics, Inc. will accept the responsibility to
staff, develop and implement sound programs for the best interest of this community; and
WHEREAS, The Academy of Youth Athletics, Inc. deliberated that it would be
beneficial to both the Augusta Richmond County taxpayers and local Augusta residents for
The Academy of Youth AtWetics, Inc., and the Augusta Recreation and Parks Department
(ARPD) to jointly operate Hickman Park.
NOW, THEREFORE, for and in consideration of the mutual promises and the

covenants contained herein, and other good and valuable consideration, the receipt and
sufficiency of which is hereby acknowledged, the parties agree as follows:
A. Responsibilities of The Academy of Youth Athletics, Inc.
The Academy of Youth Athletics, Inc. shall provide adequate staffing of
Hickman Park, which shall include the following features:
1. Hours of Operation - Fall, Winter and Spring (September - May) 3:00
P.M.- 6:00 P.M.; Summer Gune -August) 11:00 A.M. - 5:00 P.M. at a

2. The Academy of Youth Athletics, Inc. shall provide staff for all rentals at
facility and follow the rental guidelines provided by the Augusta
Recreation and Parks Department, and shall have all volunteer staff
execute and keep on file a Volunteer Release Form (See Staffing
Requirements Attachment)

3. The (A Y A) shall issue keys for Hickman Park to members and officers of
The Academy of Youth Athletics, Inc.
4. The (A YA) shall maintain an inventory of all supplies furnished by the
(ARPD) of Hickman Park and shall perform general maintenance of the
interior/ exterior of Hickman Park, which includes mopping, sweeping,
and picking up their litter from grounds. (See Staffing Requirements
Attachment).
5. The (A Y A) shall formulate programs and activities for Hickman Park as
well as maintain a current safety inspection of all existing playground
equipment. In the event that any equipment is deemed unsafe, that
equipment must be properly labeled unsafe and Recreation personnel
must be contacted immediately.
6. The Academy of Youth Athletics, Inc. must follow all safety guidelines
set forth by the Augusta Recreation and Parks Department which include
notifying the Augusta Recreation and Parks Department immediately in
the following cases: break-ins property damage, or emergencies.
7. The Academy of Youth Athletics, Inc. shall be covered under the
Volunteer Protection Act of 1997,42 D.S.C. 14501, et seq.
8. All revenues received by Academy of Youth Athletics, Inc. for services
rendered at Hickman Park shall be expended for materials, supplies or
other services that directly effect the operations of Hickman Park.
B.
Responsibilities of Augusta Recreation and Parks Department
The Augusta Recreation and Parks Department shall be responsible
for assisting The Academy of Youth Athletics, Inc. in the operation
of Hickman Park as follows:

1. Supply all utilities.
2. Perform all repairs and normal maintenance for the upkeep of the
facility (painting, pesticide treatment, etc.)
3. Provide for trash collection from existing canister on grounds.
4. Provide for stripping/waxing of floors within the facility.
5. Supply both programming and janitorial supplies as budgeted and
approved by Augusta Commission.
6. Provide administrative assistance.
7. Supply all capital purchases, as needed depending on funding.
8. Provide assistance with special events that are programmed by the
(AYA).
9. Provide all necessary guidelines/manuals concerning building rentals
and safety questions.
10. Assume responsibility for break-ins and emergency situations that may
anse.
11. Assume responsibility for liability as provided in the Volunteer
Protec~on Act to the (A Y A).
Responsibilities of Augusta Recreation and Parks prior to lease
Replace rotten wooden surfaces, paint exterior trim of building.
Paint interior of building.
Strip and wax floors in building.
Resurface tennis court.
Purchase refrigerator and stove for kitchen and microwave.
Purchase TV/VCR for activity room.
Repair roof.
Provide (A Y A) Members with First Aid and CPR training.

9. Replace threshold on entrance door.
10. Replace cracked window panes.
11. Install security system.
The Augusta Recreation and Parks Department shall also provide the following
departmental contracts for the (A YA):

This Agreement contains the entire agreement of the parties, and no representatives,
inducements, promises or agreements, oral or otherwise, between the parties not embodied
herein shall be of any force or effect.
IN WITNESS WHEREOF, the parties hereto have caused these presents to be
executed, the day and year first above written.

ATTACHMENT
STAFFING REQUIREMENTS:
· ACAD EMY OF YOUTH ATHLETICS must supply staff members that meet the
following qualifications:
· Certified CPR and First Aid:
· Desire and knowledge of practices ~nd principles needed to develop activities for
children and adults: ' ..
· Clerical skills that involve maintaining records pertaining to program registrations, supply
inventories, rental contracts, user fees and other facility charges and information;
· Supervise programs for children.
· Have executed a Volunteer Release Form, in the form attached hereto.
GENERAL SUMMARY
It is the responsibility of the ACADEMY OF YOUlliATHLETICS to coordinate
and monitor activities held at Hickman Park within departmental and City guidelines. Also,
it is essential for the ACADEMY OF YOU1H ATHLETICS to work with instructors,
program participants, community leaders, civic organizations and the general public to
ensure programs and services.
